Submission of Information Collection to the Office of Management and Budget for Review Under the Paperwork Reduction Act

Pursuant to 43 Code of Federal Regulation (CFR) 3425.4, the Bureau of Land Management (BLM) Utah State Office, hereby gives notice that Environmental Assessments (EA) and Documentation of NEPA Adequacy (DNA) are available and a public hearing will be held to lease Federal coal. The EA/DNA analyzes and discloses direct, indirect, and cumulative environmental impacts of issuing a Federal coal lease competitively for 213.57 acres in Emery County, Utah. The purpose of the public hearing is to solicit comments from the public on (1) the proposal to issue a Federal coal lease; (2) the proposed competitive lease sale; (3) the Fair Market Value (FMV) of the Federal coal; and (4) Maximum Economic Recovery (MER) of the Federal coal included in the tract.

Notice of Intent To Prepare an Environmental Impact Statement (EIS) for an Oil and Gas Management Plan (O&GMP) Big South Fork National River and Recreation Area (BISO), and Obed Wild and Science River (OBRI)
Notice is hereby given in accordance with the National Environmental Policy Act of 1969 (NEPA), 42 U.S.C. 4332 and Council on Environmental Quality regulation 40 CFR 1506.6, that the U.S. Department of the Interior, National Park Service (NPS), is preparing an EIS for an O&GMP for BISO and OBRI. The BISO/OBRI O&GMP/EIS will: Identify resources impacted by oil and gas operations, and provide a comprehensive framework to remedy the resulting environmental problems. Allow for exploration and development of the private mineral estate. Facilitate operator planning by setting park-specific operating standards. Provide educational outreach to operators, including guidance on the regulatory process for bringing operations into compliance with applicable legal requirements. Enhance coordination with State natural resource agencies to better manage and enforce oil and gas operations according to State standards. Evaluate the potential for NEPA streamlining for plugging and reclaiming orphaned or exhausted oil and gas operations. Evaluate public use of oil and gas access roads. Address visitor safety issues related to oil and gas operations. Provide for a range of reasonable alternatives for managing oil and gas operations, and assess potential impacts on park resoures such as threatened and endangered species, soils, wetlands, wildlife, cultural resources, and public safety, while allowing for the exercise of oil and gas rights. Provide the framework to achieve sound decision-making and resource protection at BISO and OBRI for the next 15 to 20 years. A scoping brochure will be available summarizing the purpose, need and objectives of the O&GMP/EIS. Request for Public Comments on Extension of Existing Information Collection Submitted to OMB for Review Under the Paperwork Reduction Act
In accordance with the Migratory Bird Treaty Act, 16 U.S.C. 703-712, the trapping and marking of wild migratory birds by persons holding Federal permits must be monitored. Formerly managed by the U.S. Fish and Wildlife Service, the bird banding program is now the responsibility of the USGS Bird Banding Laboratory (BBL). This bird banding monitoring program involves information collections on three forms: (1) The Application for Federal Bird Marking and Salvage Permit; (2) The Bird Banding Recovery Report; and (3) The Bird Banding Schedule. The information on the Recovery Report may also be submitted electronically at the BBL Web site or via a toll-free telephone number. This program also assists the Fish and Wildlife Service in fulfillment of its responsibilities designated by International Migratory Bird Treaties with Canada, Mexico, Japan, and the Soviet Union. Outer Continental Shelf, Headquarters, Cape Wind Offshore Wind Development 2007
The MMS has received a request from Cape Wind Associates, LLC (CWA) for a lease, easement or right-of-way to construct and operate a wind park located in Federal waters 4.7 miles offshore Cape Cod, Massachusetts. The purpose of this project is to provide a utility- scale wind energy facility providing power to the New England power grid. By this document, the MMS announces: (1) Its intention to prepare an EIS; (2) commencement of a 45-day written scoping period under the National Environmental Policy Act (NEPA); and (3) invitation for participation by interested cooperating agencies.
Alligator River National Wildlife Refuge
The Fish and Wildlife Service announces that a Draft Comprehensive Conservation Plan and Environmental Assessment (Draft CCP/EA) for the Alligator River National Wildlife Refuge are available for review and comment. This Draft CCP/EA was prepared pursuant to the National Wildlife Refuge System Administration Act, as amended, and the National Environmental Policy Act. The Draft CCP/EA describes the Service's proposal for management of the refuge for 15 years.
Delta and Breton National Wildlife Refuges
The Fish and Wildlife Service, Southeast Region, intends to gather information necessary to prepare a comprehensive conservation plan and environmental assessment pursuant to the National Environmental Policy Act of 1969 and its implementing regulations. The National Wildlife Refuge System Administration Act of 1966, as amended by the National Wildlife Refuge System Improvement Act of 1997, requires the Service to develop a comprehensive conservation plan for each national wildlife refuge. The purpose in developing a comprehensive conservation plan is to provide refuge managers with a 15-year strategy for achieving refuge purposes and contributing toward the mission of the National Wildlife Refuge System, consistent with sound principles of fish and wildlife management, conservation, legal mandates, and Service policies. In addition to outlining broad management direction on conserving wildlife and their habitats, plans identify wildlife-dependent recreational opportunities available to the public, including opportunities for hunting, fishing, wildlife observation, wildlife photography, and environmental education and interpretation. The purpose of this notice is to achieve the following: (1) Advise other agencies and the public of our intentions, and (2) Obtain suggestions and information on the scope of issues to include in the environmental document.

Record of Decision for the Final Comprehensive Conservation Plan and Environmental Impact Statement for Driftless Area National Wildlife Refuge in Illinois, Iowa, and Wisconsin
The U.S. Fish and Wildlife Service announces the decision and availability of the Record of Decision (ROD) for the Final Comprehensive Conservation Plan (CCP) and Environmental Impact Statement (EIS) for Driftless Area National Wildlife Refuge (NWR) in accordance with 40 CFR 1506.6(b). A thorough analysis of the environmental, social, and economic considerations was completed and included in the Final CCP/EIS. The Final CCP/EIS was released to the public and a Notice of Availability was published in the Federal Register, 71 FR 5874, February 3, 2006. The ROD documents the selection of Alternative C, the Preferred Alternative in the Final CCP/EIS. The ROD was signed by the Regional Director, U.S. Fish and Wildlife Service, Midwest Region, on April 18, 2006.

TXU Electric Delivery (Applicant) has applied to the U.S. Fish and Wildlife Service (Service) for an incidental take permit (TE- 125388-0) pursuant to section 10(a)(1)(B) of the Endangered Species Act (Act) of 1973, as amended. The requested permit, which is for a period of five years, would authorize incidental take of the golden-cheeked warbler (Dendroica chyrosparia) and black-capped vireo (Vireo atricapilla). The proposed take would occur as a result of the construction and continued operation of a 16-mile (26-kilometer), 138 kV transmission line within Bell and Coryell counties, Texas. We invite the public to review and comment on the permit application and associated draft Environmental Assessment/Habitat Conservation Plan (EA/HCP).

Preparation for Sale
The Bureau of Land Management (BLM) amends its regulations on preparation for timber sales to allow third party scaling on density management sales with an upper limit on the quadratic mean diameter at breast height (DBH) of the trees to be harvested of 20 inches. Third party scaling will be limited to the situations described in the amended provision, that is, if a timber disaster has occurred and a critical resource loss is imminent, and tree cruising and BLM scaling are inadequate to permit orderly disposal of the damaged timber, or if BLM is carrying out density management timber sales subject to the size limits stated above. Thus, third party scaling will generally not be used for sales of higher-value and/or larger diameter timber. BLM is amending the regulations in order to improve the efficiency of density management timber sales where the timber to be harvested may be designated by prescription (a written prescription included in the timber sale contract). The regulations will no longer require that BLM perform all scaling except in the event that a timber disaster is threatening imminent critical resource loss and scaling by BLM would be inadequate to permit orderly disposal of the damaged timber. In the case of density management timber sales when the quadratic mean DBH of trees to be cut and removed is equal to or less than 20 inches, the regulations will only allow third party scaling by scalers or scaling bureaus under contract to BLM.

The Bureau of Land Management (BLM) proposes to sell public lands within the City of North Las Vegas in Clark County, Nevada. These lands, consisting of 20.42 acres more or less (10.42 acres considered developable) have been authorized for disposal under the Southern Nevada Public Land Management Act of 1998 (112 Stat. 2343), as amended by the Clark County Conservation of Public Land and Natural Resources Act of 2002 (116 Stat. 1994) (hereinafter ``SNPLMA''). Draft Environmental Assessment (EA) for “Guidelines for Living With Florida Panthers and the Interagency Florida Panther Response Plan” and Notice of Receipt of an Application for Amendment to an Endangered Species Permit
The Florida panther (Puma concolor coryi) is one of the rarest large mammals in the United States. The panther is protected as an endangered species under the Endangered Species Act (Act) and Florida statutes. Due to the panther's potential for extinction, conflicts with humans raise issues that require careful consideration and action such that the intent and ability to conserve the species is unaltered while the safety of the public remains paramount. We announce the availability of an Environmental Assessment (EA) that considers alternatives for managing panther-human conflicts. The alternatives are intended to result in nonsignificant impacts to panthers, humans and the environment. The public is also invited to comment on an application for amendment to a permit to conduct certain activities with endangered and threatened species. This notice is provided under section 10(c) of the Act.
Quarterly Status Report of Water Service, Repayment, and Other Water-Related Contract Negotiations
Notice is hereby given of contractual actions that have been proposed to the Bureau of Reclamation (Reclamation) and are new, modified, discontinued, or completed since the last publication of this notice on February 23, 2006. This notice is one of a variety of means used to inform the public about proposed contractual actions for capital recovery and management of project resources and facilities consistent with section 9(f) of the Reclamation Project Act of 1939. Additional announcements of individual contract actions may be published in the Federal Register and in newspapers of general circulation in the areas determined by Reclamation to be affected by the proposed action.
Definition for Electronic or Electromechanical Facsimile
The proposed rule revises the definition of a term Congress used to define Class II gaming under the Indian Gaming Regulatory Act, 25 U.S.C. 2701, et seq. (``IGRA'' or ``Act''). Specifically, the proposed rule revises the definition for ``electronic or electromechanical facsimile'' that appears in part 502 of the Commission's regulations (25 CFR part 501 et seq.). The Commission defined these terms in 1992 and revised the definitions in 2002. The proposed rule offers further revision.
Classification Standards for Bingo, Lotto, Other Games Similar to Bingo, Pull Tabs and Instant Bingo as Class II Gaming When Played Through an Electronic Medium Using “Electronic, Computer, or Other Technologic Aids”
The proposed rule clarifies the terms Congress used to define Class II gaming under the Indian Gaming Regulatory Act, 25 U.S.C. 2701, et seq. (``IGRA'' or ``Act''). First, the proposed rule further revises the definitions for ``electronic or electromechanical facsimile'' and ``other games similar to bingo'' that appear in part 502 of Commission regulations (25 CFR part 501 et seq.). The Commission defined these terms in 1992, revised the definitions in 2002, and proposed further revisions to the term ``electronic or electromechanical facsimile'' separate from this proposed revision. The proposed rule offers further revision that would incorporate the new part 546 into the definitions. The Commission adds a new Part to its regulations (part 546) that explains the basis for determining whether a game of bingo or lotto, ``other game similar to bingo,'' or a game of pull-tabs or ``instant bingo,'' meets the IGRA statutory requirements for Class II gaming, when such games are played electronically, primarily through an ``electronic, computer or other technologic aid,'' while distinguishing them from Class III ``electronic or electromechanical facsimiles.'' This new part also establishes a process for assuring that such games are Class II before placement of the games in a Class II tribal gaming operation. This process contains information collection requirements subject to the Paperwork Reduction Act of 1995. The Commission has submitted the information collection request to OMB for approval.

The U.S. Fish and Wildlife Service (Service) announces that the Final CCP is available for the Hagerman National Wildlife Refuge (Refuge). This CCP is prepared pursuant to the National Wildlife Refuge System Administration Act of 1966, as amended by the National Wildlife Refuge System Improvement Act of 1997, and the National Environmental Policy Act of 1969, and describes how the Service intends to manage this Refuge over the next 15 years.

Mississippi Regulatory Program
We, the Office of Surface Mining Reclamation and Enforcement (OSM), are announcing receipt of a proposed amendment to the Mississippi regulatory program (Mississippi program) under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). Mississippi proposes a revision to its statutes regarding valid existing rights as it pertains to designation of lands as unsuitable for surface coal mining operations. Mississippi intends to revise its program to be consistent with SMCRA. This document gives the times and locations that the Mississippi program and proposed amendment to that program are available for your inspection, the comment period during which you may submit written comments on the amendment, and the procedures that we will follow for the public hearing, if one is requested.
Notice of Intent To Prepare a Comprehensive Conservation Plan and Environmental Assessment for the San Diego National Wildlife Refuge (Otay-Sweetwater Unit and Vernal Pools Stewardship Project), San Diego County, CA
This notice advises the public that the U.S. Fish and Wildlife Service (Service) intends to gather information necessary to prepare a Comprehensive Conservation Plan (CCP) and an associated environmental assessment for the San Diego National Wildlife Refuge pursuant to the National Wildlife Refuge System Administration Act of 1966, as amended by the National Wildlife Refuge System Improvement Act of 1997 (16 U.S.C. 668dd-668ee et seq), and the National Environmental Policy Act of 1969, as amended (42 U.S.C. 4321-4370d). The Service is providing this notice to advise other agencies, Tribal Governments, and the public of our intentions, and to obtain suggestions and information on the scope of the issues and alternatives to include in the CPP and the environmental document.
Klamath River Basin Fisheries Task Force and Klamath Fishery Management Council
We, the Fish and Wildlife Service, announce a joint meeting of the Klamath River Basin Fisheries Task Force and Klamath Fishery Management Council. The meeting is open to the public. The purpose of the meeting is to allow affected interests to continue providing recommendations to us on implementation of our program to restore anadromous fisheries, including salmon and steelhead, in the Klamath River in California and Oregon.
Notice of Public Meeting, McInnis Canyons National Conservation Area Advisory Council
The newly appointed McInnis Canyons National Conservation Area (MCNCA) Advisory Council will hold its first meeting on June 22, 2006. The meeting will begin at 3:00 p.m. and will be held at the Mesa County Administration Building; 544 Rood Avenue, Grand Junction, CO. Additional meetings for 2006 will be determined at the June 22nd meeting and published in the Federal Register.
Notice of Meeting of the Trinity Adaptive Management Working Group
The TAMWG affords stakeholders the opportunity to give policy, management, and technical input concerning Trinity River restoration efforts to the Trinity Management Council. Primary objectives of the meeting will include: Trinity River Restoration Program Fiscal Year 2007 budget; Hoopa Valley and Yurok tribal perspectives; Trinity River Restoration Program emphasis on tributaries and watersheds; science framework; Executive Director's report; reports from Trinity River Restoration Program workgroups; Trinity River Restoration Program strategic plan; TAMWG member presentation; and CVPIA program review. Completion of the agenda is dependent on the amount of time each item takes. The meeting could end early if the agenda has been completed. The meeting is open to the public.

Platte River Recovery Implementation Program
Pursuant to the National Environmental Policy Act (NEPA) of 1969 (as amended), the Bureau of Reclamation (Reclamation) and the U.S. Fish and Wildlife Service (Service) as joint lead agencies have prepared a final programmatic environmental impact statement (FEIS) for the Platte River Recovery Implementation Program (Program). This FEIS also serves as the Biological Assessment necessary for consultation under section 7 of the Endangered Species Act (ESA). In 1997, the States of Nebraska, Wyoming, and Colorado and the U.S. Department of the Interior (Interior) signed a Cooperative Agreement for Platte River Research and Other Efforts Relating to Endangered Species Habitats Along the Central Platte River, Nebraska (Cooperative Agreement). In this document, the signatories agreed to pursue a basinwide, cooperative approach to improve and maintain habitat for four threatened and endangered species which use the Platte River in Nebraska: whooping crane (Grus americana), interior least tern (Sterna antillarum), piping plover (Charadrius melodus), and pallid sturgeon (Scaphirhynchus albus). This Program will provide ESA compliance for Service and Reclamation water projects in the Platte River Basin for the four target species, as well as for other participating projects which require Federal permits.
Endangered and Threatened Wildlife and Plants; 90-Day Finding on a Petition To Delist the California Brown Pelican and Initiation of a 5-Year Review for the Brown Pelican
We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to remove the California brown pelican (Pelecanus occidentalis californicus) from the Federal List of Endangered and Threatened Wildlife and Plants pursuant to section 4(b)(3) of the Endangered Species Act of 1973, as amended (Act). We find that the petition presents substantial scientific or commercial information indicating that the petitioned action may be warranted. We, therefore, are initiating a status review of the California brown pelican to determine if delisting under the Act is warranted. We note that the taxon on the Federal List of Endangered and Threatened Species is the brown pelican (Pelecanus occidentalis). The petition requests specifically the delisting of the California brown pelican, (Pelecanus occidentalis californicus), rather than the delisting of the entire listed entity. Brown pelicans in coastal States along the Atlantic Coast and in Florida and Alabama were removed from the List of Endangered and Threatened Wildlife on February 4, 1985 (50 FR 4938). The brown pelican remains listed as endangered throughout the remainder of its range in North, Central, and South America and the Caribbean. Because a status review is also required for the 5-year review of listed species under section 4(c)(2)(A) of the Act, we are electing to initiate a 5-year review of the brown pelican (Pelecanus occidentalis) throughout its range and prepare these reviews simultaneously. The purpose of reviews conducted under this section of the Act is to ensure that the classification of species as threatened or endangered on the List of Endangered and Threatened Wildlife and Plants is accurate. To ensure that the reviews are comprehensive, we are soliciting scientific and commercial information regarding this species.
Establishment of Interim Supplementary Rules on Public Lands Within the King Range National Conservation Area Management Area, Managed by the Arcata Field Office, CA
In accordance with the Record of Decision for the King Range National Conservation Area (NCA) Approved Resource Management Plan (RMP), the Bureau of Land Management (BLM), Arcata Field Office, is issuing interim supplementary rules and requesting comments. These interim supplementary rules will apply to public lands within the King Range National Conservation Area management area, and will be effective upon publication and remain in effect until the publication of final supplementary rules. The BLM has determined these interim supplementary rules are necessary to enhance the safety of visitors, protect natural resources, improve recreation opportunities, and protect public health. These supplementary rules do not propose or implement any land use limitations or restrictions other than those included within the BLM's decisions in the King Range NCA Approved RMP, or allowed under existing law or regulation.
