Information Collection Request Sent to the Office of Management and Budget (OMB) for Approval; Procedures for State, Tribal, and Local Government Historic Preservation Programs
We (National Park Service, NPS) have sent an Information Collection Request (ICR) to OMB for review and approval. We summarize the ICR below and describe the nature of the collection and the estimated burden and cost. This ICR is scheduled to expire on May 31, 2011. We may not conduct or sponsor and a person is not required to respond to a collection of information unless it displays a currently valid OMB control number. However, under OMB regulations, we may continue to conduct or sponsor this information collection while it is pending at OMB.
Agency Information Collection Activities: Comment Request for the Ferrous Metals Surveys
To comply with the Paperwork Reduction Act of 1995 (PRA), we are notifying the public that we have submitted to the Office of Management and Budget (OMB) an information collection request (ICR) for the revision of the currently approved paperwork requirements for the Ferrous Metals Surveys. This collection consists of 17 forms. This notice provides the public and other Federal agencies an opportunity to comment on the nature of this collection which is scheduled to expire on May 31, 2011.
Notice of Intent To Prepare an Environmental Impact Statement on a General Management Plan Amendment/Wilderness Study for Lake Clark National Park and Preserve
Pursuant to the National Environmental Policy Act of 1969 (42 U.S.C. 4332(C)), and the Wilderness Act of 1964 (16 U.S.C. 1131 et seq.), the National Park Service (NPS) is preparing an environmental impact statement for a general management plan amendment, including a wilderness study, for Lake Clark National Park and Preserve, Alaska. The environmental impact statement will be approved by the Regional Director, Alaska Region. The general management plan amendment will establish the overall direction for both the park and preserve (referred to hereafter as the park), setting broad management goals for managing the area during the next 15 to 20 years. The plan will prescribe desired resource conditions and visitor experiences that are to be achieved and maintained throughout the park based on such factors as the park's purpose, significance, special mandates, the body of laws and policies directing park management, resource analysis, and the range of public expectations and concerns. The plan also will outline the kinds of resource management activities, visitor activities, and developments that would be appropriate in the park in the future. In addition, the plan will generally address visitor-use related issues and provide management direction for the three designated wild rivers within the park. The wilderness study will evaluate portions of Lake Clark National Park and Preserve for possible designation as wilderness. The wilderness study will be included as part of the general management plan. A range of reasonable alternatives for managing the park will be developed through this planning process and will include, at a minimum, a no-action and an NPS-preferred alternative. Major issues the plan will address include: Visitor access and use of the park; the adequacy and sustainability of existing visitor facilities and park operations; and the management of wilderness, natural and cultural resources, commercial services, and cabins. The environmental impact statement will evaluate the potential environmental impacts of the alternative management approaches and the possible designation of wilderness within the park. All interested persons, organizations, and agencies are encouraged to submit comments and suggestions on issues and concerns that should be addressed in the general management plan amendment/wilderness study/ environmental impact statement, and the range of appropriate alternatives that should be examined.
Endangered and Threatened Wildlife and Plants; 12-Month Finding on a Petition To List Puerto Rican Harlequin Butterfly as Endangered
We, the Fish and Wildlife Service (Service), announce a 12- month finding on a petition to list the Puerto Rican harlequin butterfly (Atlantea tulita) as endangered and to designate critical habitat under the Endangered Species Act of 1973, as amended. After reviewing all available scientific and commercial information, we find that the listing of the Puerto Rican harlequin butterfly is warranted. Currently, however, listing the Puerto Rican harlequin butterfly is precluded by higher priority actions to amend the Lists of Endangered and Threatened Wildlife and Plants. Upon publication of this 12-month petition finding, we will add the Puerto Rican harlequin butterfly to our candidate species list. If an emergency situation develops with this species that warrants an emergency listing, we will act immediately to provide additional protection. We will develop a proposed rule to list the Puerto Rican harlequin butterfly as our priorities allow. We will make any determination on critical habitat during development of the proposed listing rule. During any interim period, we will address the status of the candidate taxon through our annual Candidate Notice of Review (CNOR).
Federal Oil and Gas Valuation
The Office of Natural Resources Revenue (ONRR) requests comments and suggestions from affected parties and the interested public before proposing changes to the existing regulations governing the valuation of oil and gas produced from Federal onshore and offshore oil and gas leases, for royalty purposes. The existing Federal oil valuation regulations have been in effect since 2000, with a subsequent amendment relating primarily to the use of index pricing in some circumstances. The existing Federal gas valuation regulations have been in effect since March 1, 1988, with various subsequent amendments relating primarily to the transportation allowance provisions. These regulations have not kept pace with significant changes that have occurred in the domestic gas market during the last 20-plus years. This notice is intended to solicit comments and suggestions for possible new methodologies to establish the royalty value of oil and gas produced from Federal leases. The ONRR plans to hold public workshops to discuss possible changes to the oil and gas valuation regulations after the written comment period closes and ONRR has had a reasonable time to review and analyze the comments. The ONRR will announce any public workshops in a future Federal Register notice. Getting feedback upfront and involving all affected stakeholders in the rulemaking process are the hallmarks of good government and smart business practice. The intention of this rulemaking process is to provide regulations that would offer greater simplicity, certainty, clarity, and consistency in production valuation for mineral lessees and mineral revenue recipients; be easy to understand; decrease industry's cost of compliance; and provide early certainty to industry and ONRR that companies have paid every dollar due. The ONRR intends that the final regulations will be revenue neutral.

Invasive Species Advisory Committee
Pursuant to the provisions of the Federal Advisory Committee Act, notice is hereby given of meetings of the Invasive Species Advisory Committee (ISAC). Comprised of 30 nonfederal invasive species experts and stakeholders from across the nation, the purpose of the Advisory Committee is to provide advice to the National Invasive Species Council, as authorized by Executive Order 13112, on a broad array of issues related to preventing the introduction of invasive species and providing for their control and minimizing the economic, ecological, and human health impacts that invasive species cause. The Council is co-chaired by the Secretary of the Interior, the Secretary of Agriculture, and the Secretary of Commerce. The duty of the Council is to provide national leadership regarding invasive species issues. Purpose of Meeting: The meeting will be held on June 14-16, 2011 in Denver, Colorado, and will focus primarily on invaders in the intermountain West. The meeting will focus on adapting management of invasive species in the vast Rocky Mountain/High Plains region in order to gain new understanding of landscape ecology, climate change, land development, introduction pathways, and new invaders. ISAC will also consult with Western-based scientists and practitioners on problems and potential solutions, as well as evaluate on-the-ground issues firsthand, thereby determining how management methods and practices can be adapted in the West to prevent and manage invasive species.
Endangered and Threatened Wildlife and Plants; Permit Applications
We, the U.S. Fish and Wildlife Service, invite the public to comment on the following applications to conduct certain activities with endangered species. With some exceptions, the Endangered Species Act (Act) prohibits activities with endangered and threatened species unless a Federal permit allows such activity. The Act requires that we invite public comment before issuing these permits.
Bogue Chitto National Wildlife Refuge, LA and MS; Draft Comprehensive Conservation Plan and Environmental Assessment
We, the Fish and Wildlife Service (Service), announce the availability of a draft comprehensive conservation plan and environmental assessment (Draft CCP/EA) for Bogue Chitto National Wildlife Refuge (NWR) in St. Tammany and Washington Parishes, Louisiana, and Pearl River County, Mississippi, for public review and comment. In this Draft CCP/EA, we describe the alternative we propose to use to manage this refuge for the 15 years following approval of the final CCP.

We, the Fish and Wildlife Service, announce the availability of our draft recovery plan, first revision, for the Mount Graham Red Squirrel (Tamiasciurus hudsonicus grahamensis) under the Endangered Species Act of 1973, as amended (Act). This species is endemic to upper-elevation forests in the Pinale[ntilde]o Mountains in southeastern Arizona. We request review and comment on our plan from local, State, and Federal agencies, Tribes, and the public. We will also accept any new information on the species' status throughout its range.
Notice of Intent To Prepare an Environmental Impact Statement for the Proposed Wilson Creek Wind Project, Lincoln County, NV
In compliance with the National Environmental Policy Act (NEPA) of 1969, as amended, and the Federal Land Policy and Management Act of 1976, as amended, the Bureau of Land Management (BLM) Schell Field Office, Nevada, intends to prepare an Environmental Impact Statement (EIS) for a right-of-way (ROW) application submitted by Wilson Creek Power Partners, LLC, for a wind energy generation project and by this notice is announcing the beginning of the scoping process to solicit public input on the identification of issues. The BLM may also determine that the proposed project would require an amendment to the Ely Resource Management Plan, in which case the EIS would support any planning amendment.

Buy American Exception Under the American Recovery and Reinvestment Act of 2009
This notice provides information regarding the Bureau of Reclamation (Reclamation) approval of the Buy American waiver requested by the Deschutes River Conservancy (DRC) to purchase foreign-produced ductile iron flanges also known as bolt rings used to connect high- density polyethylene (HDPE) and polyvinyl chloride (PVC) pipe as part of the American Recovery and Reinvestment Act of 2009 (ARRA) grant for Three Sisters Irrigation District (TSID) Phase IIIMain Canal piping project located in Sisters, Oregon. These ductile iron flanges are not available in the United States and are necessary for the construction of the TSID project and associated construction schedule. The DRC and TSID engineers conducted market research for the domestic ductile iron flange production industry and determined there is currently no domestic availability for ductile iron flanges for use with HDPE and PVC pipe.
Outer Continental Shelf, Alaska OCS Region, Chukchi Sea Planning Area, Oil and Gas Lease Sale 193
BOEMRE announces the availability of a Revised Draft SEIS, OCS Oil and Gas Lease Sale 193, Chukchi Sea, Alaska (OCS EIS/EA BOEMRE 2010-034) for public review and comment, as well as the date, location, and time for public hearings. BOEMRE prepared this Revised Draft SEIS pursuant to the National Environmental Policy Act of 1969 (NEPA), as amended, 42 U.S.C. 4321 et seq., the Council on Environmental Quality (CEQ) regulations that implement the procedural provisions of NEPA (40 CFR parts 1500-1508), and the July 21, 2010, remand order issued by the United States District Court for the District of Alaska. The Revised Draft SEIS augments the analysis of the Final EIS, Oil and Gas Lease Sale 193, Chukchi Sea Planning Area (OCS EIS/EA MMS 2007-026).
Notice of Intent To Prepare an Environmental Impact Statement for the Acquisition of Land Currently Owned by Florida Power and Light Company in Everglades National Park, Florida
In June 2009, the National Park Service (NPS) initiated public scoping for an environmental assessment (EA) that was being prepared in accordance with the National Environmental Policy Act of 1969 (NEPA), as amended, to evaluate the environmental impacts of a potential land acquisition or exchange between NPS and Florida Power and Light Company (FPL) in Everglades National Park (Park). The NPS decision to be made at the conclusion of the process was to have been whether to exchange NPS lands for FPL's lands within the boundary of the Park or to acquire FPL's lands by purchase or eminent domain. After careful consideration of the issues and analysis developed during the EA process, the NPS has determined that there is potential for significant impacts to the human environment from this decision, and NPS therefore intends to prepare an environmental impact statement (EIS). This notice initiates the public scoping process to solicit public comments and identify issues regarding the potential land acquisition or land exchange in the Park.

The Bureau of Land Management (BLM) announces the availability of the Record of Decision (ROD) for the Eldorado Ivanpah Transmission Project (EITP) located in San Bernardino County, California, and Clark County, Nevada. The BLM Needles Field Manager signed the ROD on May 19, 2011, which constitutes the final decision of the BLM.
Endangered and Threatened Wildlife and Plants; Listing the Salmon-Crested Cockatoo as Threatened Throughout its Range with Special Rule
We, the U.S. Fish and Wildlife Service, determine threatened status for the salmon-crested cockatoo (Cacatua moluccensis) under the Endangered Species Act of 1973, as amended (Act). This final rule implements the Federal protections provided by the Act for this species. We are also publishing a special rule for the species.
Historic Preservation Certifications for Federal Income Tax Incentives
The National Park Service (NPS) is amending its procedures for obtaining historic preservation certifications for rehabilitation of historic structures. Individuals and corporations must obtain these certifications to be eligible for tax credits from the Internal Revenue Service (IRS). This rule incorporates references to the revised sections of the Internal Revenue Code containing the requirements for obtaining a tax credit; replaces references to NPS's regional offices with references to its Washington Area Service Office (WASO); requires NPS to accept appeals for denial of certain certifications; and removes the certification fee schedule from the regulation. These latter two revisions provide an additional avenue for appeals and allow NPS to update fees by publishing a notice in the Federal Register as administrative costs change.
Endangered Species; Marine Mammals; Receipt of Applications for Permit

Willamette Valley National Wildlife Refuge Complex, Benton, Linn, Marion, and Polk Counties, OR
We, the U.S. Fish and Wildlife Service (Service), announce the availability of a draft comprehensive conservation plan (DCCP) and environmental assessment (EA) for the Willamette Valley National Wildlife Refuge Complex (refuge complex) for public review and comment. The refuge complex is made up of Ankeny, Baskett Slough, and William L. Finley National Wildlife Refuges (refuges), located in Benton, Linn, Marion, and Polk Counties, Oregon. In the DCCP and EA, we describe and evaluate alternatives, including our preferred alternative, for managing the refuge complex for the 15 years following approval of the final CCP.
Endangered and Threatened Wildlife and Plants; 5-Year Reviews of Species in California, Nevada, and the Klamath Basin of Oregon
We, the U.S. Fish and Wildlife Service, are initiating 5-year reviews for 53 species under the Endangered Species Act of 1973, as amended (Act). We conduct these reviews to ensure that our classification of each species on the Lists of Endangered and Threatened Wildlife and Plants as threatened or endangered is accurate. A 5-year review assesses the best scientific and commercial data available at the time of the review. We are requesting any information that has become available since our original listing of each of these species. Based on review results, we will determine whether we should change the listing status of any of these species. In this notice, we also announce 5-year reviews that were completed for 32 species in California and Nevada between April 1, 2010, and March 16, 2011.
Notice of Intent To Prepare a Draft Environmental Impact Statement for a Proposed Habitat Conservation Plan and Incidental Take Permit
We, the U.S. Fish and Wildlife Service (Service), advise the public that we intend to prepare a draft environmental impact statement (EIS) to evaluate the impacts of several alternatives relating to the proposed issuance of an Endangered Species Act Permit to Fowler Ridge Wind Farm LLC, Fowler Ridge Wind Farm II LLC, Fowler Ridge Wind Farm III LLC, and Fowler Ridge Wind Farm IV LLC (Applicant) for incidental take of the Indiana bat (Myotis sodalis), a Federal endangered species, from activities associated with the operation of Fowler Ridge Wind Farm in Benton County, Indiana. We also announce a public comment period.
Indian Child Welfare Act; Designated Tribal Agents for Service of Notice

Endangered and Threatened Wildlife and Plants; 90-Day Finding on a Petition To List the Spot-Tailed Earless Lizard as Endangered or Threatened
We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list the spot-tailed earless lizard (Holbrookia lacerata) as endangered or threatened under the Endangered Species Act of 1973, as amended (Act), and to designate critical habitat. Based on our review, we find that the petition presents substantial scientific or commercial information indicating that listing this species may be warranted. Therefore, with the publication of this notice, we are initiating a review of the status of the species to determine if listing the spot-tailed earless lizard is warranted. To ensure that this status review is comprehensive, we are requesting scientific and commercial data and other information regarding the spot-tailed earless lizard, including its two subspecies (Holbrookia lacerata lacerata and Holbrookia lacerata subcaudalis). Based on the status review, we will issue a 12-month finding on the petition, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.
Alabama Regulatory Program
We, the Office of Surface Mining Reclamation and Enforcement (OSM), are approving an amendment to the Alabama regulatory program (Alabama program) under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). Alabama revised its regulations regarding their license fees, annual license updates, and blaster certification fees. Alabama revised its program to improve operational efficiency.
Montana Regulatory Program
We are approving an amendment to the Montana regulatory program (the ``Montana program'') under the Surface Mining Control and Reclamation Act of 1977 (``SMCRA'' or ``the Act''). Montana proposed revisions to and additions of statutes about bond release responsibility periods for water management facilities and other support facilities comprising less than 10 percent of the total bond release area. Montana revised its program to clarify ambiguities and improve operational efficiency.
Outer Continental Shelf (OCS) Renewable Energy Program Interim Policy Leasing for Marine Hydrokinetic Technology Testing Offshore Florida
This notice is being published as an initial step for the purpose of involving Federal agencies, states, tribes, local government, and the public in the leasing decision for an offshore technology testing facility located on the OCS, in accordance with the Department of the Interior and the Council on Environmental Quality (CEQ) regulations implementing the provisions of the National Environmental Policy Act (NEPA) of 1969 as amended (42 U.S.C. 4321 et seq.). On November 6, 2007, the Minerals Management Service (MMS), now BOEMRE, announced an interim policy for authorizing the issuance of leases for the installation of offshore data collection and technology testing facilities on the OCS (72 FR 62673). A lease application has been submitted pursuant to the interim policy, initiating the need for an EA. On June 11, 2010 Florida Atlantic University's (FAU) Southeast National Marine Renewable Energy Center (SNMREC) submitted an application to lease three OCS blocks, approximately nine to 15 nautical miles offshore of Fort Lauderdale, Florida, under its original nomination submitted on November 8, 2007. These three blocks are located on the Atlantic OCS in the Official Protraction Diagram NG 17- 06 numbered 7003, 7053, and 7054. The proposed lease area ranges from a depth of 262 meters (m) in Block 7053 to 366 m in the southern half of Block 7054. This project application was amended on February 10, 2011, and describes data collection and technology testing activities to be conducted on the proposed lease. FAU SNMREC intends to deploy a single- anchor mooring, with a mooring and telemetry buoy (MTB) (similar to the Navy Oceanographic Meteorological Automatic Device (NOMAD) weather buoys) for the purpose of testing, for limited periods, equipment designed to use the Florida current to generate electricity on the proposed leasehold. The proposed MTB would act as both a sensor and measurement platform and mooring point for a platform or vessel which can deploy small-scale ocean current devices. The device(s) to be deployed would be limited to 100-kilowatt (kW) power extraction and seven-meter diameter rotor(s). Initially, it is proposed to deploy an experimental demonstration device with 20 kW maximum power and a three- meter rotor diameter from a vessel moored to the MTB. BOEMRE intends to prepare an EA for the purpose of considering the environmental consequences associated with issuing an interim policy lease to FAU SNMREC, which will include impacts that may result from the installation of an MTB, deployment of small-scale ocean current devices, and operations of a deployment vessel on the potential leasehold. The EA will consider multiple environmental issues, including impacts to benthic habitats, sea turtles, pelagic fishes, marine mammals, and existing human uses. At a minimum, the alternatives that will be considered are no action (i.e., no issuance of a lease), and the issuance of a lease and approval of certain technology testing activities within the lease area, such as deployment of technology demonstration devices, single anchor moorings, and an MTB. With this NOI, BOEMRE is requesting comments and input from Federal, state, and local government agencies, tribal governments, and other interested parties, which may assist BOEMRE in identifying the important environmental issues and any additional alternatives that should be considered in the EA. Input is also requested regarding measures (e.g., limitations on activities based on technology, siting, or timing) that would mitigate impacts to environmental resources and socioeconomic conditions that could result from leasing and the technology testing activities in the lease area. Consultation with other Federal agencies, tribal governments, and affected states will be carried out during the EA process and will be completed before a final decision is made on whether, or under what circumstances to issue a lease.
