The Department of Homeland Security (DHS) and the Department of Labor (DOL) (jointly referred to as the Departments) are amending regulations governing certification for the employment of nonimmigrant workers in temporary or seasonal non-agricultural employment. This interim final rule revises how DOL provides the consultation that DHS has determined is necessary to adjudicate H-2B petitions by revising the methodology by which DOL calculates the prevailing wages to be paid to H-2B workers and U.S. workers recruited in connection with the application for certification; the prevailing wage is then used in petitioning DHS to employ nonimmigrant workers in H-2B status. DOL and DHS are jointly issuing this rule in response to the court's order in Comit[eacute] de Apoyo a los Trabajadores Agricolas v. Solis, which vacated portions of DOL's current prevailing wage rate regulation, and to ensure that there is no question that the rule is in effect nationwide in light of other outstanding litigation. This rule also contains certain revisions to DHS's H-2B rule to clarify that DHS is the Executive Branch agency charged with making determinations regarding eligibility for H-2B classification, after consulting with DOL for its advice about matters with which DOL has expertise, particularly, in this case, questions about the methodology for setting the prevailing wage in the H-2B program.

The U.S. Department of Labor (the Department) announces the availability of approximately $474 million in grant funds to be awarded under the Trade Adjustment Assistance Community College and Career Training (TAACCCT) grant program. The TAACCCT grant program provides eligible institutions of higher education, as defined in section 102 of the Higher Education Act of 1965 (20 U.S.C. 1002), with funds to expand and improve their ability to deliver education and career training programs that can be completed in two years or less, and are suited for workers who are eligible for training under the Trade Adjustment Assistance (TAA) for Workers Program (``TAA-eligible workers'') of chapter 2 of title II of the Trade Act of 1974, 19 U.S.C. 2271-2323, as well as other adults. Eligible institutions may be located in the 50 States, the District of Columbia, Puerto Rico or the U.S. territories; however, the competitiveness of institutions in the U.S. territories for this Solicitation for Grant Applications (SGA) may be impacted by their limited opportunity to serve TAA-eligible workers. The primary intent of the TAACCCT program is to meet the educational or career training needs of workers who have lost their jobs or are threatened with job loss as a result of foreign trade by funding the expansion and improvement of education and career training programs that are suited for these individuals; however, the Department expects that a wide range of individuals will benefit from the TAACCCT program once education and training programs are developed and implemented. The Department intends to fund grants to single institution applicants ranging from $2,372,500 to $2.75 million, totaling up to $150 million. This allows the Department to award 54-63 grants to single institutions, potentially funding more than one per state. The Department will award grants up to $25 million to single-state or multi-state consortium applicants, up to approximately $324 million in total awards, which propose programs that impact TAA-eligible workers and other adults across a state, region or regions, industry sector or cluster of related industries. On August 17, 2012, OSHA issued a notice of proposed rulemaking, as well as a companion direct final rule, that proposed applying the requirements in OSHA's 2010 cranes and derricks construction standard to underground construction work and demolition work. The notice of proposed rulemaking also proposed to correct inadvertent errors in the underground construction and demolition standards. After receiving a comment recommending that OSHA clarify the proposed regulatory text of the demolition standard, OSHA clarified the text and is issuing this final rule to apply the cranes and derricks standard to underground construction work and demolition work.

Under this solicitation, DOL expects to award 26 grants for up to $1,000,000 each to cover a 39-month period of performance, which includes a planning period of up to six months, program operation period of 24 months, and a minimum of nine months of post program support and follow-up services provided to each participant. Any non- profit organization with IRS 501(c)(3) status, unit of state or local government, or any Indian and Native American entity eligible for grants under WIA Section 166, may apply for these grants to provide services to eligible participants in areas with high-poverty and high- crime rates. These services will include diversion and/or expungement (required for all participants), case management, mentoring, education, training leading to industry-recognized credentials for in demand industries and occupations in the State or local area, service- learning, workforce activities, and post-program support and follow-up services. Announcement regarding a change in eligibility for Unemployment Insurance (UI) claimants in Alaska, Georgia, Louisiana, Maryland, Mississippi, Missouri, Montana, Ohio, South Carolina and Texas in the Emergency Unemployment Compensation (EUC08) program, and the Federal-State Extended Benefits (EB) program. The U.S. Department of Labor (Department) produces trigger notices indicating which states qualify for both EB and EUC08 benefits, and provides the beginning and ending dates of payable periods for each qualifying state. The trigger notices covering state eligibility for these programs can be found at: https://ows.doleta.gov/unemploy/claims arch.asp. The following changes have occurred since the publication of the last notice regarding states EUC08 and EB trigger status: Maryland and Texas have triggered ``off'' in Tier 3 of EUC08 Maryland and Texas began a 13-week mandatory ``on'' period in Tier 3 of EUC08 on October 7, 2012. Based on data released from the Bureau of Labor Statistics, these states are below the 7.0 percent threshold rate necessary to remain ``on'' in Tier 3 of EUC08. As a result, they have concluded a payable period in Tier 3 and the week ending January 5, 2013, was the last week in which EUC08 claimants in these states could exhaust Tier 2, and establish Tier 3 eligibility. Under the phase-out provisions, claimants could receive any remaining entitlement they had in Tier 3 after January 5, 2013. Georgia, Mississippi and South Carolina have triggered ``off'' in Tier 4 of EUC08. The three month average, seasonally adjusted total unemployment rate in these states fell below the 9.0 percent threshold rate to remain ``on'' in Tier 4 of EUC08. This triggered these states ``off'' of Tier 4 and the week ending January 12, 2013, was the last week in which EUC08 claimants in these states could exhaust Tier 3, and establish Tier 4 eligibility. Under the phase-out provisions, claimants could receive any remaining entitlement they had in Tier 4 after January 12, 2013. Louisiana, Missouri, and Ohio have triggered ``off'' in Tier 3 of EUC08. The three month average, seasonally adjusted total unemployment rate in Louisiana, Missouri, and Ohio fell below the 7.0 percent threshold rate to remain ``on'' in Tier 3 of EUC08. The three month average, seasonally adjusted total unemployment rate in Montana fell below the 6.0 percent threshold rate to remain ``on'' in Tier 2 of EUC08. This triggered Montana ``off'' of Tier 2 and the week ending January 12, 2013, was the last week in which EUC08 claimants in Montana could have exhausted Tier 1, and establish Tier 2 eligibility. Under the phase-out provisions, claimants could receive any remaining entitlement they had in Tier 2 after January 12, 2013. Alaska has triggered ``on'' Tier 4 of EUC08. Alaska's 13-week insured unemployment rate for the week ending January 19, 2013, rose to meet the 6 percent threshold to trigger ``on'' to Tier 4 of EUC08. The payable period for Alaska in Tier Four of EUC08 began February 3, 2013. As a result, the current maximum potential entitlement for claimants in Alaska in EUC08 has increased from 37 weeks to 47 weeks. Alaska triggers ``on'' to EB. Alaska's 13-week insured unemployment rate for the week ending January 19, 2013, rose to meet the 6 percent threshold to trigger ``on'' to EB. Alaska's payable period in EB began February 3, 2013.
