We, the U.S. Fish and Wildlife Service, announce the initiation of a 5-year review of 56 species under section 4(c)(2)(B) of the Endangered Species Act (Act). The purpose of a 5-year review is to ensure that the classification of a species as threatened or endangered on the List of Endangered and Threatened Wildlife and Plants is accurate and based on the best scientific and commercial data available at the time of the review. We are requesting submission of any such information that has become available since the original listing of each of these 56 species. Based on the results of these 5-year reviews, we will make the requisite findings under section 4(c)(2)(A) of the Act.

The Fish and Wildlife Service (Service) proposes regulations that would authorize the nonlethal, incidental, unintentional take of small numbers of polar bears and Pacific walrus during year-round oil and gas industry (Industry) exploration, development, and production operations in the Beaufort Sea and adjacent northern coast of Alaska. Industry operations for the covered period are similar to, and include all activities covered by the previous 16-month Beaufort Sea incidental take regulations that were effective from November 28, 2003, through March 28, 2005 (68 FR 66744; November 28, 2003). We are proposing that this rule be effective for 5 years from date of issuance. We propose a finding that the total expected takings of polar bear and Pacific walrus during oil and gas industry exploration, development, and production activities will have a negligible impact on these species and will not have an unmitigable adverse impact on the availability of these species for subsistence use by Alaska Natives. We base this finding on the results of 12 years of data on the encounters and interactions between polar bears, Pacific walrus, and Industry; recent studies of potential effects of Industry on these species; and oil spill risk assessments using oil spill trajectory models, polar bear density models, potential and documented Industry impacts on these species, and models to determine the likelihood of impacts to polar bears should an accidental oil release occur. We are seeking public comments on this proposed rule.

The Bureau of Land Management (BLM) received an application from Powder River Coal Company, Inc., (PRCC) to exchange portions of two Federal coal leases affecting an alluvial valley floor (AVF) designated as significant to farming. The affected leases are located at the Caballo Mine in Campbell County, Wyoming. The AVF lands will be exchanged for new coal leases adjacent to one or more existing coal leases. This tract, which was applied for as an AVF exchange under the provisions of 43 CFR 3436, is called the Gold Mine Draw Exchange (GMDX) Tract. Consistent with the National Environmental Policy Act (NEPA) regulations, BLM must prepare an environmental analysis prior to consummating an exchange. BLM is announcing that the Draft Environmental Analysis (EA) is available for public review and that a public hearing will be held to elicit comments from any affected parties concerning the EA or the exchange in general.

Under the provisions of 371(a) of the Energy Policy Act of 2005, the lessees: Kay Papulak and Trachyte Oil Company timely filed a petition for reinstatement of competitive oil and gas lease WYW151232 in Sweetwater County, Wyoming. The lessees paid the required rental accruing from the date of termination, October 1, 2002. No leases were issued that affect these lands. The lessees have agreed to the new lease terms for rentals of $10.00 per acre and royalties of 16\2/3\ percent or 4 percentages above the existing noncompetitive royalty rates. The lessees have paid the required $500 administrative fee for the reinstatement of the lease and $166 cost for publishing this Notice. The lessees have met all the requirements for reinstatement of the lease per Sec. 31(e) of the Mineral Leasing Act of 1920 (30 U.S.C. 188(e)). We are proposing to reinstate the lease, effective the date of termination subject to: The original terms and conditions of the lease; The increased rental of $10.00 per acre; and The increased royalty of 16\2/3\ percent or 4 percentages above the existing competitive royalty rates.

This notice is to inform the public that the Bureau of Land Management (BLM) intends to temporarily close an un-maintained, dirt- surfaced vehicle route in the Sonoran Desert National Monument to all travel by motor vehicles. The vehicle route affected by this temporary closure traverses public lands in T. 4 S., R. 2 W., sections 26, 27, and 35, and T. 5 S., R. 2 W., sections 2, 11, and 12 (Gila and Salt River Meridian) and is approximately 4.4 miles in length. The following persons, operating within the scope of their official duties, are exempt from the provisions of this closure: Employees of the BLM, Arizona Game and Fish Department, and local and Federal law enforcement and fire protection personnel. Access by additional parties may be allowed, but must be approved in advance in writing by the Sonoran Desert National Monument Manager. Any person who fails to comply with the provisions of this closure may be subject to penalties outlined in 43 CFR 8360.0-7.

This notice announces a panel discussion regarding implementation of the Energy Policy Act of 2005 (Act). The panel discussion, entitled ``The Energy Policy Act of '05What Lies Ahead,'' will be conducted April 25, 2006, in Houston, Texas. The intent of the panel discussion is to bring together some of the leading experts from the Department of the Interior who are responsible for implementing the provisions of the Act. The panel will discuss major provisions of the Act and will provide the latest implementation status regarding the provisions, including alternate energy related uses on the outer continental shelf (OCS); coastal impact assistance; royalty incentives; royalty credits; and streamlined oil and gas permit processing. This 5-Year Review should not be confused with status reviews (also called 5-year reviews) conducted under section 4(c)(2)(A) of the Act. This 5-year program evaluation of the Reintroduction Project is conducted pursuant to a 1998 section 10(j) final rule.

Approval of the WEMO Plan/ROD terminates all interim measures identified in the Consent Decree in Center for Biological Diversity, et al. v. BLM (C-00-0927 WHA (JCS)) with regard to the West Mojave Planning area.

A 40.24 acre parcel in Lake County, Oregon is being considered for direct (non-competitive) sale to Mr. Alan Withers. Mr. Withers, the adjoining landowner, has used the subject parcel for hay storage and livestock feedlot purposes, authorized under a range improvement permit, since 1989. No significant resource values will be affected by this disposal. The parcel proposed for sale is identified as suitable for disposal in the Lakeview Resource Management Plan and Record of Decision, dated November 2003.

The National Park Service (NPS) announces the availability of the Record of Decision (ROD) for the Environmental Impact Statement on the Backcountry Management Plan and General Management Plan Amendment, Denali National Park and Preserve, Alaska. This Record of Decision documents the decision by the NPS to adopt a Backcountry Management Plan for Denali National Park and Preserve and to amend the park's General Management Plan. The Backcountry Management Plan addresses management of all park and preserve lands, except the park road corridor and adjacent development zones and backcountry day use areas, which were addressed in the 1997 Entrance Area and Road Corridor Development Concept Plan. Winter management of the park road corridor west of park headquarters is also addressed. The plan includes management area zoning, access, wilderness management, commercial services, backcountry facilities, administrative and research uses, and boundary changes. The plan also serves as a Soundscape Preservation and Noise Management Plan as required by NPS Director's Order 47, a Wilderness Management Plan as required by NPS Director's Order 41, and a Commercial Services Plan for the backcountry. The NPS selected the modified version of Alternative 4, as described in the Final Environmental Impact Statement (Final EIS). Of the four action alternatives, this alternative best meets the objectives of the plan for park resource protection and recreational use, and has a high degree of implementation feasibility. The ROD briefly discusses the background for the planning effort, summarizes public involvement during the planning process, states the decision and discusses the basis for it, describes other alternatives considered, specifies the environmentally preferable alternative, identifies measures adopted to minimize potential environmental harm, and provides a non-impairment determination.

Pursuant to section 102(2)(C) of the National Environmental Policy Act of 1969 (Pub. L. 91-190, as amended) and the implementing regulations promulgated by the Council on Environmental Quality (40 CFR 1505.2), the Department of the Interior, National Park Service has prepared, and the Regional Director, Pacific West Region has approved, the Record of Decision for the Fire Management Plan for Santa Monica Mountains National Recreation Area. The formal no-action period was officially initiated December 23, 2005, with the U.S. Environmental Protection Agency's Federal Register notification of the filing of the Final Environmental Impact Statement (EIS). Decision: As soon as practicable the park will begin to implement as its updated Fire Management Plan the ``Mechanical Fuel Reduction/ Ecological Prescribed Fire/Strategic Fuels Treatment'' alternative (also described and analyzed as the Preferred Alternative (2)) contained in the Draft and Final EIS. The selected plan provides the maximum potential environmental benefits and minimizes adverse effects of fire management activities. Alternative 2 is the most flexible alternative, utilizing all available fire management strategies deemed to be appropriate for the mediterranean type conditions found in Santa Monica Mountains National Recreation Area. As documented in the EIS, this plan was also deemed to be the ``environmentally preferred'' alternative. This course of action and three alternatives were identified and analyzed in the Final EIS, and previously in the Draft EIS (the latter was distributed in June 2004). The full spectrum of foreseeable environmental consequences was assessed, and appropriate mitigation measures identified, for each alternative. Beginning with early scoping, through the preparation of the Draft and Final EIS, numerous public meetings were conducted (in Thousand Oaks, Malibu, Los Angeles, Agoura Hills, Calabasas) and newsletter updates were regularly provided. Approximately 25 written comments responding to the Draft EIS were received and duly considered. Key consultations which aided in preparing the Draft and Final EIS involved (but were not limited to) the U.S. Fish and Wildlife Service, State Historic Preservation Office, native American Tribes, air quality management districts, adjoining land managing agencies, and U.S. Geological Survey. Local communities, county and city officials, and interested organizations were contacted extensively during initial scoping and throughout the fire planning process.
