Prime Hook National Wildlife Refuge, Sussex County, DE; Draft Comprehensive Conservation Plan and Environmental Impact Statement
We, the U.S. Fish and Wildlife Service (Service), advise the public that we are reopening the public comment period for the draft comprehensive conservation plan and draft environmental impact statement (draft CCP/EIS) for Prime Hook National Wildlife Refuge (NWR), located in Sussex County, Delaware. If you have previously submitted comments, please do not resubmit them. We have already incorporated them in the public record and will fully consider them in the final decision.
Presquile National Wildlife Refuge, Chesterfield County, VA; Comprehensive Conservation Plan and Environmental Assessment
We, the U.S. Fish and Wildlife Service (Service), announce the availability of a draft comprehensive conservation plan (CCP) and environmental assessment (EA) for Presquile National Wildlife Refuge (NWR) for public review and comment. Presquile NWR is located in Chesterfield County, Virginia, and is administered by staff at Eastern Virginia Rivers NWR Complex. The draft CCP/EA describes two alternatives for managing Presquile NWR for the next 15 years. Alternative B is identified as the Service-preferred alternative. Also available for public review and comment are the draft compatibility determinations, which are included as appendix B in the draft CCP/EA.

Endangered and Threatened Wildlife and Plants; 90-Day Finding on a Petition to List Graptopetalum bartramii
We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list Graptopetalum bartramii (Bartram stonecrop) and Pectis imberbis (beardless chinch weed) as endangered or threatened under the Endangered Species Act of 1973, as amended (Act), and to designate critical habitat. Based on our review, we find that the petition presents substantial scientific or commercial information indicating that listing Bartram stonecrop and beardless chinch weed may be warranted. Therefore, with the publication of this notice, we will initiate a review of the status of these species to determine if listing Bartram stonecrop or beardless chinch weed, or both, is warranted. To ensure that our status review is comprehensive, we request scientific and commercial data and other information regarding these species. Based on the status review, we will issue a 12-month finding on the petition, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.

Endangered and Threatened Wildlife and Plants; 90-Day Finding on Petitions To List the Two Spring Mountains Dark Blue Butterflies and Morand's Checkerspot Butterfly as Endangered or Threatened
We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on petitions to list the Spring Mountains dark blue butterflies (Euphilotes ancilla purpura and Euphilotes ancilla cryptica) and Morand's checkerspot butterfly (Euphydryas anicia morandi) as endangered or threatened under the Endangered Species Act of 1973, as amended (Act), and to designate critical habitat. Based on our review, we find that the petition requesting listing of the Morand's checkerspot butterfly does not present substantial information indicating that listing that species may be warranted. In addition, based on our review, we find that the petition requesting listing of the two Spring Mountains dark blue butterflies presents substantial scientific or commercial information indicating that listing these species may be warranted. Therefore, with the publication of this notice, we will initiate status reviews of the two Spring Mountains dark blue butterflies to determine whether listing is warranted. To ensure that these status reviews are comprehensive, we are requesting scientific and commercial data and other information regarding these two subspecies. Based on these status reviews, we will issue a 12-month finding on the petition, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.

Public Land Order No. 7795; Withdrawal of Public Lands, Clear Creek Serpentine Area of Critical Environmental Concern; California
This order withdraws 28,727 acres, more or less, of public lands from location and entry under the United States mining laws for a period of 20 years, to minimize impacts to human health, safety, and the environment from hazardous emissions of airborne asbestos fibers within the Clear Creek Serpentine Area of Critical Environmental Concern. In addition, approximately 3,889 acres of non-Federal lands located inside of the boundary of the withdrawal area, if acquired by or returned to the United States, will also be included in the withdrawal. The withdrawal will have no effect on the non-Federal lands until such time as title passes to the United States.

Endangered and Threatened Wildlife and Plants; Reclassifying the Straight-Horned Markhor With Special Rule
We, the U.S. Fish and Wildlife Service (Service), propose to reclassify the straight-horned markhor (Capra falconeri jerdoni) from endangered to threatened under the Endangered Species Act of 1973, as amended. This proposed action is based on a review of the best available scientific and commercial data which indicates that the endangered designation no longer correctly reflects the status of the straight-horned markhor. This proposal constitutes our 12-month finding on the petition to reclassify this subspecies, serves as our 5-year review, and fulfills our obligations under a settlement agreement. We are also proposing a special rule concurrently. The effects of these regulations are to correctly reflect the status of the subspecies and encourage conservation of additional populations of the straight-horned markhor.

Ohio Regulatory Program
We are announcing receipt of a proposed amendment to the Ohio regulatory program under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). Ohio's proposed amendment updates the Ohio Administrative Code (OAC) to address issues raised by OSM regarding consistency of Ohio's surface mining program with the final Federal rule relative to Ownership and Control, Permit and Application Information and Transfer, and Assignment or Sale of Permit Rights, which became effective December 3, 2007. The proposed amendment specifically alters the following regulations within the OAC: Definitions; Incorporation by reference; Permit applications, requirements for legal, financial, compliance, and related information; Permit applications, revisions, and renewals, and transfers, assignments, and sales of permit rights; Improvidently issued permits; and Enforcement and Individual civil penalties. By submittal of this proposed amendment, Ohio intends to revise its approved program pursuant to the additional flexibility afforded by the revised Federal regulations and SMCRA, as amended, to ensure Ohio's proposed regulatory provisions are no less effective than the corresponding regulations. This document provides the times and locations that the Ohio program and proposed amendment are available for public inspection, the comment period during which you may submit written comments on this amendment, and the procedures that we will follow for the public hearing, if one is requested.
Draft Resource Management Plan/General Plan Draft Environmental Impact Statement/Revised Draft Environmental Impact Report for the San Luis Reservoir State Recreation Area, Merced County, California
The Bureau of Reclamation, as the National Environmental Policy Act Federal lead agency, and the California Department of Parks and Recreation (CDPR), as the California Environmental Quality Act State lead agency, have made available for public review and comment the San Luis Reservoir State Recreation Area Resource Management Plan/ General Plan (RMP/GP) Draft Environmental Impact Statement/Revised Draft Environmental Impact Report (EIS/EIR). The Draft RMP/GP EIS/EIR describes and presents the environmental effects of the No Action/No Project Alternative and three Action Alternatives. A public meeting will be held to receive comments from individuals and organizations on the Draft RMP/GP EIS/EIR.

Adoption and Notice of Availability of a Final Environmental Assessment for the Penobscot River Restoration Project
The U.S. Fish and Wildlife Service (Service) hereby gives notice of its intent to adopt the Federal Energy Regulatory Commission's (Commission) existing Final Environmental Assessment (FEA) for the Application for Surrender of License of the Veazie, Great Works, and Howland Projects. The FEA, issued on May 18, 2010, evaluates the environmental impacts that would result from the Commission approving the applications for license surrender. The Penobscot River Restoration Project (PRRP) seeks to restore diadromous fish to the Penobscot River and key tributaries in accordance with the Lower Penobscot River Basin Comprehensive Settlement Agreement (Agreement), to which the U.S. Department of the Interior (Department) is a signatory. The Service intends to approve mechanisms to assist with funding the PRRP because it will provide substantial benefits for diadromous fish. Based on the Service's independent evaluation, adoption of the FEA would meet the Department's and the Service's National Environmental Policy Act (NEPA) procedures and guidelines, as the Service is funding the precise actions, the effects of which have already been analyzed by the Commission. As part of that process, the Service is recirculating the FEA as its final Environmental Assessment in accordance with the Service's adoption requirements.

Call for Nominations for Advisory Groups, Oregon/Washington
The Secretary of the Department of the Interior requests public nominations for persons to serve on Oregon/Washington Bureau of Land Management (BLM) Resource Advisory Councils and the Steens Mountain Advisory Council. Citizens who serve on these groups provide advice and recommendations to the BLM on land use planning and management of the National System of Public Lands within their geographic areas and management options for a specific National Landscape Conservation System site. The BLM will accept public nominations for 30 days after the publication of this notice.
Notice of Application for Proposed Withdrawal Extension and Opportunity for Public Meeting; Oregon
The United States Forest Service (USFS) has filed an application with the Bureau of Land Management (BLM) requesting the Secretary of the Interior extend the duration of Public Land Order (PLO) No. 6986 for an additional 20-year term. PLO No. 6986 withdrew approximately 4,239.95 acres of National Forest System land from the United States mining laws in order to protect the scenic, recreation, and fish/wildlife habitat values in the scenic section of the Illinois Wild and Scenic River between the mouth of Deer Creek and the mouth of Briggs Creek. The withdrawal created by PLO No. 6986 will expire on June 30, 2013, unless extended. This notice also gives an opportunity to comment on the application and to request a public meeting.

Endangered and Threatened Wildlife and Plants; Revising the Special Rule for the Utah Prairie Dog
Under the Endangered Species Act of 1973, as amended (ESA), we, the U.S. Fish and Wildlife Service (Service/USFWS), revise our special regulations for the conservation of the Utah prairie dog. We are revising our special regulations to provide limits to the allowable take, including limits to where permitted take can occuragricultural lands, properties within 0.8 kilometers (km) (0.5 miles (mi)) of conservation lands, and areas where Utah prairie dogs cause serious human safety hazards or disturb the sanctity of significant human cultural or human burial sites; the amount of take that can be permitted; methods of take that can be permitted; and seasonal limitations on direct lethal take. We are also allowing entities other than the Utah Division of Wildlife Resources to permit take. We are also issuing new incidental take exemptions for otherwise legal activities associated with standard agricultural practices. All other provisions of the special rule not relating to these amendments remain unchanged.
Yakima River Basin Conservation Advisory Group; Yakima River Basin Water Enhancement Project, Yakima, WA
As required by the Federal Advisory Committee Act, the Yakima River Basin Conservation Advisory Group, Yakima River Basin Water Enhancement Project, established by the Secretary of the Interior, will hold a public meeting. Pursuant to the National Environmental Policy Act and the California Environmental Quality Act, the Bureau of Reclamation and the California Department of Water Resources have prepared a joint Final Program Environmental Impact Statement/Environmental Impact Report (Final PEIS/R), for the implementation of the Stipulation of Settlement in NRDC, et al., v. Rodgers, et al. The Final PEIS/R recommends a proposed action from the alternatives considered in the Draft PEIS/R to achieve the Stipulation of Settlement's restoration and water management goals.
