Mississippi Regulatory Program
We, the Office of Surface Mining Reclamation and Enforcement (OSM), are announcing receipt of revisions to a previously proposed amendment to the Mississippi regulatory program (Mississippi program) under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). Mississippi proposes a revision to its regulations regarding valid existing rights as it pertains to designation of lands as unsuitable for surface coal mining operations. Mississippi intends to revise its program to be consistent with SMCRA. This document gives the times and locations that the Mississippi program and proposed amendment to that program are available for your inspection and the comment period during which you may submit written comments on the revisions to the amendment.

Draft General Management Plan, Draft Environmental Impact Statement, Fort Stanwix National Monument, NY
Pursuant to the National Environmental Policy Act of 1969, 42 U.S.C. 4332(2)(c) the National Park Service (NPS) announces the availability of a Draft Environmental Impact Statement (DEIS) for the Draft General Management Plan (GMP) for Fort Stanwix National Monument, located in the city of Rome, New York. Consistent with National Park Service rules, regulations, and policies, and the park's mission, the Draft GMP/EIS describes and analyzes two alternatives to guide the management and development of Fort Stanwix National Monument over the next 15 to 20 years. The alternatives incorporate various management prescriptions to ensure protection and enjoyment of the park's resources. The Draft GMP/EIS evaluates potential environmental consequences of implementing the alternatives. Impact topics include cultural and natural resources, visitor experience, park operations, and the socioeconomic environment. NPS regional planning staff and staff at Fort Stanwix NM collaborated in the development of the Draft GMP/EIS. The main issues that the Draft GMP/EIS has focused on have included protection of cultural resources, visitor services, partnership opportunities, carrying capacity, and the lack of a properly defined boundary. Alternative 1: No Action focuses on basically maintaining current management, protection, and interpretive practices and interpreting the siege of Fort Stanwix in the Revolutionary War. Alternative 2: Action Alternative seeks to broaden interpretation of Fort Stanwix in the context of the Northern Frontier, the Mohawk Valley, and American Indian history; forge new partnerships; upgrade exhibits and waysides; expand the interpretive role of the Marinus Willett Center; and develop an 18th-century cultural landscape treatment plan for the site. After public review of the Draft GMP/EIS, the National Park Service will consider public comments, and a Final GMP/EIS will be prepared. The Final GMP/EIS is scheduled for completion in 2008.
Endangered and Threatened Wildlife and Plants; Final Rule Removing the Virginia Northern Flying Squirrel (Glaucomys sabrinus fuscus) From the Federal List of Endangered and Threatened Wildlife
We, the U.S. Fish and Wildlife Service (Service), hereby remove the Virginia northern flying squirrel (Glaucomys sabrinus fuscus), now more commonly known as the West Virginia northern flying squirrel (WVNFS), from the List of Threatened and Endangered Wildlife due to recovery. This action is based on a review of the best available scientific and commercial data, which indicate that the subspecies is no longer endangered or threatened with extinction, or likely to become so within the foreseeable future. Habitat regeneration and recovery actions have resulted in a reduction in the threats, which has led to: (1) A significant increase in the number of known WVNFS captures and distinct capture locations; (2) verification of multiple-generation reproduction and persistence throughout the range; (3) proven WVNFS resiliency; and (4) substantial improvement and continued expansion of suitable habitat rangewide.
Endangered and Threatened Wildlife and Plants; Designation of Critical Habitat for the Peninsular Ranges Population of Desert Bighorn Sheep (Ovis canadensis nelsoni
We, the U.S. Fish and Wildlife Service (Service), announce the reopening of the comment period and the scheduling of public hearings on our October 10, 2007, proposed revision to critical habitat for the Peninsular bighorn sheep (Ovis canadensis nelsoni) under the Endangered Species Act of 1973, as amended (Act). In this document, we propose to add approximately 36,240 acres (ac) (14,667 hectares (ha)) to our proposed revision of critical habitat. We also announce the availability of the draft economic analysis (DEA) of the proposed revision to critical habitat and amended required determinations. We are reopening the comment period to allow all interested parties an opportunity to comment simultaneously on the proposed revisions to critical habitat, the associated DEA, and the amended required determinations section. Please do not resend comments that you submitted on the October 10, 2007, proposed rule. We considered those comments in our revisions to the proposed critical habitat that are set forth in this supplemental proposed rule. Comments previously submitted are included in the public record for this rulemaking.
Endangered and Threatened Wildlife and Plants; Designation of Critical Habitat for the Bay Checkerspot Butterfly (Euphydryas editha bayensis
We, the U.S. Fish and Wildlife Service (Service), are designating revised critical habitat for the Bay checkerspot butterfly (Euphydryas editha bayensis) under the Endangered Species Act of 1973, as amended (Act). In total, approximately 18,293 acres (ac) (7,403 hectares (ha)) fall within the boundaries of the revised critical habitat designation for the Bay checkerspot butterfly. The revision to critical habitat is located in San Mateo and Santa Clara Counties, California. This final revised designation therefore constitutes a reduction of 1,453 ac (588 ha) from our 19,746 ac (7,990 ha) proposed revised designation of critical habitat for the Bay checkerspot butterfly published on August 22, 2007.

We, the U.S. Fish and Wildlife Service (Service), are designating critical habitat for Acanthomintha ilicifolia (San Diego thornmint) under the Endangered Species Act of 1973, as amended (Act). In total, approximately 671 acres (ac) (272 hectares (ha)) of land in San Diego County, California, fall within the boundaries of the critical habitat designation.
Notice and Agenda for Meeting of the Royalty Policy Committee
This notice announces the September 18, 2008, meeting of the Royalty Policy Committee (RPC). Agenda items for the meeting of the RPC will include remarks from the Director, MMS, and the Associate Director, Minerals Revenue Management (MRM); a status report on the Department of Interior's implementation of recommendations from the RPC Subcommittee on Royalty Management; and a presentation on the Royalty in Kind (RIK) Fiscal Year 2007 Annual Report. Southern Delivery System Project, Colorado
The Bureau of Reclamation (Reclamation), under the National Environmental Policy Act of 1969, is announcing the opportunity to provide additional comments on the water quality analysis portion of the Draft EIS. The original 60-day comment period for the Draft EIS was scheduled to end on April 26, 2008 but was extended to June 13, 2008. Comments received during this period expressed a concern about the section addressing water quality analysis. In order to address these comments, an additional water quality analysis is being prepared for the Draft EIS. This analysis will augment and reinforce the existing analysis for the Draft EIS. Reclamation will continue to receive comments on the existing water quality portion of the Draft EIS while the additional analysis is performed.

This notice also terminates the Multiple Use Classification on a portion of these lands as this classification is no longer needed.
Electronic Payment of Fees for Outer Continental Shelf Activities
This final rule requires that all lessees, operators, permittees, and right-of-way holders pay all fees for processing plans, applications, and permits electronically. This rule will aid industry in payment processing and reduce payment processing errors. This rule will improve MMS processing efficiency and facilitate the correction of industry payment errors. The MMS will not accept checks, money orders, or cashier's checks for payment of fees after the effective date of this final rule. The final rule also adjusts certain cost recovery fees for inflation.
Availability of a Draft Environmental Impact Statement and Habitat Conservation Plan, and Receipt of Applications for Incidental Take Permits
This notice advises the public that the Oregon Department of Forestry (ODF), has submitted applications to the U.S. Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS) for incidental take permits (Permit(s)) pursuant to the Endangered Species Act of 1973, as amended (ESA). As required by the ESA, ODF has also prepared a Habitat Conservation Plan (Plan) designed to minimize and mitigate any such take of endangered or threatened species. The Permit applications are related to forest management and timber harvest activities on the Elliott State Forest in Coos and Douglas Counties, Oregon. The FWS and NMFS (together, the Services) are co-lead agencies in this effort. The Permit applications include the proposed Plan and a draft Implementation Agreement (IA). The Services also announce the availability of a draft Environmental Impact Statement (DEIS) for the proposed action. The Services are requesting comments from the public on the Permit applications, the Plan, the IA, and DEIS, all of which are available for review. The Services are furnishing this notice to allow other agencies and the public an opportunity to review and comment on these documents. All comments received will become part of the public record and will be available for review pursuant to the ESA. For locations to review the documents, please see the \SUPPLEMENTARY INFORMATION\ section below. A 90-day comment period, rather then a standard 60-day comment period, is being provided to allow the public sufficient time to comment on the draft documents.
Migratory Bird Permits; Control of Purple Swamphens
We, the U.S. Fish and Wildlife Service, propose changes in the regulations governing control of depredating or introduced migratory birds. The purple swamphen (Porphyrio porphyrio) is not native to any State, and competes with native species. However, we have proposed to add it to the list of species protected under our Migratory Bird Treaty Act obligations because it does occur naturally in American Samoa. We propose to amend 50 CFR part 21 to allow removal of purple swamphens in the contiguous United States, Hawaii, Alaska, Puerto Rico, and the U.S. Virgin Islands.
Migratory Bird Permits; Control of Muscovy Ducks, Revisions to the Waterfowl Permit Exceptions and Waterfowl Sale and Disposal Permits Regulations
We, the U.S. Fish and Wildlife Service, propose changes in the regulations governing control of introduced migratory birds. The muscovy duck (Cairina moschata) occurs naturally only in southern Texas. It has been introduced in other locations, where it is considered an invasive species that sometimes creates problems through competition with native species, damage to property, and transmission of disease. We propose to revise 50 CFR part 21 to prohibit sale of muscovy ducks for hunting, and to allow their removal in locations in which the species does not occur naturally in the contiguous United States, Alaska, and Hawaii, and in U.S. territories and possessions. This will require a revision of Sec. 21.14 (permit exceptions for captive-bred migratory waterfowl other than mallard ducks) and a revision of Sec. 21.25 (waterfowl sale and disposal permits), and the addition of Sec. 21.54, an order to allow control of muscovy ducks, their nests, and eggs. We also have rewritten the affected regulations to make them easier to understand.

Notice of Meetings for the National Park Service (NPS) Subsistence Resource Commission (SRC) Program Within the Alaska Region
The NPS announces the SRC meeting schedules for the following areas: Aniakchak National Monument, Cape Krusenstern National Monument, Kobuk Valley National Park, Lake Clark National Park, and Wrangell-St. Elias National Park. The purpose of each meeting is to develop and continue work on NPS subsistence hunting program recommendations and other related subsistence management issues. Herring River Restoration, Environmental Impact Statement, Cape Cod National Seashore, MA
In accordance with Sec. 102(2)(C) of the National Environmental Policy Act of 1969, as amended (NEPA), the National Park Service is preparing an Environmental Impact Statement for the Herring River Restoration Project, Cape Cod National Seashore, Massachusetts. This restoration project is being developed in partnership with the Town of Wellfleet and the Town of Truro, and in cooperation with Massachusetts Coastal Zone Management, U.S. Fish and Wildlife Service, National Oceanic and Atmospheric Administration, and Natural Resources Conservation Service. In addition to satisfying the requirements and intent of the NEPA, this Environmental Impact Statement will also be developed in compliance with the Massachusetts Environmental Policy Act (MEPA) and thus will result in a combined Environmental Impact Statement/Environmental Impact Report (EIS/EIR). The purpose of this project and EIS/EIR is to provide for the restoration of over 1100 acres of salt-marsh and estuarine habitat in the Herring River which has been degraded by diking and drainage since 1909. Restoration is needed to: (1) Re-establish the physical connection between the estuary and Cape Cod Bay for natural material exchange and for access by marine animals including migratory fish; (2) restore aquatic habitat and ecosystem services both within the estuary and in receiving waters of Wellfleet Harbor by reversing the water- quality impacts of 100 years of diking and drainage; (3) replace existing invasive exotic plant species with native salt-marsh species through the reestablishment of natural estuarine salinity; (4) restore ecosystem productivity through the reestablishment of naturally high tidal range; (5) minimize the long-term management and social costs of continued diking in the face of current, and likely accelerating, sea- level rise; and (6) guide a phased, carefully monitored and adaptively managed long-term restoration program. The EIS/EIR will examine a range of feasible alternatives and evaluate potential impacts on natural resources, cultural resources, and the human environment. The public is invited to comment on the purpose, need, objectives, preliminary alternatives, or any other issues associated with the plan. A scoping newsletter has been prepared that details the purpose, need, and issues identified to date. The newsletter is available on-line at https://parkplanning.nps.gov. Changes in the Insular Possessions Watch, Watch Movement and Jewelry Programs 2008
The Departments of Commerce and the Interior (the Departments) propose to amend their regulations governing watch duty-exemption allocations and watch and jewelry duty-refund benefits for producers in the United States insular possessions (the U.S. Virgin Islands, Guam, American Samoa and the Commonwealth of the Northern Mariana Islands). The proposed rule would amend the regulations by updating the formula that is used to calculate the combined amount of individual and family health and life insurance per year that is creditable towards the duty refund benefit.

Odessa Subarea Special Study; Adams, Franklin, Grant, Lincoln and Walla Walla Counties, WA
Pursuant to section 102(2)(C) of the National Environmental Policy Act of 1969, as amended, the Bureau of Reclamation (Reclamation) proposes to prepare an Environmental Impact Statement (EIS) for the Odessa Subarea Special Study. The Washington Department of Ecology (Ecology) is a joint lead with Reclamation in the preparation of this Environmental Impact Statement which will also be used to comply with requirements of the Washington State Environmental Policy Act (SEPA). The purpose of Reclamation's Odessa Subarea Special Study is to evaluate alternatives that would deliver project water from the Columbia Basin Project (CBP) to lands currently using groundwater for irrigation in the Odessa Ground Water Management Subarea. The Study is needed to fulfill the obligation Reclamation made in a Memorandum of Agreement between the State of Washington (State) and the Project irrigation districts in December 2004, which included cooperating on a study to explore opportunities for delivery of Columbia Basin Project water to existing groundwater-irrigated lands within the Odessa Subarea. Action is needed to avoid significant economic loss, in the near term, to the region's agricultural sector because of resource conditions associated with continued decline of the aquifers in the Odessa Subarea. Groundwater in the Odessa Subarea is currently being depleted to such an extent that water must be pumped from great depths. Pumping depths are 750 feet in some areas, and well depths are as great as 2,100-2,400 feet. Well drilling costs and pumping water from this depth have resulted in expensive power costs and water quality concerns such as high water temperatures and high sodium concentrations. The ability of farmers to irrigate their crops is at risk. Domestic, commercial, municipal, and industrial uses and water quality are also affected. Those irrigating with wells of lesser depth live with uncertainty about future well production. Washington State University conducted a regional economic impact study assessing the effects of lost potato production and processing in Adams, Franklin, Grant, and Lincoln counties from continued aquifer decline. Assuming that all potato production and processing is lost from the region, the analysis estimated the regional economic impact would be a loss of about $630 million dollars annually in regional sales, a loss of 3,600 jobs, and a loss of $211 million in regional income (Bhattacharjee and Holland 2005).

In accordance with the National Environmental Policy Act, the Federal Land Policy and Management Act, and Bureau of Land Management (BLM) policies, the BLM announces the availability of the ROD for the Cascade-Siskiyou National Monument Resource Management Plan (RMP) located in Jackson County in southwestern Oregon. The ROD serves as a final decision for the land use plan decisions described in the approved RMP and becomes effective on the date the ROD is signed.
Notice of Intent To Prepare an Environmental Impact Statement for the Mountain States Transmission Intertie Project in Montana and Idaho, Possible Land Use Plan Amendments, and Notice of Public Scoping Meetings
The Bureau of Land Management (BLM) gives notice of intent to prepare an Environmental Impact Statement (EIS) to address potential effects of a proposed project by NorthWestern Energy to build and operate a new 500 kV electric transmission line requiring a special use permit, right-of-way grant, and/or temporary use permit for construction, operation, and maintenance of a 500kV electric transmission line and associated substation, including new access roads. The transmission line is known as the Mountain States Transmission Intertie (MSTI) Project. NorthWestern Energy's three project alternatives range from 390 to 430 miles in length, but additional alternatives or variations on alternatives may be developed through the environmental review process. Alternatives for the proposed transmission line would pass over private, state, and federally managed lands in Montana and Idaho. Federally managed lands include lands administered by the BLM, U.S. Forest Service (USFS), Department of Agriculture (USDA) Agricultural Research Service (ARS), U.S. Sheep Experiment Station, and U.S. Department of Energy (DOE) Idaho National Laboratory. Authorization of this proposal may require the amendment of the BLM and the USFS land use plans (Forest Plans, Management Framework Plans, and Resource Management Plans).

The U.S. Department of Agriculture, Forest Service, has filed an application with the Bureau of Land Management (BLM) requesting the Secretary of the Interior to withdraw approximately 3,968 acres of National Forest System land from the mining laws for 20 years to protect cultural resources, including rock art of great cultural, scientific, and public interest within Craven Canyon.
