Notice is hereby given, in accordance with Public Laws 92-463 and 94-579, that the California Desert District Advisory Council to the Bureau of Land Management, U.S. Department of the Interior, will participate in a field tour of BLM-administered public lands on Friday, March 20, 2009, from 10 a.m. to 4 p.m., and meet in formal session on Saturday, March 21 from 8 a.m. to 4 p.m. at the Holiday Inn Express Hotel & Suites, 2700 Lenwood Road, Barstow, CA 92311. The Council and interested members of the public will depart for the field tour at 10 a.m. from the lobby of the Holiday Inn Express Hotel & Suites. Members of the public are welcome to participate in the tour but should plan on providing their own transportation, lunch, and beverage. Four-wheel drive vehicles are strongly recommended for the field tour. Agenda topics for the formal session on Saturday will include updates by Council members and reports from the BLM District Manager and five field office managers. Additional agenda topics are being developed. Once finalized, the field tour and meeting agendas will be published in a news release prior to the meeting and posted on the BLM California state Web site at https://www.blm.gov/ca/news/rac.html.

Notice is hereby given, pursuant to 25 CFR 514.1(a)(3), that the National Indian Gaming Commission has adopted preliminary annual fee rates of 0.00% for tier 1 and 0.058% (.00058) for tier 2 for calendar year 2009. These rates shall apply to all assessable gross revenues from each gaming operation under the jurisdiction of the Commission. If a tribe has a certificate of self regulation under 25 CFR part 518, the preliminary fee rate on class II revenues for calendar year 2009 shall be one-half of the annual fee rate, which is 0.0290% (.000290).

The Bureau of Land Management (BLM) proposes a direct (non- competitive) sale of a parcel of public land, containing 0.27 acres located in Rio Arriba County, New Mexico. The described public land has been examined, and through the public-supported land use planning process, has been determined to be suitable for disposal by direct sale pursuant to Section 203 of the Federal Land Policy and Management Act of 1976 (90 Stat. 2750, 43 U.S.C. 1713), as amended, at no less than the appraised fair market value. This sale will resolve an inadvertent trespass on public land. An appraisal of the subject parcel's fair market value is being prepared, and when completed, will be available for review at the BLM's Taos Field Office, 226 Cruz Alta Road, Taos, New Mexico 87571. Upon the completion and approval of the appraisal report, a subsequent notice will be published in the local newspaper specifying the fair market value.

We, the U.S. Fish and Wildlife Service, announce that Tundra Composites, LLC, of White Bear Lake, Minnesota, has applied for our approval of shot composed of alloys of tungsten, iron, and fluoropolymer as nontoxic for waterfowl hunting in the United States. The alloys are 41.5 to 95.2 percent tungsten, 1.5 to 52.0 percent steel, and 3.5 to 8.0 percent fluoropolymer by weight. We have initiated review of the shot under the criteria we have set out in our nontoxic shot approval procedures in our regulations.

Champion timely filed a petition for reinstatement of oil and gas lease NDM 90948, Billings County, North Dakota. The lessees paid the required rental accruing from the date of termination. No leases were issued that affect these lands. The lessees agree to new lease terms for rentals and royalties of $10 per acre and 16\2/3\ percent or 4 percentages above the existing competitive royalty rate. The lessees paid the $500 administration fee for the reinstatement of the lease and $163 cost for publishing this Notice. The lessees met the requirements for reinstatement of the lease per Sec. 31(d) and (e) of the Mineral Leasing Act of 1920 (30 U.S.C. 188). We are proposing to reinstate the lease, effective the date of termination subject to: The original terms and conditions of the lease; The increased rental of $10 per acre; The increased royalty of 16\2/3\ percent or 4 percentages above the existing competitive royalty rate; and The $163 cost of publishing this Notice.

Town of Marana Habitat Conservation Plan, Pima County, AZ

We, the U.S. Fish and Wildlife Service (Service), have received an application from the Town of Marana (Applicant) for an incidental take permit (ITP) under the Endangered Species Act of 1973 (Act). The Applicant has been assigned permit number TE-204887-0. If approved, the permit would be for a period of 25 years, and would authorize incidental take of two species currently listed under the Act, and 11 species that may become listed under the Act in the future (collectively ``covered species''). The proposed incidental take would occur in Pima County, Arizona, as a result of impacts on covered species and occupied habitat from specified actions conducted under the authority of the Town of Marana. We request public comments on the application and associated documents, and announce our plan to hold public meetings.
