Notice of Intent of Non-Renewal of Permits to Keyhole and Sundance Boat Clubs, Keyhole Reservoir, WY

The permits between the State of Wyoming, Department of State Parks and Cultural Resources, Division of State Parks and Historic Sites (WSPHS) and the Keyhole and Sundance Boat Clubs at Keyhole Reservoir in northeast Wyoming will not be renewed after their expiration on December 31, 2005. The Bureau of Reclamation is the Federal agency responsible for administering lands and resources associated with Keyhole Reservoir. Keyhole State Park (Park) is managed by Wyoming State Parks and Historic Sites through a Memorandum of Understanding with Reclamation that provides WSPHS with the authority to issue permits for limited recreation activities. Permits have been issued by WSPHS to Keyhole and Sundance boat clubs since 1967 to conduct recreation activities as boat clubs. These two boat clubs occupy a total of 18 contiguous acres on Cottonwood Bay and currently have 20 private seasonal occupancy trailers in the permit area, hereafter referred to as the ``area''. This administrative decision results from a review to determine if the existence of the boat clubs conflicts with the best public use of the area as outlined in Part 21.4(a)(1) of 43 CFR Part 21, Occupancy of Cabin Sites on Public Conservation and Recreation Areas. Consideration was given to the following factors listed in 43 CFR 21.4 (a)(1)(i-iv): existing and projected public need for the area, compatibility between public uses and private cabin sites, development potential and plans for the area, and other relevant factors. An analysis of each of these factors is given in ``Supplemental Information''. From this analysis it has been determined that public need for the area currently occupied by Keyhole and Sundance boat clubs has grown to a point where continued use of the area by the boat clubs is no longer in the best public interest.

Endangered and Threatened Wildlife and Plants; Designation of Critical Habitat for Brodiaea filifolia

We, the Fish and Wildlife Service (Service), are designating critical habitat for the federally threatened Brodiaea filifolia (thread-leaved brodiaea) pursuant to the Endangered Species Act of 1973, as amended (Act). In total, approximately 597 acres (ac) (242 hectares (ha)) fall within the boundaries of the critical habitat designation. The critical habitat is located in Los Angeles and San Diego counties, California. Lands in Orange, Riverside, and San Diego counties that are covered by approved and draft habitat conservation plans are excluded under section 4(b)(2). Lands owned or controlled by the Department of Defense that are covered by an Integrated Natural Resource Management Plan (INRMP) that provides a benefit to the species are exempt from critical habitat under section 4(a)(3) of the Act. As a result of revisions based on peer and public comments and a re- evaluation of methodology and mapping, approximately 4,093 ac (1,656 ha) in Los Angeles, San Bernardino, Orange, and San Diego counties proposed as critical habitat were removed or excluded from this final designation. Lands designated as critical habitat are under Federal and private ownership. No Tribal lands are included in this critical habitat designation.

We, the U.S. Fish and Wildlife Service (Service), propose to designate critical habitat for the Laguna Mountains skipper (Pyrgus ruralis lagunae), pursuant to the Endangered Species Act of 1973, as amended (Act). In total, approximately 6,662 acres (ac) (2,696 hectares (ha)) fall within the boundaries of the proposed critical habitat in two units that are divided into a total of seven subunits on Laguna and Palomar Mountains in San Diego County, California. Five subunits are occupied. Two subunits are not known to be currently occupied or occupied at the time of listing, but are connected to occupied habitat, were historically occupied, and also contain physical and biological features essential to the conservation of the species.

The Bureau of Land Management (BLM) and USDA Forest Service (collectively the Agencies) will prepare a supplemental environmental impact statement (SEIS) to address the order of Judge Marshal J. Pechman, United States District Court, Western District of Washington. (Northwest Ecosystem Alliance v. Rey, August 1, 2005) Specifically, the court found that the 2004 Final Supplemental Environmental Impact Statement to Remove or Modify the Survey and Manage Mitigation Measure Standards and Guideline (2004 SEIS) was deficient because the Agencies failed to: (1) ``* * analyze potential impacts to Survey and Manage species if they are not added to or are removed from the Forest Service's and BLM's respective programs for special status species;'' (2) ``* * * provide a thorough analysis of their assumption that the late-successional reserves would adequately protect species that the Survey and Manage standard was introduced to protect, particularly in light of their previous positions in earlier environmental impact statements;'' and (3) ``* * * disclose and analyze flaws in their methodology for calculating the acreage in need of hazardous fuel treatments. Part of the cost analysis was similarly flawed because it relied on the acreage in need of hazardous fuel treatments in calculating the cost of the Survey and Manage standard.'' The SEIS will provide additional information and analysis necessary to fully address the deficiencies noted by the court in the 2004 SEIS.

We, the Fish and Wildlife Service (Service), announce our revised 12-month finding for a petition to list the greater Adams Cave beetle (Pseudanophthalmus pholeter) and the lesser Adams Cave beetle (Pseudanophthalmus cataryctos) under the Endangered Species Act (Act). After a review of the best available scientific and commercial information, we conclude that these species are not likely to become endangered species within the foreseeable future throughout all or a significant portion of their range. Therefore, we find that proposing a rule to list these species is not warranted, and we no longer consider them to be candidate species for listing. The Service will continue to seek new information on the taxonomy, biology, and ecology of these species, as well as potential threats to their continued existence.

In accordance with the Migratory Bird Treaty Act, 16 U.S.C. 703-712, the trapping and marking of wild migratory birds by persons holding Federal permits must be monitored. Formerly managed by the U.S. Fish and Wildlife Service, the bird banding program is now the responsibility of the USGS Bird Banding Laboratory (BBL). This bird banding monitoring program involves information collections on three forms: (1) The Application for Federal Bird Marking and Salvage Permit; (2) The Bird Banding Recovery Report; and (3) The Bird Banding Schedule. The information on the Recovery Report may also be submitted electronically at the BBL Web site or via a toll-free telephone number. This program also assists the Fish and Wildlife Service in fulfillment of its responsibilities designated by International Migratory Bird Treaties with Canada, Mexico, Japan, and the Soviet Union. This document provides notice that the Bureau of Land Management (BLM) Arcata Field Office intends to prepare a Resource Management Plan (RMP) Amendment with an associated Environmental Assessment (EA) for recently acquired BLM coastal lands in Humboldt County in Northwest California. The lands addressed by this amendment have been acquired through a combination of fee title and conservation easements, using private donations and state and Federal funds. Approximately 1100 acres have been acquired by the BLM along the Humboldt County coast since completion of the Arcata RMP in 1992. These lands are located in T.6N., R.1W., Secs. 26, 27, 34 and 35; T.4N., R.2W., Secs. 13, 14, 23, 24, 26 and 27; and T.2N., R.3W., Secs. 12, 13, 23, 24, 25, 26, Humboldt Meridian. The plan amendment will fulfill the obligations set forth by the National Environmental Policy Act (NEPA), the Federal Land Policy and Management Act (FLPMA) and BLM management policies. The plan amendment will serve to update the Arcata RMP and associated amendments for the affected lands. The BLM will work collaboratively with interested parties to identify the management decisions that are best suited to local, regional, and national needs and concerns. The public scoping process will identify planning issues, develop planning criteria, and outline a vision for area management that reflects the needs and interests of the public and protection of the areas' resource values.

L. 91-190, 42 U.S.C. 432l et seq.), notice is hereby given that the Bureau of Land Management (BLM), together with the California Public Utilities Commission (CPUC), intend to prepare a joint Environmental Impact Statement/Environmental Impact Report (EIS/ EIR) for the Devers-Palo Verde 500 kV No. 2 Transmission Line Project (DPV2), proposed by the Southern California Edison Company (SCE). The BLM is the lead Federal agency for the preparation of this EIS in compliance with the requirements of the National Environmental Policy Act (NEPA). We, the U.S. Fish and Wildlife Service, announce the reinstatement of the November 29, 1993, proposed rule to list the flat- tailed horned lizard (Phrynosoma mcallii) as a threatened species under the Endangered Species Act of 1973, as amended (Act). On November 17, 2005, the U.S. District Court for the District of Arizona vacated the January 3, 2003, withdrawal of the proposed rule to list the flat- tailed horned lizard, reinstated the 1993 proposed rule, and remanded the matter to us for further consideration in accordance with its August 30, 2005, and November 17, 2005, orders. The District Court ordered us to submit for publication in the Federal Register, as soon as practicable, a notice advising the public that the January 3, 2003, withdrawal has been vacated and that the 1993 proposed rule is reinstated, and to submit for publication in the Federal Register a new final listing decision on the proposed rule to list the flat-tailed horned lizard by April 30, 2006. Consequently, we are hereby providing notice that the 1993 proposed rule to list the flat-tailed horned lizard is reinstated, and that we will complete a final listing decision for the flat-tailed horned lizard by April 30, 2006.
