We are removing these required amendments because these changes are no longer necessary for the Pennsylvania program to be consistent with the corresponding Federal regulations.

Legislative Environmental Impact Statement on Gull Egg Harvest by the Huna Tlingit in Glacier Bay National Park

The National Park Service (NPS) is preparing a Legislative Environmental Impact Statement (LEIS) on the potential harvest of gull eggs by the Huna Tlingit in Glacier Bay National Park. The purpose of the LEIS is to respond to Section 4 of the Glacier Bay National Park Resource Management Act of 1999 (Pub. L. 106-455) which requires the Secretary of Interior, in consultation with local residents, to assess whether sea gull eggs can be collected in the park on a limited basis without impairing the biological sustainability of the gull population in the park. The Act further requires that if the study determines that the limited collection of sea gull eggs can occur without impairing the biological sustainability of the gull population in the park, the Secretary shall submit recommendations for legislation to Congress. The proposed action alternative will include harvesting glaucous- winged gull (Larus glaucescens) eggs by tribal members of the Hoonah Indian Association (HIA) under a traditional harvest strategy cooperatively produced by NPS and HIA The traditional harvest strategy would outline the methods by which eggs could be harvested, harvest limits, and monitoring actions that would be implemented to ensure that park purposes and values would remain unimpaired. A second alternative will consider more limited egg harvest opportunities. A no action alternative, which would continue to preclude egg harvest throughout the park will also be included in the LEIS. Scoping: The National Park Service seeks input from interested groups, organizations, individuals and government agencies. Written and verbal scoping comments are being solicited. Further information on this LEIS process is available by contacting the National Park Service at Glacier Bay National Park and Preserve. Our practice is to make comments, including names, home addresses, home phone numbers, and email addresses of respondents, available for public review. Individual respondents may request that we withhold their names and/or home addresses, etc., but if you wish us to consider withholding this information you must state this prominently at the beginning of your comments. In addition, you must present a rationale for withholding this information. This rationale must demonstrate that disclosure would constitute a clearly unwarranted invasion of privacy. Unsupported assertions will not meet this burden. In the absence of exceptional, documentable circumstances, this information will be released. We will always make submissions from organizations or businesses, and from individuals identifying themselves as representatives or officials of organizations or businesses, available for public inspection in their entirety. The LEIS is being prepared in accordance with the requirements of the National Environmental Policy Act of 1969, as amended (42 U.S.C. 4331 et seq.) and its implementing regulations at 40 CFR part 1500 and the process for proposals for legislation (40 CFR 1506.8).

Pursuant to section 102(2)(C) of the National Environmental Policy Act of 1969, the National Park Service (NPS) announces the availability of the Record of Decision (ROD) on the final Environmental Impact Statement (EIS) for the Stream Management Plan, Herbert Hoover National Historic Site (Site), West Branch, Iowa. The Midwest Regional Director approved the ROD for this final EIS on August 1, 2006. Specifically, the Site will adopt and implement actions described under Alternative E, the preferred alternative, in the final EIS. Under the selected action, the primary strategy entails the restoration of the function of the stream corridor and a floodwater detention area in the upstream portion of the Park. The EIS considered and evaluated five alternatives to the selected action. A full range of foreseeable environmental consequences was assessed. The overriding concern expressed by the Site and the public during the development of this action was the protection of fundamental resources and values of the Site. Alternative EProvide 50-Year Flood Protectionis the selected alternative since it best meets the objectives of the Site. The preferred alternative will not result in the impairment of resources and values. The ROD includes a statement of the decision made, synopses of other alternatives considered, the basis for the decision, the rationale for why the selected action is the environmentally preferred alternative, a finding of no impairment of Site resources and values, and an overview of public involvement in the decisionmaking process.

The National Park Service (NPS) announces the availability of the Record of Decision (ROD) for the Environmental Impact Statement on the South Denali Implementation Plan, Denali National Park and Preserve, Alaska. This Record of Decision documents the decision by the NPS, in cooperation with the State of Alaska and Matanuska-Susitna Borough to adopt the South Denali Implementation Plan. The Final South Denali Implementation Plan and Environmental Impact Statement (FEIS) was prepared cooperatively by the National Park Service, the State of Alaska, and the Matanuska-Susitna Borough to provide specific direction for expanded visitor facilities and recreational opportunities in the South Denali region until 2021. South Denali is defined to include the local communities, the Petersville Road corridor, the western section of Denali State Park, the northern part of the Peters Hills, lands east of the Peters Hills to the eastern boundary of Denali State Park, and the Parks Highway corridor from Rabideaux Creek north through the state park. The NPS selected Alternative C, as described in the FEIS. Of the two action alternatives, this alternative best meets the objectives of the plan for resource protection, increasing quality recreational and access opportunities, and preserving quality of life values in local communities. The ROD briefly discusses the background for the planning effort, summarizes public involvement during the planning process, states the decision and discusses the basis for it, describes other alternatives considered, specifies the environmentally preferable alternative, and identifies measures adopted to minimize potential environmental harm.

Pursuant to Section 102(2)(C) of the National Environmental Policy Act (NEPA) of 1969 (as amended) and Section 21061 of the California Environmental Quality Act (CEQA), the Bureau of Reclamation (Reclamation) and El Dorado County Water Agency (EDCWA) intend to prepare a joint EIS/EIR for a Municipal and Industrial (M&I) water service contract from the Central Valley Project (CVP), California. The proposed project consists of a long term water supply contract under which Reclamation would provide up to 15,000 acre-feet per annum (AFA) to the EDCWA for diversion from Folsom Reservoir or for exchange upstream on the American River. The EDCWA proposes to sub-contract this water equally between El Dorado Irrigation District (EID) and Georgetown Divide Public Utility District (GDPUD). EID proposes to take its supply from Folsom Reservoir. GDPUD proposes to take its supply upstream by way of a water exchange with Placer County Water Agency (PCWA). The GDPUD diversion facility is at the American River Pump Station which is currently under construction.

Member organizations help to foster communications between the Federal and non-Federal sectors on sharing water information. The existing regulations allowed certain Alaska Native veterans another opportunity to apply for a Native allotment under the repealed Native Allotment Act of 1906. This final rule will remove the requirement that veteran applicants must have posted the land by marking all corners on the ground with their name and address prior to filing an application with BLM. This change to the regulations will make the processing of Alaska Native veteran allotments more like that of allotments adjudicated under the 1906 act.

Pursuant to the National Environmental Policy Act (NEPA) (42 U.S.C. 4321, et seq.), the Fish and Wildlife Service (Service) as the lead agency, advises the public that we intend to gather information necessary to prepare an Environmental Impact Statement (EIS) regarding the proposed Coyote Springs Investment LLC (Applicant) Multiple Species Habitat Conservation Plan (MSHCP) and issuance of an incidental take permit (Permit) for endangered and threatened species in accordance with section 10(a)(1)(B) of the Endangered Species Act of 1973, as amended (Act). The Applicant proposes to develop a planned community in southern Lincoln County and implement conservation features (Project). The Applicant intends to request a Permit for incidental take of federally listed threatened or endangered species, including desert tortoise (gopherus agassizii) as well as Evaluation List species. Evaluation List species include species that have been petitioned for listing; State-listed species; species that have been nominated for inclusion by technical specialists; and other species of concern that co-occur with federally listed species. The Service plans to refine the species list as a part of the scoping process. In accordance with the Act, the Applicant will prepare a MSHCP containing proposed measures to minimize and mitigate incidental take that could result from the Project. The Service provides this notice to: (1) Describe the proposed action and possible alternatives; (2) advise other Federal and State agencies, affected tribes, and the public of our intent to prepare an EIS; (3) announce the initiation of a 30-day public scoping period; and (4) obtain suggestions and information on the scope of issues to be included in the EIS. The proposed action is approval of the MSHCP and issuance of the Permit.

The Bureau of Land Management (BLM) proposes to offer for sale, by public auction, 81 parcels of Federal public land aggregating approximately 2,577.60 acres, more or less, in the Las Vegas Valley, Nevada. The sale will be under the authority of the Southern Nevada Public Land Management Act of 1998, 112 Stat. 2343, as amended by Title IV of the Clark County Conservation of Public Land and Natural Resources Act of 2002, 116 Stat. 1994, (SNPLMA). We, the U.S. Fish and Wildlife Service (Service), are designating critical habitat for the Rota Bridled White-eye (Zosterops rotensis) pursuant to the Endangered Species Act of 1973, as amended (Act). In total, approximately 3,958 acres (ac) (1,602 hectares (ha)) fall within the boundaries of the critical habitat designation on the Island of Rota, Commonwealth of the Northern Mariana Islands (CNMI).
Endangered and Threatened Wildlife and Plants; Designation of Critical Habitat for the Marbled Murrelet

We, the U.S. Fish and Wildlife Service (Service), propose to revise currently designated critical habitat for the marbled murrelet (Brachyramphus marmoratus marmoratus) in Washington, Oregon, and California, under the Endangered Species Act of 1973, as amended (Act). We originally designated critical habitat for the marbled murrelet in Washington, Oregon, and California on May 24, 1996 (61 FR 26256). Since that time, we completed a 5-year status review of the marbled murrelet (USFWS 2004). This proposed rule is in response to a settlement agreement reached on January 13, 2003. In our proposal to revise the current designation of critical habitat for the marbled murrelet, we are proposing 3,590,642 acres (ac) (1,453,000 hectares (ha)) as critical habitat. We are further considering excluding 3,368,950 ac (1,363,300 ha) of these lands under section 4(b)(2) of the Act from the final designation. This action, if adopted in its entirety, would result in a final revised designation of approximately 221,692 ac (89,700 ha) of land being designated as critical habitat for the marbled murrelet, a reduction of approximately 3,666,108 ac (1,483,640 ha) from currently designated critical habitat. In this rule, we are further proposing to revise the entry in 50 CFR 17.11 concerning the scientific name of the marbled murrelet from Brachyramphus marmoratus marmoratus to Brachyramphus marmoratus to reflect recent taxonomic information.

In this Candidate Notice of Review (CNOR), we, the U.S. Fish and Wildlife Service (Service), present an updated list of plant and animal species native to the United States that we regard as candidates or have proposed for addition to the Lists of Endangered and Threatened Wildlife and Plants under the Endangered Species Act of 1973, as amended. Identification of candidate species can assist environmental planning efforts by providing advance notice of potential listings, allowing landowners and resource managers to alleviate threats and thereby possibly remove the need to list species as endangered or threatened. Even if we subsequently list a candidate species, the early notice provided here could result in more options for species management and recovery by prompting candidate conservation measures to alleviate threats to the species. The CNOR summarizes the status and threats that we evaluated in order to determine that species qualify as candidates and to assign a listing priority number to each species, or to remove species from candidate status. Additional material that we relied on is available in the Species Assessment and Listing Priority Assignment Forms (species assessment forms, previously called candidate forms) for each candidate species. Overall, this CNOR recognizes 7 new candidates, changes the listing priority number for 24 candidates, and removes 10 species from candidate status. Combined with other decisions for individual species that were published separately from this CNOR, the new number of species that are candidates for listing is 279. We request additional status information that may be available for the 279 candidate species identified in this CNOR. We will consider this information in preparing listing documents and future revisions to the notice of review, as it will help us in monitoring changes in the status of candidate species and in management for conserving them. We also request information on additional species that we should consider including as candidates as we prepare future updates of this notice. This document also includes our findings on resubmitted petitions and describes our progress in revising the Lists of Endangered and Threatened Wildlife and Plants during the period May 2, 2005, through August 23, 2006.
