We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to remove the tiger (Panthera tigris) from the List of Endangered and Threatened Wildlife under the Endangered Species Act of 1973, as amended. We find that the petition does not present substantial scientific or commercial information indicating that removing the species from the List of Endangered and Threatened Wildlife may be warranted. Therefore, we will not initiate a status review in response to this petition. We ask the public to submit to us any new information that becomes available concerning the status of the tiger or threats to it or its habitat at any time. This information will help us monitor and encourage the conservation of this species.

Endangered and Threatened Wildlife and Plants; Removing the Tennessee Purple Coneflower From the Federal List of Endangered and Threatened Plants

Under the authority of the Endangered Species Act of 1973, as amended (Act), we, the U.S. Fish and Wildlife Service (Service), propose to remove the plant Echinacea tennesseensis (Tennessee purple coneflower) from the Federal List of Endangered and Threatened Plants due to recovery. This action is based on a thorough review of the best available scientific and commercial data, which indicate that this species' status has improved to the point that E. tennesseensis is not likely to become endangered within the foreseeable future throughout all or a significant portion of its range. Our review of the status of this species shows that all of the threats to the species have been eliminated or significantly reduced, adequate regulatory mechanisms exist, and populations are stable. We also announce the availability of the draft post-delisting monitoring plan. This proposed rule completes the 5-year status review for the species, initiated on September 21, 2007.

Pursuant to the National Environmental Policy Act (NEPA) of 1969, 42 U.S.C. 4332(2)(C) the National Park Service (NPS) announces the availability of a Draft Environmental Impact Statement (DEIS) on Off-Road Vehicle Management in the Nabesna District of Wrangell-St. Elias National Park and Preserve. The DEIS evaluates the environmental impacts of a preferred alternative and three action alternatives for management of off-road vehicles in the Nabesna District. The purpose is to consider opportunities for appropriate and reasonable access to wilderness and backcountry recreational activities, which also accommodates subsistence and access to inholdings while protecting scenic quality, fish and wildlife habitat, and other park resource values. A no action alternative is also evaluated. This notice announces the public comment period, the locations of public meetings, and solicits comments on the DEIS. This DEIS also provides notice of a proposed technical correction to the wilderness eligibility assessment which was approved in the 1986 Wrangell-St. Elias National Park and Preserve General Management Plan. Public comment on the revised wilderness eligibility map for the Nabesna District is specifically requested.

The Bureau of Indian Affairs (BIA) announces the availability of the Final Environmental Impact Statement (EIS) for the proposed 25- acre trust acquisition for the Confederated Tribes of the Warm Springs Reservation of Oregon (Tribe) within the City of Cascade Locks, Hood River County, Oregon. The acquired trust land would be used for the development of a casino and related hotel, dining, and entertainment facilities. The purpose of the proposed action is to improve the Tribe's long-term economic conditions and support its self-sufficiency, both with respect to its government operations and its members. The Final EIS considers casino alternatives in Hood River County and on the Warm Springs Indian Reservation. This notice publishes the Amended Seminole Tribe of Florida Alcohol Beverage Control Act of 2009, Ordinance No. C-01-09. The Amended Ordinance regulates and controls the possession, sale, and consumption of liquor within the tribal lands. The last amendment to the liquor ordinance was published in 60 FR 53431. The tribal lands are located in Indian country and this Amended Ordinance allows for possession and sale of alcoholic beverages within their boundaries. The Amended Ordinance contains provisions requiring the Tribe to issue licenses to all businesses that intend to sell liquor and it requires proof that the applicant for a liquor license is licensed by the State of Florida to sell alcoholic beverages as well. This Amended Ordinance will increase the ability of the tribal government to control the community's liquor distribution and possession, and at the same time will provide an important source of revenue for the continued operation and strengthening of the tribal government and the delivery of tribal services.
Endangered and Threatened Wildlife and Plants; 90-Day Finding on a Petition To List the Mexican Gray Wolf as an Endangered Subspecies With Critical Habitat

We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on two petitions to list the Mexican gray wolf (Canis lupus baileyi) (Mexican wolf) as an endangered subspecies and designate critical habitat under the Endangered Species Act of 1973, as amended (Act). Although not listed as a subspecies, the Mexican wolf is currently listed as endangered within the broader listing of gray wolves. Based on our review, we find that the petitions present substantial scientific or commercial information indicating that the Mexican wolf subspecies may warrant listing such that reclassifying the Mexican wolf as a separate subspecies may be warranted.
