BOEMRE has issued a ROD to authorize the use of OCS sand resources in National Aeronautics and Space Administration's (NASA's) Wallops Flight Facility (WFF) Shoreline Restoration and Infrastructure Protection Program (SRIPP). The ROD documents the Bureau's decision in selecting the Preferred Alternative described in NASA's Final Programmatic Environmental Impact Statement (PEIS) for the WFF SRIPP (October 2010). BOEMRE will enter into a negotiated agreement with NASA for the purpose of making sand available from a shoal on the OCS for placement on the beach in support of the WFF SRIPP's initial beach fill, following the mandated 30-day wait period from the date of the issuance of the ROD. BOEMRE is announcing the availability of this ROD, in accordance with the regulations implementing the National Environmental Policy Act (NEPA). The Associate Director for Offshore Energy and Minerals Management in BOEMRE signed the ROD on March 2, 2011.
National Earthquake Prediction Evaluation Council (NEPEC)

Pursuant to Public Law 96-472, the National Earthquake Prediction Evaluation Council (NEPEC) will hold a 1-day meeting on April 16, 2011. The meeting will be held at the Crowne Plaza Memphis Downtown, 300 North Second Street, Memphis, Tennessee 38105. The Council is comprised of members from academia and the Federal Government. The Council shall advise the Director of the U.S. Geological Survey on proposed earthquake predictions, on the completeness and scientific validity of the available data related to earthquake predictions, and on related matters as assigned by the Director. Additional information about the Council may be found at: http://earthquake.usgs.gov/aboutus/nepec/. At the meeting, the Council will receive a report from the Independent Expert Panel on New Madrid Seismic Zone Earthquake Hazards, a subcommittee charged with commenting on the level of hazard posed by future large earthquakes in the region and on priorities for future research to better constrain that hazard. The Council may also receive briefings on other topics relating to earthquakes in the Central U.S., on earthquake swarms recently active in Arkansas, on communication of seismic hazard in the Pacific Northwest, on the project intended to deliver an updated Uniform California Earthquake Rupture Forecast (UCERF3) in summer 2012, on the recent earthquake and tsunami in Japan, and on other topics. Workshops and meetings of the NEPEC are open to the public. A draft workshop agenda is available on request (contact information below). In order to ensure sufficient seating and hand-outs, it is requested that visitors pre-register by April 13. Members of the public wishing to make a statement to the Council should provide notice of that intention by April 13 so that time may be allotted in the agenda.

Endangered and Threatened Wildlife and Plants; 12-Month Finding on a Petition To List the Bearmouth Mountainsnail, Byrne Resort Mountainsnail, and Meltwater Lednian Stonefly as Endangered or Threatened

We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to list the Bearmouth mountainsnail (Oreohelix species 3), Byrne Resort mountainsnail (Oreohelix species 31), and meltwater lednian stonefly (Lednia tumana) as endangered or threatened, and to designate critical habitat under the Endangered Species Act of 1973, as amended (Act). After review of all available scientific and commercial information, we find that listing the Bearmouth mountainsnail and the Byrne Resort mountainsnail is not warranted because neither constitutes a valid taxon; therefore, they are not considered to be listable entities under the Act. We find that listing of the meltwater lednian stonefly is warranted. However, currently listing of the meltwater lednian stonefly is precluded by higher priority actions to amend the Lists of Endangered and Threatened Wildlife and Plants. Upon publication of this 12-month petition finding, we will add the meltwater lednian stonefly to our candidate species list. We will develop a proposed rule to list the meltwater lednian stonefly as our priorities allow. We will make any determination on critical habitat during development of the proposed listing rule. During any interim period, we will address the status of the candidate taxon through our annual Candidate Notice of Review (CNOR).
Endangered and Threatened Wildlife and Plants; 90-Day Finding on a Petition To List the Peary Caribou and Dolphin and Union Population of the Barren-Ground Caribou as Endangered or Threatened

We, the U.S. Fish and Wildlife Service, announce a 90-day finding on a petition to list the Peary (Rangifer tarandus pearyi) and the Dolphin and Union population of the barren-ground (R. t. groenlandicus x pearyi) caribou as endangered or threatened under the Endangered Species Act of 1973, as amended (Act). Based on our review, we find that the petition presents substantial scientific and commercial information indicating that the petitioned action may be warranted. Therefore, with the publication of this notice, we are initiating a review of the status of these two subspecies to determine if listing these two subspecies is warranted. To ensure that this status review is comprehensive, we request scientific and commercial data and other information regarding these two subspecies. At the conclusion of this review, we will issue a 12-month finding on the petition, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.

On November 18, 2010, the National Indian Gaming Commission (NIGC) issued a Notice of Inquiry and Notice of Consultation advising the public that the NIGC was conducting a comprehensive review of all regulations promulgated to implement the Indian Gaming Regulatory Act (IGRA). The review identified in the Notice of Inquiry and Notice of Consultation was also prepared in order to submit the NIGC's Semi- Annual Regulatory Review to the Federal Register in April 2011 as set forth in Executive Order 12866 entitled ``Regulatory Planning and Review'' and the Regulatory Flexibility Act, 5 U.S.C. 601 et. seq. The NIGC held eight consultations during January and February 2011 and invited written comments to be submitted by February 12, 2011. Comments received and transcripts of the consultations are available on the NIGC Web site. The NIGC reviewed all comments received and created this comprehensive regulatory review agenda schedule based on the input received.

We are reopening the public comment period related to an amendment to the Pennsylvania regulatory program (the ``Pennsylvania program'') under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). The amendment is in response to fourteen required program amendments and the remining financial guarantee program. The comment period is being extended to incorporate subsequent information that we received on two occasions from Pennsylvania. Taken together, the submissions specifically address fifteen required program amendments and the remining financial guarantee program. Pennsylvania intends to revise its program to be consistent with the corresponding Federal regulations. We, the U.S. Fish and Wildlife Service (Service), announce our intent to modify the existing fee collection program at Merritt Island National Wildlife Refuge by adding entrance fees. The proposed entrance fees are $1.00 a day for one person, $5.00 a day for one vehicle, and $15.00 a year for one person. Under the Federal Lands Recreation Enhancement Act (REA), we will identify and post specific visitor fees and begin collecting them. The proposed fees only affect Black Point Wildlife Drive and three improved refuge boat ramps (Bairs Cove, Beacon 42, and Bio Lab). Fees are not required to enter any other portion of the refuge.

Therefore, with the publication of this notice, we are initiating a review of the status of the species to determine if the petitioned action is warranted. To ensure this status review is comprehensive, we are requesting scientific and commercial data and other information regarding this species. Based on the status review, we will issue a 12-month finding on the petition, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.

We, the U.S. Fish and Wildlife Service (Service), are reclassifying the Okaloosa darter (Etheostoma okaloosae) from endangered to threatened under the authority of the Endangered Species Act of 1973, as amended (Act). The endangered designation no longer correctly reflects the current status of this fish due to a substantial improvement in the species' status. This action is based on a thorough review of the best available scientific and commercial data, which indicate a substantial reduction in threats to the species, a significant habitat restoration in most of the species' range, and a stable or increasing trend of darters in all darter stream systems. We also establish a special rule under section 4(d) of the Act. This special rule allows Eglin Air Force Base to continue activities with a reduced regulatory burden and will provide a net benefit to the Okaloosa darter.
