We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list Calopogon oklahomensis (Oklahoma grass pink orchid) as endangered or threatened under the Endangered Species Act of 1973, as amended (Act). Based on our review, we find that the petition presents substantial scientific or commercial information indicating that listing the plant species, C. oklahomensis, as endangered or threatened may be warranted. Therefore, with the publication of this notice, we are initiating a review of the status of the species to determine if listing C. oklahomensis as endangered or threatened is warranted. This notice advises the public that the Bureau of Indian Affairs (BIA), in cooperation with the Ute Indian Tribe, Bureau of Land Management (BLM), U.S. Forest Service (USFS), U.S. Army Corp of Engineers (ACE), U.S. Fish and Wildlife Service (USFWS), U.S. Environmental Protection Agency (EPA), the State of Utah, and Duchesne County, intends to gather information necessary for preparing an Environmental Impact Statement (EIS) that evaluates proposed oil and gas development activities on the Uintah and Ouray Indian Reservation (Reservation), Utah. The Proposed Action consists of drilling up to 4,899 oil and/or natural gas wells over the next 15 years, with a life- of-project of 40 years. In addition to well pad development, linear developments would include roads, pipelines, and power lines. The Proposed Action would also include the development of ancillary facilities such as compressor stations, water treatment facilities, and storage areas. This notice also announces public scoping meetings that will be held to identify potential issues and alternatives to be considered in the EIS.
Public Review of Draft Coastal and Marine Ecological Classification Standard

The Federal Geographic Data Committee (FGDC) is conducting a public review of the draft Coastal and Marine Ecological Classification Standard (CMECS). CMECS provides a means of classifying ecological and habitat units using a common terminology. It provides a uniform protocol for identifying, characterizing and naming ecological units in support of monitoring, protection, and restoration of unique biotic assemblages, protected species, critical habitat, and important ecosystem components. The FGDC Coastal and Marine Spatial Data Subcommittee, chaired by the National Oceanic and Atmospheric Administration (NOAA), developed this draft standard. The FGDC Coordination Group, comprised of representatives of Federal agencies, approved releasing this draft standard for public review at its July 20, 2010 meeting. The FGDC invites all stakeholders in coastal and marine ecology and management to comment on this standard to ensure that the standard meets their needs.

Endangered and Threatened Wildlife and Plants; Establishment of a Nonessential Experimental Population of Endangered Whooping Cranes in Southwestern Louisiana

We, the U.S. Fish and Wildlife Service (Service), propose to reintroduce whooping cranes (Grus americana), a federally listed endangered species, into habitat in its historic range in southwestern Louisiana with the intent to establish a nonmigratory flock that lives and breeds in the wetlands, marshes, and prairies there. We propose to classify the flock as a nonessential experimental population (NEP) according to section 10(j) of the Endangered Species Act of 1973 (Act), as amended. Releases will be within the historic breeding area in southwestern Louisiana near White Lake in Vermilion Parish. This proposed rule provides a plan for establishing the NEP and provides for allowable legal incidental take of whooping cranes within the defined NEP area. The objectives of the reintroduction are to advance recovery of the endangered whooping crane. No conflicts are envisioned between the reintroduction and any existing or anticipated Federal, State, Tribal, local government, or private actions such as oil/gas exploration and extraction, aquacultural practices, agricultural practices, pesticide application, water management, construction, recreation, trapping, or hunting.

We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to remove the Stephens' kangaroo rat (Dipodomys stephensi) from the Federal List of Endangered and Threatened Wildlife under the Endangered Species Act of 1973, as amended. After a review of the best available scientific and commercial information, we find that delisting the Stephens' kangaroo rat is not warranted at this time. However, we ask the public to submit to us any new information that becomes available concerning the threats to the Stephens' kangaroo rat or its habitat at any time. This information will help us monitor and encourage the conservation of this species.

Minidoka Dam Spillway Replacement, Minidoka County, ID

Pursuant to section 102(2)(C) of the National Environmental Policy Act (NEPA) of 1969, as amended, the Bureau of Reclamation (Reclamation) is notifying the public that it has prepared a FEIS on the proposed Minidoka Dam Spillway Replacement. The U.S. Fish and Wildlife Service (Department of Interior) and Rural Development (Department of Agriculture) are cooperating agencies under NEPA. Alternatives considered in the FEIS are the No Action, as required under NEPA; total replacement of the spillway and headgate structures; and replacement of just the spillway. Total replacement of the spillway and headgate structures is the preferred alternative. Proposed changes in operations following construction are also evaluated, as is designation of special use areas. Reclamation published a Draft EIS in the Federal Register on December 11, 2009 (74 FR 65783) with a public comment period ending on February 5, 2010. The Final EIS includes written responses to all public comments on the Draft EIS. Revisions were made in the FEIS to incorporate responses to comments. In response to comments an adaptive management approach, which includes monitoring of effects resulting from changes in operations, has been added and proposed changes to operations will be made over a 4-year period. These revisions do not significantly change the analysis or results presented in the Draft EIS. However, if monitoring under the adaptive management approach shows different impacts than are documented in this FEIS, and changes to proposed operations (as discussed in this FEIS) are made as a result of monitoring, additional NEPA compliance will be conducted to document those changes and/or impacts.

We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list the Brian Head mountainsnail (Oreohelix parawanensis) as endangered or threatened under the Endangered Species Act of 1973 (Act), as amended. Based on our review, we find that the petition does not present substantial information indicating that listing the species may be warranted. However, we ask the public to submit to us any new information that becomes available concerning the status of, or threats to, the mountainsnail or its habitat at any time. This information will help us monitor and encourage the conservation of this species.
