Information Collection Activities: Well Control and Production Safety Training, Submitted for Office of Management and Budget (OMB) Review; Comment Request
To comply with the Paperwork Reduction Act of 1995 (PRA), we are notifying the public that we have submitted to OMB an information collection request (ICR) to renew approval of the paperwork requirements in the regulations under Subpart O, ``Well Control and Production Safety Training.'' This notice also provides the public a second opportunity to comment on the revised paperwork burden of these regulatory requirements.
Migratory Bird Subsistence Harvest in Alaska; Harvest Regulations for Migratory Birds in Alaska During the 2013 Season
The U.S. Fish and Wildlife Service (Service or we) proposes migratory bird subsistence harvest regulations in Alaska for the 2013 season. These regulations would enable the continuation of customary and traditional subsistence uses of migratory birds in Alaska and prescribe regional information on when and where the harvesting of birds may occur. These regulations were developed under a co-management process involving the Service, the Alaska Department of Fish and Game, and Alaska Native representatives. The rulemaking is necessary because the regulations governing the subsistence harvest of migratory birds in Alaska are subject to annual review. This rulemaking proposes region- specific regulations that would go into effect on April 2, 2013, and expire on August 31, 2013.

Notice of Intent To Prepare an Environmental Impact Statement for the Proposed Pacific Connector Gas Pipeline Right-of-Way Grant in Oregon and Possible Land Use Plan Amendments
In compliance with the National Environmental Policy Act of 1969 (NEPA), as amended; the Federal Land Policy and Management Act of 1976 (FLPMA), as amended; and the National Forest Management Act of 1976 (NFMA), as amended, the Bureau of Land Management (BLM) Coos Bay, Roseburg, and Medford Districts and the Klamath Falls Resource Area of the Lakeview District in Oregon and the Forest Service Umpqua, Rogue River, and Winema National Forests, Oregon, propose to amend their land management plans to make provision for the proposed Pacific Connector Gas Pipeline (Project) if the Project is authorized by the Federal Energy Regulatory Commission (FERC or the Commission). The BLM also proposes to respond to Pacific Connector LP's application for a right- of-way grant for the Project to occupy Federal lands. The FERC is the lead agency for preparation of an Environmental Impact Statement (EIS) for the proposed Pacific Connector Gas Pipeline (FERC Docket PF12-17), which includes the analysis for possible land use plan amendments.
Minimum Technical Standards for Class II Gaming Systems and Equipment
The National Indian Gaming Commission (NIGC) is amending its technical standards to change the order of the first five sections; add definitions and amend existing definitions; amend requirements and time restrictions for grandfathered Class II gaming systems; amend the requirements concerning minimum odds for Class II games; amend standards for test labs; remove references to the Federal Communications Commission and Underwriters Laboratory; require a player interface to display a serial number and date of manufacture; amend requirements concerning approval of downloads to a Class II gaming system; and clarify the term ``alternate standard.''
Minimum Internal Control Standards
The National Indian Gaming Commission (NIGC) amends its minimum internal control standards for Class II gaming under the Indian Gaming Regulatory Act to provide comprehensive and updated standards for all aspects of Class II gaming. These amendments replace the partial standards published in 2008 with a set of comprehensive standards for the entire Class II gaming environment. The new sections include, for example: Card games; drop and count; surveillance; and gaming promotions and player tracking. The amendments also update and reorganize existing sections, such as bingo and information technology. The amendments reflect advancements in technology and provide auditable standards while leaving more areas in which the Tribal Gaming Regulatory Authorities (TGRAs) may exercise discretion.
Migratory Bird Hunting; Late Seasons and Bag and Possession Limits for Certain Migratory Game Birds
This rule prescribes the hunting seasons, hours, areas, and daily bag and possession limits for general waterfowl seasons and those early seasons for which States previously deferred selection. Taking of migratory birds is prohibited unless specifically provided for by annual regulations. This rule permits the taking of designated species during the 2012-13 season.
Migratory Bird Hunting; Migratory Bird Hunting Regulations on Certain Federal Indian Reservations and Ceded Lands for the 2012-13 Late Season
This rule prescribes special late-season migratory bird hunting regulations for certain tribes on Federal Indian reservations, off-reservation trust lands, and ceded lands. This rule responds to tribal requests for U.S. Fish and Wildlife Service (hereinafter Service or we) recognition of their authority to regulate hunting under established guidelines. This rule allows the establishment of season bag limits and, thus, harvest at levels compatible with populations and habitat conditions.

We, the U.S. Fish and Wildlife Service (Service), have issued the following permits to conduct certain activities with endangered species, marine mammals, or both. We issue these permits under the Endangered Species Act (ESA) and Marine Mammal Protection Act (MMPA).
Endangered Species; Marine Mammals; Receipt of Applications for Permit
We, the U.S. Fish and Wildlife Service, invite the public to comment on the following applications to conduct certain activities with endangered species, marine mammals, or both. With some exceptions, the Endangered Species Act (ESA) and Marine Mammal Protection Act (MMPA) prohibit activities with listed species unless Federal authorization is acquired that allows such activities.
Migratory Bird Hunting; Final Frameworks for Late-Season Migratory Bird Hunting Regulations
The Fish and Wildlife Service (Service or we) prescribes final late-season frameworks from which States may select season dates, limits, and other options for the 2012-13 migratory bird hunting seasons. These late seasons include most waterfowl seasons, the earliest of which commences on September 22, 2012. The effect of this final rule is to facilitate the States' selection of hunting seasons and to further the annual establishment of the late-season migratory bird hunting regulations.
Montana Regulatory Program
We are approving an amendment to the Montana regulatory program (the ``Montana program'') under the Surface Mining Control and Reclamation Act of 1977 (``SMCRA'' or ``the Act''). Montana proposed revisions to and additions of statutory definitions of approximate original contour, in situ coal gasification, and recovery fluid. Montana revised its program to clarify ambiguities and improve operational efficiency. Montana intends to promulgate regulations pertaining to in situ coal gasification within one year. The statutory revisions discussed here will support that future rulemaking effort.
Mississippi Regulatory Program
We, the Office of Surface Mining Reclamation and Enforcement (OSM), are announcing receipt of a proposed amendment to the Mississippi regulatory program (Mississippi Program) under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). Mississippi proposes revisions to its regulations regarding: definitions; identification of interests; lands eligible for remining; permit eligibility determination; review of permit applications; eligibility for provisionally issued permits; criteria for permit approval or denial; initial review and finding requirements for improvidently issued permits; notice requirements for improvidently issued permits; suspension or rescission requirements for improvidently issued permits; unanticipated events or conditions at remining sites; verification of ownership or control application information; who may challenge ownership or control listings and findings; how to challenge an ownership or control listing or finding; burden of proof for ownership or control challenges; written agency decision on challenges to ownership or control listings or findings; post-permit issuance requirements for regulatory authorities and other actions based on ownership, control, and violation information; post-permit issuance requirements for permittees; backfilling and grading: previously mined areas; and alternative enforcement. Mississippi intends to revise its program to be no less effective than the Federal regulations and to improve operational efficiency. This document gives the times and locations of the Mississippi program and this proposed amendment to that program are available for your inspection, the comment period during which you may submit written comments on the amendment, and the procedures that we will follow for the public hearing, if one is requested.
Texas Regulatory Program
We, the Office of Surface Mining Reclamation and Enforcement (OSM), are approving an amendment to the Texas regulatory program (Texas program) under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). Texas proposed revisions to its regulations regarding annual permit fees. Texas revised its program at its own initiative to raise revenues sufficient to cover its anticipated share of costs to administer the coal regulatory program and to encourage mining companies to more quickly reclaim lands and request bond release, thereby fulfilling SMCRA's purpose of assuring the reclamation of mined land as quickly as possible.
Kentucky Regulatory Program
We are announcing our intent to remove two required amendments to the Kentucky regulatory program (hereinafter, the ``Kentucky program'') under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). As a result of OSM's review of the Kentucky program concerning its regulations and procedures relating to Ownership and Control, and Transfer, Assignment or Sale of Permit Rights, OSM has determined that two previously required amendments can be removed. Kentucky's program with regard to Ownership and Control, and Transfer, Assignment, or Sale of Permit Rights, is now consistent with the corresponding Federal regulations and SMCRA. This document gives the times and locations that the Kentucky program is available for your inspection, the comment period during which you may submit written comments, and the procedures that we will follow for the public hearing, if one is requested.
Endangered and Threatened Wildlife and Plants; 90-Day Findings on Petitions To Delist U.S. Captive Populations of the Scimitar-Horned Oryx, Dama Gazelle, and Addax
We, the U.S. Fish and Wildlife Service (``Service''), announce 90-day findings on two petitions to remove the U.S. captive-bred and U.S. captive populations of three antelope species, the scimitar-horned oryx (Oryx dammah), dama gazelle (Gazella dama), and addax (Addax nasomaculatus), from the List of Endangered and Threatened Wildlife as determined under the Endangered Species Act of 1973, as amended (Act or ESA). Based on our review, we find that the petitions present substantial information indicating that delisting the U.S. captive animals or U.S. captive-bred members of these species may be warranted. Therefore, with the publication of this notice, we are initiating a review of the status of the U.S. captive members of these species to determine if delisting the U.S. captive specimens is warranted. Based on the status review, we will issue a 12-month finding on these two petitions, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.
Action Subject to Intergovernmental Review
We, the Office of Surface Mining Reclamation and Enforcement, are notifying the public that we intend to grant funds to eligible applicants for purposes authorized under the Abandoned Mine Land (AML) Reclamation Program. Additionally we are notifying the public that we intend to grant funds to eligible applicants for regulating coal mining within their jurisdictional borders. We will award these grants after October 1, 2012, because our award authority commences at the beginning of the fiscal year.

Renewal of Approved Information Collection

We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to list the basalt juga (Juga new species (n. sp.) 2), canary duskysnail (Colligyrus convexus), cinnamon juga (Juga n. sp. 3), Columbia duskysnail (Colligyrus n. sp. 1), Fredenburg pebblesnail (Fluminicola n. sp. 11), Goose Valley pebblesnail (Fluminicola anserinus), Hat Creek pebblesnail (Fluminicola umbilicatus), Klamath Rim pebblesnail (Fluminicola n. sp. 3), knobby rams-horn (Vorticifex n. sp. 1), masked duskysnail (Colligyrus n. sp. 2), nugget pebblesnail (Fluminicola seminalis), Potem Creek pebblesnail (Fluminicola potemicus), Shasta pebblesnail (Fluminicola multifarius), and tall pebblesnail (Fluminicola n. sp. 2) as endangered or threatened, and to designate critical habitat, under the Endangered Species Act of 1973, as amended (Act). The Fredenburg pebblesnail and the Klamath Rim pebblesnail were referred to in the petition and in our 90-day finding (76 FR 61826) as the nerite pebblesnail and the diminutive pebblesnail, respectively (see Clarification Regarding Common Names for Two Petitioned Aquatic Mollusks, below). After review of the best available scientific and commercial information, we find that listing the basalt juga, cinnamon juga, Columbia duskysnail, Fredenburg pebblesnail, Klamath Rim pebblesnail, knobby rams-horn, masked duskysnail, and tall pebblesnail is not warranted at this time because these snails do not constitute listable entities under the Act (see Listable Entity Evaluation, below). We ask the public to submit to us new information that becomes available concerning the taxonomic status of these mollusks. We find that listing the canary duskysnail, Goose Valley pebblesnail, Hat Creek pebblesnail, nugget pebblesnail, Potem Creek pebblesnail, and Shasta pebblesnail is not warranted at this time. We ask the public to submit to us new information that becomes available concerning threats to these mollusks.
Endangered and Threatened Wildlife and Plants; Endangered Status for 23 Species on Oahu and Designation of Critical Habitat for 124 Species
We, the U.S. Fish and Wildlife Service (Service), list 23 species on the island of Oahu in the Hawaiian Islands as endangered under the Endangered Species Act of 1973, as amended (Act). We also designate 42,804 acres (17,322 hectares) as critical habitat. This designation includes critical habitat for these 23 species, 2 plant species that are already listed as endangered, and revised critical habitat for 99 plant species that are already listed as endangered or threatened. In this final rule we are also recognizing taxonomic revision of the scientific names of nine plant species and revising the List of Endangered and Threatened Plants accordingly. This final rule will implement the Federal protections provided by the Act.
Bandon Marsh, Nestucca Bay, and Siletz Bay National Wildlife Refuges, Coos, Tillamook, and Lincoln Counties, OR; Comprehensive Conservation Plans and Environmental Assessments
We, the U.S. Fish and Wildlife Service (Service), announce the availability of the draft comprehensive conservation plans and environmental assessments (Draft CCP/EAs) for three Oregon refuges Bandon Marsh, Nestucca Bay, and Siletz Bay National Wildlife Refuges (NWRs)for public review and comment. Each refuge's Draft CCP/EA describes our proposal for managing that refuge for the 15 years following approval of the final CCP.

The U.S. Department of Agriculture (USDA), Forest Service, Arapaho and Roosevelt National Forest and the Pawnee National Grassland (ARP) has completed an inventory of human remains and associated funerary objects, in consultation with the appropriate Indian tribes, and has determined that there is no cultural affiliation between the remains and any present-day Indian tribe. Representatives of any Indian tribe that believes itself to be culturally affiliated with the human remains may contact the ARP. Disposition of the human remains and associated funerary objects to the Indian tribes described below may occur if no additional requestors come forward.
Notice of Inventory Completion: U.S. Department of Defense, Army, Fort Sill Museum, Lawton, OK
The U.S. Department of Defense, Army, Fort Sill Museum, with the U.S. Army Corps of Engineers, St. Louis District, has completed an inventory of human remains and associated funerary objects in consultation with the appropriate Indian tribe, and has determined that there is a cultural affiliation between the human remains and associated funerary objects and a present-day Indian tribe. Representatives of any Indian tribe that believes itself to be culturally affiliated with the human remains and associated funerary objects may contact the Fort Sill Museum. Repatriation of the human remains and associated funerary objects to the Indian tribe stated below occurred on April 12, 2004.

Federal Register Notification of Redesignation of Potential Wilderness as Wilderness, Ross Lake National Recreation Area, North Cascades National Park Service Complex, Washington
The 1988 Washington Parks Wilderness Act (Pub. L. 100-668, November 16, 1988) designated 634,614 acres of North Cascades National Park, Ross Lake National Recreation Area, and Lake Chelan National Recreation Area as the Stephen Mather Wilderness. Due to the potential for hydroelectric development, the Act also designated an additional 5,226 acres of potential wilderness within Ross Lake National Recreation Area, including approximately 1,667 acres of land within the Lower Big Beaver Valley and 3,559-acres of the Lower Thunder Creek Valley. Seattle City Light (SCL), a hydroelectric utility with the City of Seattle, retained rights, through Section 505 of the Act of October 2, 1968 (82 Stat. 930; 16 U.S.C. 90d-4) as amended under Title II, Section 202 of Public Law 100-668, for hydroelectric development
Endangered and Threatened Wildlife and Plants; Draft Recovery Plan for Four Subspecies of Island Fox
We, the U.S. Fish and Wildlife Service, announce the availability of our Draft Recovery Plan for Four Subspecies of Island Fox (Urocyon littoralis) under the Endangered Species Act of 1973, as amended (Act). Each of the four subspecies, San Miguel Island fox (Urocyon littoralis littoralis), Santa Rosa Island fox (U. l. santarosae), Santa Cruz Island fox (U. l. santacruzae), and Santa Catalina Island fox (U. l. catalinae), is endemic to the Channel Island off southern California for which it is named. We request review and comment on our plan from local, State, and Federal agencies, and the public. We will also accept any new information on the species' status throughout its range.

Special Regulations, Areas of the National Park System; Mammoth Cave National Park, Bicycle Routes
This rule designates four bicycle routes within Mammoth Cave National Park to address the interest and demand of the visiting public for bicycling opportunities without compromising the National Park Service's mandate ``to conserve the scenery and the natural and historic objects and the wild life'' in the park. This rule will implement portions of the park's Comprehensive Trail Management Plan and satisfy the requirement of National Park Service general regulations that a special regulation be promulgated to allow off-road bicycle use on routes outside of developed areas. This rule allows bicycle use on a new Connector Trail in the vicinity of Maple Springs; a new Big Hollow Trail in the hilly country of the park north of the Green River; the Mammoth Cave Railroad Bike & Hike Trail; and the White Oak Trail.
White River National Wildlife Refuge, AR; Final Comprehensive Conservation Plan and Finding of No Significant Impact for Environmental Assessment
We, the Fish and Wildlife Service (Service), announce the availability of our final comprehensive conservation plan (CCP) and finding of no significant impact (FONSI) for the environmental assessment for White River National Wildlife Refuge (NWR) in Desha, Monroe, Phillips, and Arkansas Counties, AR. In the final CCP, we describe how we will manage this refuge for the next 15 years.
Minor Boundary Revision at Virgin Islands National Park
Notice is hereby given that, pursuant to 16 U.S.C. 4601- 9(c)(1)(ii), the boundary of the Virgin Islands National Park is modified to include an additional 3.57 acres of unimproved land identified as Tract 03-157, which will then be donated to the United States. The land is located at Estate Haulover on the east end of the Island of St. John, immediately adjacent to the current boundary of the Virgin Islands National Park. The boundary revision is depicted on Map No. 161/92,009A dated March 2011. The map is available for inspection at the following locations: National Park Service, Southeast Region Land Resources Program Center, 1924 Building, 100 Alabama Street SW., Atlanta, Georgia 30301, and National Park Service, Department of the Interior, Washington, DC 20240.
Final Determination Against Acknowledgment of the Brothertown Indian Nation
The Department of the Interior (Department) gives notice that the Assistant SecretaryIndian Affairs (AS-IA) declines to acknowledge the petitioner known as the Brothertown Indian Nation as an Indian tribe within the meaning of Federal law. This notice is based on a determination that the petitioner does not satisfy criterion 83.7(g) in the applicable regulations and, therefore, the Department lacks the authority to extend acknowledgment as an Indian tribe to the petitioner.
Endangered and Threatened Wildlife and Plants; Proposed Endangered Status for the Jemez Mountains Salamander and Proposed Designation of Critical Habitat
We, the U.S. Fish and Wildlife Service (Service), propose to list the Jemez Mountains salamander as an endangered species under the Endangered Species Act of 1973, as amended (Act); and propose to designate critical habitat for the species. In total, approximately 90,789 acres (36,741 hectares) are being proposed for designation as critical habitat in Los Alamos, Rio Arriba, and Sandoval Counties, New Mexico.
