Amendment to the International Traffic in Arms Regulations: Revision of U.S. Munitions List Category XV

As part of the President's Export Control Reform (ECR) effort, the Department of State is amending the International Traffic in Arms Regulations (ITAR) to revise Category XV (Spacecraft and Related Articles) of the U.S. Munitions List (USML) to describe more precisely the articles warranting control in that category. The revisions contained in this rule are part of the Department of State's retrospective plan under Executive Order 13563 completed on August 17, 2011. This rule is published as an interim final rule because the Department believes that substantial national security benefits will flow from the changes to the controls on spacecraft and related items, but acknowledges that additional analysis of and public comment on the control thresholds for remote sensing satellites are warranted.

Notice is hereby given that on November 25, 2013, the Department of State (DOS) received notice from the Otay Water District (``Otay Water'') that it seeks a Presidential Permit authorizing the construction, connection, operation, and maintenance of a cross-border pipeline facility for the importation of desalinated seawater on the border of the United States and Mexico in San Diego County, California. The Department will be working with Otay Water to conduct environmental analyses consistent with the National Environmental Policy Act (``NEPA'') and the California Environmental Quality Act (``CEQA'') for the Otay Mesa Conveyance System Project that would convey desalinated seawater from the new border crossing approximately four miles northeast to Otay Water's Roll Reservoir in San Diego County (``the Project''). The Project would provide a new water supply source from the U.S.-Mexico border to Otay Water's potable water system and ultimately delivered to end-user customers in the United States which Otay Water contends will reduce the strain and demand on the overall region's limited water supply.'' Under E.O. 11423, as amended, the Secretary of State is designated and empowered to receive all applications for Presidential Permits for the construction, connection, operation, or maintenance at the borders of the United States of facilities for the exportation or importation of water or sewage to or from a foreign country. The Department of State has the responsibility to determine whether issuance of a new Presidential Permit in light of Otay Water's application would serve the U.S. national interest. Call for Expert Reviewers to the U.S. Government Review of the Synthesis Report (SYR) of the Fifth Assessment Report of the Intergovernmental Panel on Climate Change (IPCC)

The United States Global Change Research Program, in cooperation with the Department of State, request expert review of the Intergovernmental Panel on Climate Change (IPCC) Second Order Draft (SOD) Synthesis Report (SYR) of the Fifth Assessment (AR5). More information on the report can be found at https://www.ipcc-syr.nl/. The United Nations Environment Programme (UNEP) (https:// www.unep.org/) and the World Meteorological Organization (WMO) (https:// www.wmo.int/pages/index_en.html) established the IPCC in 1988. In accordance with its mandate and as reaffirmed in various decisions by the Panel, the major activity of the IPCC is to prepare comprehensive and up-to-date assessments of policy-relevant scientific, technical, and socio-economic information for understanding the scientific basis of climate change, potential impacts, and options for mitigation and adaptation. The IPCC develops a comprehensive assessment spanning all the above topics approximately every six years. The First Assessment Report was completed in 1990, the Second Assessment Report in 1995, the Third Assessment Report in 2001, and the Fourth Assessment in 2007. Three working group volumes and a synthesis report comprise the Fifth Assessment Report. Working Group I assesses the scientific aspects of the climate system and climate change; Working Group II assesses the vulnerability of socio-economic and natural systems to climate change, potential negative and positive consequences, and options for adapting to it; and Working Group III assesses options for limiting greenhouse gas emissions and otherwise mitigating climate change. The Synthesis Report (SYR) synthesizes and integrates material contained with IPCC Assessment Reports and Special Reports. The SYR is to be based exclusively on material contained in the three Working Group Reports and Special Reports produced during the 5th or previous Assessment Cycles. The SYR is to be written in language accessible to non-technical users and guide readers to underlying materials if they wish to explore topics in greater depth. In October 2010, the IPCC approved the outline for the SYR of AR5 (https://www.ipcc.ch/meetings/session32/syr_final_scoping_ document.pdf). Authors were nominated and selected in March of 2012. All IPCC reports go through two broad reviews: a first-order draft reviewed by experts, and a second-order draft reviewed by both experts and governments. The SOD of the SYR for the AR5 will be available for review beginning on 21 April 2014. As part of the U.S. Government Review of the SOD of the SYR for the AR5, the U.S. Government is soliciting comments from experts in relevant fields of expertise. Experts may now register to review the draft report at: https:// review.globalchange.gov; the report will be available for download once it is released on 21 April 2014. To be considered for inclusion in the U.S. Government submission, comments must be received by 5PM EDT Monday, 19 May 2014. The United States Global Change Research Program will coordinate collection and compilation of U.S. expert comments and the review of the report by a Review Committee of Federal scientists and program managers in order to develop a consolidated U.S. Government submission, which will be provided to the IPCC by 13 June 2014. Instructions for registering as a reviewer, the process of the review itself and details on how to submit comments, as well as the SOD of the report will be available at: https://review.globalchange.gov. Experts may choose to provide comments directly through the IPCC's expert review process, which occurs in parallel with the U.S. government & expert review. The Department of State (``Department'') is amending its regulations to implement Section 1078 of the National Defense Authorization Act of 2013. This statutory provision, which entered into effect on July 2, 2013, amends previous law to allow the Department and the Broadcasting Board of Governors (``BBG'') to make public diplomacy program material available within the United States, upon request, following the dissemination of such material abroad, and requires the Department to issue regulations implementing this change.

The Department of State is amending its regulations regarding the waiver by joint action of consular and immigration officers of visa and passport requirements for members of foreign armed forces and coast guards. Specifically, the regulation, as amended, removes the current list of countries whose armed forces members are ineligible for a such a waiver, and provides that, in every case, when entry of foreign armed forces and coast guard members is proposed under arrangements made with the appropriate military authorities of the United States and after coordination within the U.S. Government by those U.S. military authorities, the Department of Homeland Security and the Department of State will jointly decide whether to approve waiver of the visa and/or passport requirements.
