As part of the President's Export Control Reform effort, the Department of State amends the International Traffic in Arms Regulations (ITAR) to revise Categories XIV (toxicological agents, including chemical agents, biological agents, and associated equipment) and XVIII (directed energy weapons) of the U.S. Munitions List (USML) to describe more precisely the articles warranting control on the USML. The revisions contained in this rule are part of the Department of State's retrospective plan under E.O. 13563, completed on August 17, 2011. The Department of State hereby gives notice that, on May 24, 2016, it received an application for a Presidential Permit to expand the Pembina-Emerson Land Port of Entry (LPOE) on the U.S.-Canada Border at Pembina, North Dakota, and Emerson, Manitoba, Canada. The North Dakota Department of Transportation filed this application. The Department of State's jurisdiction over this application is based upon Executive Order 11423 of August 16, 1968, as amended. As provided in E.O. 11423, the Department is circulating this application to relevant federal agencies for review and comment. Under E.O. 11423, the Department has the responsibility to determine, taking into account input from these agencies and other stakeholders, whether issuance of a Presidential Permit for the proposed expansion of this border crossing would serve the national interest. Memorandum of Agreement Between the U.S. Department of State Bureau of Consular Affairs and the Council on Accreditation

The Department of State (the Department) is the lead Federal agency for implementation of the 1993 Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption (the Convention), the Intercountry Adoption Act of 2000 (IAA), and the Intercountry Adoption Universal Accreditation Act of 2012 (UAA). Among other things, the IAA and UAA give the Secretary of State responsibility, by entering into agreements with one or more qualified entities and designating such entities as accrediting entities, for the accreditation of agencies and approval of persons to provide adoption services in intercountry adoptions. This notice is to inform the public that on July 11, 2016, the Department entered into an agreement with the Council on Accreditation (COA) designating COA as an accrediting entity (AE) for an additional five years. The Memorandum of Agreement between the U.S. Department of State Bureau of Consular Affairs and the Council on Accreditation (2016 MOA) remains largely consistent with the terms of the MOA signed on July 12, 2006 by Maura Harty, Assistant Secretary for Consular Affairs, U.S. Department of State and signed on July 6, 2006 by Richard Klarberg, President and Chief Executive Officer, COA. However, the 2016 MOA has been updated to reflect enactment of the UAA and to remove obsolete references, while further refining the role and responsibilities of the accrediting entity and taking into account subsequent updates to the intercountry adoption accreditation regulations in 22 CFR part 96. Notice of 30-Day Public Comment Period Regarding the National Interest Determination for NuStar Logistics, L.P.'s Presidential Permit Application

NuStar Logistics, L.P. (``NuStar'') applied for an amended Presidential Permit to authorize the operation and maintenance of existing pipeline facilities at the United States-Mexico border originally authorized under a 2003 Presidential Permit (the ``Dos Loredos Pipeline''). Specifically, NuStar requested that the U.S. Department of State (``State Department'') amend the 2003 Presidential Permit to: Reflect NuStar's name change from Valero Logistics Operations, L.P. to NuStar Logistics, L.P. as owner and operator of the Dos Loredos Pipeline; and allow the import and export of a wider range of refined petroleum products across the international border, including regular and premium gasoline, kerosene, and diesel. The 2003 Presidential Permit only allows the shipment of liquefied petroleum gas (LPG) through the existing 8\5/8\-inch diameter pipeline for approximately 10.6 miles from the NuStar terminal in Laredo, Texas to a location on the Rio Grande known as ``La Bota.'' After consulting with the public and interested agencies, on May 11, 2016, the State Department approved a Final Supplemental Environmental Assessment (``SEA'') for the Dos Laredos Pipeline and Finding of No Significant Impact (``FONSI''). Executive Order 13337 (69 FR 25299) calls on the Secretary of State, or his designee, to determine if issuance of a Presidential Permit would serve the national interest. Imposition of Nonproliferation Measures Against Foreign Person, Including a Ban on U.S. Government Procurement

A determination has been made that a foreign person has engaged in activities that warrant the imposition of measures pursuant to Section 3 of the Iran, North Korea, and Syria Nonproliferation Act. The Act provides for penalties on foreign entities and individuals for the transfer to or acquisition from Iran since January 1, 1999; the transfer to or acquisition from Syria since January 1, 2005; or the transfer to or acquisition from North Korea since January 1, 2006, of goods, services, or technology controlled under multilateral control lists (Missile Technology Control Regime, Australia Group, Chemical Weapons Convention, Nuclear Suppliers Group, Wassenaar Arrangement) or otherwise having the potential to make a material contribution to the development of weapons of mass destruction (WMD) or cruise or ballistic missile systems. The latter category includes (a) items of the same kind as those on multilateral lists but falling below the control list parameters when it is determined that such items have the potential of making a material contribution to WMD or cruise or ballistic missile systems, (b) items on U.S. national control lists for WMD/missile reasons that are not on multilateral lists, and (c) other items with the potential of making such a material contribution when added through case-by-case decisions.
Exchange Visitor Program-Use of Forms DS-2019 in the Summer Work Travel Program

The Department of State (the Department) will permit current sponsors in the Summer Work Travel (SWT) program category to apply to the Department for a program adjustment by allocation of Forms DS-2019 that were previously allocated to SWT sponsors in business for the full 2011 calendar year, but which no longer operate in the SWT program category. These forms are not currently allocated to any sponsor. If allocated, the total number of SWT program participants would remain within the aggregate actual total SWT participant program size for 2011 (i.e., the overall program participant level and designation moratorium established by the notice published by the Department in 2011 (Public Notice 7677, 76 FR 68808).

A determination has been made that a number of foreign persons have engaged in activities that warrant the imposition of measures pursuant to Section 3 of the Iran, North Korea, and Syria Nonproliferation Act. The Act provides for penalties on foreign entities and individuals for the transfer to or acquisition from Iran since January 1, 1999; the transfer to or acquisition from Syria since January 1, 2005; or the transfer to or acquisition from North Korea since January 1, 2006, of goods, services, or technology controlled under multilateral control lists (Missile Technology Control Regime, Australia Group, Chemical Weapons Convention, Nuclear Suppliers Group, Wassenaar Arrangement) or otherwise having the potential to make a material contribution to the development of weapons of mass destruction (WMD) or cruise or ballistic missile systems. The latter category includes (a) items of the same kind as those on multilateral lists but falling below the control list parameters when it is determined that such items have the potential of making a material contribution to WMD or cruise or ballistic missile systems, (b) items on U.S. national control lists for WMD/missile reasons that are not on multilateral lists, and (c) other items with the potential of making such a material contribution when added through case-by-case decisions.
