We, the U.S. Fish and Wildlife Service, invite the public to comment on the following applications to conduct certain activities with endangered species, marine mammals, or both. With some exceptions, the Endangered Species Act (ESA) and Marine Mammal Protection Act (MMPA) prohibit activities with listed species unless a Federal permit is issued that allows such activities. Both laws require that we invite public comment before issuing these permits.

We, the U.S. Fish and Wildlife Service (Service), announce the availability of the draft comprehensive conservation plan (CCP) and draft environmental assessment (EA) for Canaan Valley National Wildlife Refuge (NWR) for a 45-day public review and comment period. The draft CCP/EA describes four alternatives, including our Service-preferred alternative B, for managing this refuge for the next 15 years. Also available for public review and comment are the draft compatibility determinations, which are included as appendix B in the draft CCP/EA.

The Bureau of Land Management (BLM) announces the availability of the Record of Decision (ROD)/Approved Resource Management Plan (RMP) for the Kemmerer Field Office planning area located in Lincoln, Sweetwater, and Uinta counties, Wyoming. The Wyoming State Director signed the ROD on May 24, 2010, which constitutes the final decision of the BLM and makes the Approved RMP effective immediately.
Endangered and Threatened Wildlife and Plants; Proposed Rule to remove the Lake Erie Watersnake (Nerodia sipedon insularum

We, the U.S. Fish and Wildlife Service (Service), propose to remove the Lake Erie Watersnake (Nerodia sipedon insularum) from the List of Threatened and Endangered Wildlife due to recovery. This action is based on a review of the best available scientific and commercial data, which indicate that the subspecies is no longer endangered or threatened with extinction, or likely to become so within the foreseeable future. Based on our determination that the Lake Erie Watersnake is no longer endangered or threatened with extinction, we have also determined that designation of critical habitat for the Lake Erie Watersnake is not prudent. We seek information, data, and comments from the public regarding the Lake Erie Watersnake, this proposal to delist, and the draft post-delisting monitoring plan. This proposal implements the recommendations from the 5-year status review initiated on April 22, 2008 (73 FR 21643).
Endangered and Threatened Wildlife and Plants; 12-month Finding on a Petition to List the White-tailed Prairie Dog as Endangered or Threatened

We, the U.S. Fish and Wildlife Service announce a 12-month finding on a petition to list the white-tailed prairie dog (Cynomys leucurus) as endangered or threatened under the Endangered Species Act of 1973, as amended. After a review of all available scientific and commercial information, we find that listing the white-tailed prairie dog is not warranted at this time. However, we ask the public to submit to us any new information that becomes available concerning the threats to the white-tailed prairie dog or its habitat at any time.
