National Park Service Alaska Region's Subsistence Resource Commission Program; Open Public Meeting/Teleconference
The Aniakchak National Monument Subsistence Resource Commission (SRC) will meet to develop and continue work on National Park Service (NPS) subsistence program recommendations and other related subsistence management issues. The NPS SRC program is authorized under Title VIII, Section 808 of the Alaska National Interest Lands Conservation Act, Public Law 96-487, to operate in accordance with the provisions of the Federal Advisory Committee Act. The Federal Advisory Committee Act (Pub. L. 92-463, 86 Stat. 770) requires that public notice of this meeting be announced in the Federal Register. Great Bay National Wildlife Refuge, Rockingham County, NH; Final Comprehensive Conservation Plan and Finding of No Significant Impact
We, the U.S. Fish and Wildlife Service (Service), announce the availability of the final comprehensive conservation plan (CCP) and finding of no significant impact (FONSI) for Great Bay National Wildlife Refuge (NWR, refuge) in Newington, New Hampshire, which includes the Karner blue butterfly conservation easement in Concord, New Hampshire. Great Bay NWR is administered by Parker River NWR in Newburyport, Massachusetts. In this final CCP, we describe how we will manage the refuge and Karner blue butterfly conservation easement for the next 15 years.

Application From Marys River Ranch, Elko County, NV, for an Enhancement of Survival Permit; Safe Harbor Agreement
In response to an application from Marys River Ranch (applicant), the Fish and Wildlife Service (we, the Service) is considering issuance of an enhancement of survival permit pursuant to section 10(a)(1)(A) of the Endangered Species Act of 1973, as amended (ESA). The enhancement of survival permit application includes a proposed safe harbor agreement (SHA) between the applicant and the Service. The proposed SHA provides for voluntary habitat restoration, maintenance, or enhancement activities to facilitate the repatriation and recovery of Lahontan cutthroat within the enrolled property. The proposed duration of both the SHA and permit is 50 years. The Service has made a preliminary determination that the proposed SHA and permit application are eligible for categorical exclusion under the National Environmental Policy Act of 1969 (NEPA). The basis for this determination is contained in an environmental action statement, which also is available for public review.
Endangered and Threatened Wildlife and Plants; Proposed Listing of the Mount Charleston Blue Butterfly as Endangered and Proposed Listing of Five Blue Butterflies as Threatened Due to Similarity of Appearance
We, the U.S. Fish and Wildlife Service, propose to list the Mount Charleston blue butterfly (Plebejus shasta charlestonensis) as an endangered species under the Endangered Species Act of 1973, as amended (Act). We also propose to list the lupine blue butterfly (Plebejus lupini texanus), Reakirt's blue butterfly (Echinargus isola), Spring Mountains icarioides blue butterfly (Plebejus icarioides austinorum), and the two Spring Mountains dark blue butterflies (Euphilotes ancilla cryptica and E. a. purpura) as threatened due to similarity of appearance to the Mount Charleston blue, with a special rule pursuant to section 4(d) of the Act. We solicit additional data, information, and comments that may assist us in making a final decision on this proposed action. In addition, we propose to make nonsubstantive, administrative changes to a previously published listing and special rule regarding five other butterflies to correct some inadvertent errors and to make these two special rules more consistent.
Endangered and Threatened Wildlife and Plants; Endangered Status for Grotto Sculpin and Designation of Critical Habitat
We, the U.S. Fish and Wildlife Service, propose to list the grotto sculpin (Cottus sp. nov.) as an endangered species under the Endangered Species Act of 1973, and propose to designate critical habitat for the species. In total, all underground aquatic habitat underlying approximately 94 square kilometers (36 square miles) plus 31 kilometers (19.2 miles) of surface stream are being proposed for designation as critical habitat. The proposed critical habitat is located in Perry County, Missouri. If adopted, the effect of these regulations is to conserve grotto sculpin and its habitat under the Endangered Species Act.
Endangered and Threatened Wildlife and Plants; 12-Month Finding on a Petition To List Spring Mountains Acastus Checkerspot Butterfly as an Endangered or Threatened Species
We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to list the Spring Mountains acastus checkerspot butterfly (Chlosyne acastus robusta) as an endangered species under the Endangered Species Act of 1973, as amended (Act). After review of the best available scientific and commercial information, we find that listing the Spring Mountains acastus checkerspot butterfly is not warranted at this time. However, we ask the public to submit to us any new information that becomes available concerning the threats to the Spring Mountains acastus checkerspot butterfly or its habitat at any time.
Marine Mammals; Incidental Take During Specified Activities; Proposed Incidental Harassment Authorization
We, the U.S. Fish and Wildlife Service (Service), have received an application from Pacific Gas and Electric Company (PG&E) for authorization under the Marine Mammal Protection Act of 1972 (MMPA) to take small numbers of southern sea otters (Enhydra lutris nereis) by harassment, as those terms are defined in the statute and the Service implementing regulations, incidental to a marine geophysical survey. In accordance with provisions of the MMPA, we request comments on our proposed authorization for the applicant to incidentally take, by harassment, small numbers of southern sea otters for a period of 2.5 months beginning on October 15, 2012, and ending December 31, 2012. We anticipate no take by injury or death and include none in this proposed authorization, which would be for ``take by harassment'' only.

BOEM announces the availability of the Proposed NOS for proposed CPA Sale 227. This Notice is published pursuant to 30 CFR 556.29(c) as a matter of information to the public. With regard to oil and gas leasing on the OCS, the Secretary of the Interior, pursuant to Section 19 of the OCS Lands Act, provides affected States the opportunity to review the Proposed NOS. The Proposed NOS sets forth the proposed terms and conditions of the sale, including minimum bids, royalty rates, and rentals.

Extension of Post-Sale Evaluation Period for Consolidated Central Gulf of Mexico Planning Area Lease Sale 216/222
This notice extends through October 18, 2012, the post-sale evaluation period for Consolidated Central Gulf of Mexico Planning Area Lease Sale 216/222. BOEM will complete the evaluation process for all bids received in this sale by October 18, 2012. This action is necessary due to the temporary closure of the BOEM Regional Office building in New Orleans and other effects of the recent hurricane impacting the region.
Proposed Information Collection; Comment Request: NPS Institutional Animal Care and Use Committee (IACUC) General Submission, Annual Review, and Exhibitor Forms
We (National Park Service) will ask the Office of Management and Budget (OMB) to approve the information collection (IC) described below. This collection currently consist of three forms (General Submission, Annual Renewal, Exhibitor Submission) used by the Institutional Animal Care and Use Committee (NPS IACUC/the Committee) to ensure compliance with the Animal Welfare Act (AWA), its regulations (AWAR), and the Interagency Research Animal Committee (IRAC) principles for projects involving the use of vertebrate animals in research, teaching, and/or exhibition. To comply with the Paperwork Reduction Act of 1995 and as a part of our continuing efforts to reduce paperwork and respondent burden, we invite the general public and other federal agencies to comment on this IC. The PRA (44 U.S.C. 3501, et seq.) provides that we may not conduct or sponsor and a person is not required to respond to, a collection unless it displays a currently valid OMB control number and current expiration date.
Information Collection Activities: Timpanogos Cave National Monument Visitor and Community Survey
We (National Park Service) will ask the Office of Management and Budget (OMB) to approve the Information Collection (IC) described below. This collection will consist of a survey and a focus group script that will be used to collect visitors and local community members' perceptions and evaluations of four management issues (1) Cave tour size and frequency; (2) ticketing procedure and fees; (3) concession service quality and selection; and (4) safety concerns on park trails. As required by the Paperwork Reduction Act of 1995, and as part of our continuing efforts to reduce paperwork and respondent burden, we invite the general public and other Federal agencies to take this opportunity to comment on this IC.
Migratory Bird Hunting; Application for Approval of Copper-Clad Iron Shot and Fluoropolymer Shot Coatings as Nontoxic for Waterfowl Hunting
We, the U.S. Fish and Wildlife Service, propose to approve copper-clad iron shot and fluoropolymer coatings for hunting waterfowl and coots. We published a notice of application for nontoxic shot approval for copper-clad iron shot in the Federal Register on June 20, 2012 (77 FR 36980), and one for the fluoropolymer shot coatings on July 6, 2012 (77 FR 39983). Having completed our review of the application materials for both, we have concluded that neither the shot nor the coatings are likely to adversely affect fish, wildlife, or their habitats.
Alaska Native Claims Selection
As required by 43 CFR 2650.7(d), notice is hereby given that the Bureau of Land Management (BLM) will issue an appealable decision to Council Native Corporation. The decision approves only the surface estate in the lands described below for conveyance pursuant to the Alaska Native Claims Settlement Act (43 U.S.C. 1601, et seq). The subsurface estate in these lands will be conveyed to Bering Straits Native Corporation when the surface estate is conveyed to Council Native Corporation. The lands are in the vicinity of Council, Alaska, and are located in: Lot 1, U.S. Survey No. 9993, Alaska. Containing 129.97 acres.
Public Land Order No. 7802; Extension of Public Land Order No. 6944; Oregon
This order extends the duration of the withdrawal created by Public Land Order No. 6944 for an additional 20-year period. The extension is necessary to continue protection of the cultural and historical values of the Granite Chinese Walls Historic Site, which would otherwise expire on September 30, 2012.

Pennsylvania Regulatory Program
We are reopening and extending the public comment period and will be holding two public hearings on the proposed amendment to the Commonwealth of Pennsylvania's approved regulatory program (the ``Pennsylvania program'') published on July 11, 2012. The comment period is being reopened and extended in order to afford the public more time to comment and to allow ample time to conduct two public hearings. This extension was requested by the Citizens Coal Council and the Environmental Integrity Project. We are also notifying the public of the date, time, and locations for the public hearing. Pennsylvania is introducing beneficial use of coal ash into the Pennsylvania statutory scheme via Pennsylvania's Solid Waste Management Act (``SWMA''), the Clean Streams Law (``CSL''), the Surface Mining Conservation and Reclamation Act, and the Administrative Code. Pennsylvania intends to revise its approved program pursuant to the additional flexibility afforded by the revised Federal regulations and SMCRA, as amended, to ensure Pennsylvania's proposed provision is consistent with and in accordance with SMCRA and the corresponding regulations.
Appeal Proceedings Before the Commission
The National Indian Gaming Commission (NIGC or Commission) promulgates this final rule to enhance and clarify appeal proceedings before the Commission. This final rule removes three parts concerning appeals, and adds a new subchapter concerning appeal proceedings before the Commission. This final rule has six parts. First, the Rules of General Application in Appeal Proceedings Before the Commission define certain terms, set forth the burden of proof and standard of review, explain the content of a Commission decision, uniformly provide for resolution of an appeal if the Commission does not issue a majority decision, and clarify that an appeal of the Chair's decision for matters other than disapproval of a gaming ordinance does not stay the effect of that decision. Next, the regulations set forth rules for motion practice in appeals before the Commission. This part addresses: How an entity other than a tribe can request to participate on a limited basis in ordinance appeals; how parties file motions to intervene, to supplement the record, and for reconsideration; and how parties file motions before the presiding official. Following these two general parts, the regulations set forth more specific rules for the different types of appeals. Rules for appeals of ordinance disapprovals, management contract approvals and disapprovals, appeals before a presiding official, and appeals before the Commission on written submission only, each have their own unique appellate procedures.

Public Land Order No. 7801; Withdrawal of Public Lands for Protection of Proposed Expansion of Twentynine Palms; CA
This order withdraws approximately 507 acres of reserved Federal mineral estate from the United States mining laws including the mineral and geothermal leasing and mineral materials laws, and 331,786 acres of public lands from all forms of appropriation under the public land laws, including the United States mining, mineral and geothermal, and mineral materials laws for a period of 5 years. The withdrawal preserves the status quo of the lands and mineral estate included in the proposed training land acquisition/airspace establishment project of the United States Marine Corps Air Ground Combat Center, Twentynine Palms, California, pending the processing of an application for withdrawal for military purposes under the Engle Act. This order also includes 43,950 acres of non-Federal lands located within the boundaries of the withdrawal areas, and in the event that they return to Federal ownership in the future, the lands would be subject to the terms and conditions of this withdrawal.
Public Land Order No. 7977; Partial Revocation, Power Site Reserve No. 78; Colorado
This order partially revokes a withdrawal created by an Executive Order insofar as it affects 40.81 acres of National Forest System land withdrawn for protection of water power values designated as Power Site Reserve No. 78. This order also opens the land to such forms of disposition that may be made of National Forest System lands.
Public Land Order No. 7799; Withdrawal of Public Land for the Rock Springs Administrative Site Addition; Wyoming
This order withdraws 4.93 acres of public land from settlement, sale, location, and entry under the general land laws, including the United States mining laws, for a period of 20 years to protect the Rock Springs Administrative Site addition.
Public Land Order No. 7800; Extension of Public Land Order No. 6947; Oregon
This order extends the duration of the withdrawal created by Public Land Order No. 6947 for an additional 20-year period. The extension is necessary to continue protection of the recreational rockhounding area of the Thunder Egg Lake Agate Beds located in the Fremont National Forest in Oregon, which would otherwise expire on September 21, 2012.
Public Land Order No. 7798; Partial Modification of Power Site Classification No. 126; Washington
This order partially modifies a withdrawal which established Power Site Classification No. 126, insofar as it affects approximately 21.70 acres of National Forest System land withdrawn to protect water power values along the Nooksack River in Whatcom County, Washington. This order opens the land to such forms of disposition as may by law be made of National Forest System lands subject to a Section 24 Federal Power Act reservation.

Teleconference for the National Park Service Alaska Region's Subsistence Resource Commission Program
The Lake Clark National Park Subsistence Resource Commission (SRC) and the Wrangell-St. Elias National Park SRC will meet to develop and continue work on National Park Service (NPS) subsistence program recommendations and other related subsistence management issues. The NPS SRC program is authorized under Title VIII, Section 808 of the Alaska National Interest Lands Conservation Act, Public Law 96-487, to operate in accordance with the provisions of the Federal Advisory Committee Act. The Federal Advisory Committee Act (Pub. L. 92-463, 86 Stat. 770) requires that public notice of this meeting be announced in the Federal Register. Public Availability Of Comments: These meetings are open to the public and will have time allocated for public testimony. The public is welcome to present written or oral comments to the SRC. The meetings will be recorded and summary minutes will be available upon request from the park superintendent for public inspection approximately six weeks after each meeting. To comply with the Paperwork Reduction Act of 1995 (PRA), we are notifying the public that we have submitted to OMB an information collection request (ICR) for a new approval of the paperwork requirements in the regulations under Subpart B, Plans and Information, and related documents. Facility License Notifications and Submissions
The National Indian Gaming Commission (NIGC or Commission) is amending its facility license regulations. The final rule amends the current regulations: To provide for an expedited review to confirm a tribe's submittal of facility license information; to require notice to the NIGC when a tribe issues, renews, or terminates a facility license; to streamline the submittal of certain information relating to the construction, maintenance, and operation of a gaming facility; and to provide that a tribe need not submit a notification of seasonal or temporary closures of less than 180 days.
