Infectious Diseases
OSHA invites interested parties to participate in informal stakeholder meetings concerning occupational exposure to infectious diseases. OSHA plans to use the information gathered at these meetings to explore the possible development of a proposed rule to protect workers from occupational exposure to infectious agents in settings, either where workers provide direct patient care or where workers perform tasks other than direct patient care that also have occupational exposure. These other work tasks include: Providing patient support services (e.g., housekeeping, facility maintenance); handling, transporting, receiving or processing infectious items or wastes (e.g., transporting medical specimens, disposing of medical waste); conducting autopsies or performing mortuary services; and performing tasks in laboratories.

Onsite Consultation Agreements; Extension of the Office of Management and Budget's (OMB) Approval of Information Collection (Paperwork) Requirements
OSHA solicits comments concerning its proposal to extend OMB approval of the information collection requirements contained in the Consultation Agreement regulations (hereinafter, the Onsite Consultation Program regulations) (29 CFR part 1908). The Onsite Consultation Program regulations specify services to be provided, and practices and procedures to be followed, by the State Onsite Consultation Programs. Information collection requirements set forth in the Onsite Consultation Program regulations are in two categories: State Responsibilities and Employer Responsibilities. Eight regulatory provisions require information collection activities by the State. The Federal government provides 90 percent of the funds for Onsite Consultation services delivered by the States, which result in the collections of information. Four requirements apply to employers and specify conditions for receiving the free Onsite Consultation services.
Occupational Injury and Illness Recording and Reporting Requirements-NAICS Update and Reporting Revisions
OSHA is proposing to update Appendix A to Subpart B of its Injury and Illness Recording and Reporting regulation. Appendix A contains a list of industries that are partially exempt from maintaining records of occupational injuries and illnesses, generally due to their relatively low rates of occupational injury and illness. The current list of industries is based on the Standard Industrial Classification (SIC) system. In 1997, the North American Industry Classification System (NAICS) was introduced to classify establishments by industry. The proposed rule would update Appendix A by replacing it with a list of industries based on NAICS and more recent injury and illness data. The proposed rule would also require employers to report to OSHA, within eight hours, all work-related fatalities and all work-related in-patient hospitalizations; and within 24 hours, all work-related amputations. The current regulation requires an employer to report to OSHA, within eight hours, all work-related fatalities and in-patient hospitalizations of three or more employees.

Standards Improvement Project-Phase III
Phase III of the Standards Improvement Project (SIP-III) is the third in a series of rulemaking actions to improve and streamline OSHA standards. The Standards Improvement Project removes or revises individual requirements within rules that are confusing, outdated, duplicative, or inconsistent. OSHA identified several requirements for SIP-III (e.g., rigging, NIOSH records, and training certifications) for improvement based on the Agency's review of its standards, suggestions and comments from the public, or recommendations from the Office of Management and Budget (OMB). OSHA believes that improving these standards will help employers to better understand their obligations, promote safety and health for employees, lead to increased compliance, and reduce compliance costs. OSHA estimates that these changes will result in annualized savings for employers of over $45 million, and will reduce paperwork burden by 1.85 million hours annually.

Occupational Injury and Illness Recording and Reporting Requirements
OSHA is reopening the rulemaking record to allow interested persons, particularly small businesses, to comment on the information gathered and on issues raised during the small business teleconferences that the Agency and the Small Business Administration's Office of Advocacy (SBA Office of Advocacy) co-sponsored on April 11-12, 2011. The purpose of the teleconferences was to gather information from small businesses about their experiences recording work-related musculoskeletal disorders (MSDs) and how they believe they would be impacted by OSHA's proposed rule to revise its Recordkeeping regulations to restore a column on the OSHA 300 Log that employers would have to check if a case they already are required to record is an MSD. The record will remain open for 30 days for comment on these limited issues.

Maritime Advisory Committee for Occupational Safety and Health (MACOSH)
In accordance with the provisions of the Federal Advisory Committee Act (FACA), as amended (5 U.S.C., App. 2), and after consultation with the General Services Administration, the Secretary of Labor announced on January 10, 2011, her intention to reestablish the Maritime Advisory Committee for Occupational Safety and Health (MACOSH) as being in the public interest (76 FR 1460). She signed the MACOSH charter on January 25, 2011, which, pursuant to FACA, will expire after two years on January 25, 2013. On March 29, 2011, the Secretary of Labor selected and approved 15 members to serve on the Committee. MACOSH will contribute to OSHA's performance of the duties imposed by the Occupational Safety and Health Act of 1970 (29 U.S.C. 651 et seq.). The first meeting of the reestablished MACOSH Committee will be held on April 19 and 20, 2011, in Washington, DC.

Nationally Recognized Testing Laboratories Fees
The Occupational Safety and Health Administration (OSHA) is adjusting the approach it uses for calculating the fees the Agency charges Nationally Recognized Testing Laboratories (NRTLs), and also is requiring prepayment of these fees. This adjustment increases the fees; OSHA is phasing in the fee increase over three years for existing NRTLs and pending NRTL applicants. OSHA began charging NRTLs fees in 2000, and revised the fee schedule only twice since then (in 2002 and 2007).

Maritime Advisory Committee for Occupational Safety and Health (MACOSH); Committee Reestablishment
In accordance with the provisions of the Federal Advisory Committee Act, as amended (5. U.S.C., App. 2), and after consultation with the General Services Administration, the Secretary of Labor intends to reestablish the Maritime Advisory Committee for Occupational Safety and Health. The Committee will better enable OSHA to perform the duties imposed by the Occupational Safety and Health (OSH) Act of 1970 (29 U.S.C. 655, 656). Authority to establish this Committee is found in Sections 6(b)(1) and 7(b) of the OSH Act, Section 41 of the Longshore and Harbor Workers' Compensation Act (33 U.S.C. 941), Secretary of Labor's Order 42010 (75 FR 55355, Sept. 10, 2010), and 29 CFR part 1912. Compliance Directive for Fall Protection in Residential Construction
The Occupational Safety and Health Administration (OSHA) is issuing compliance directive STD 03-11-002 Fall Protection in Residential Construction. This directive rescinds compliance directive STD 03-00-001, Plain Language Revision of OSHA Instruction STD 3.1, Interim Fall Protection Compliance Guidelines for Residential Construction, effective on June 18, 1999. There continue to be high numbers of fall-related fatalities in residential construction. The Advisory Committee on Construction Safety and Health, the National Association of Home Builders, and the Occupational Safety and Health State Plan Association have recommended the withdrawal of directive STD 03-00-001.
Nationally Recognized Testing Laboratories; Supplier's Declaration of Conformity
Based on its analysis of comments received in response to a Request for Information published in October 2008, the Occupational Safety and Health Administration will not initiate rulemaking to permit the use of a Supplier's Declaration of Conformity as a means of ensuring the safety of products currently requiring approval by Nationally Recognized Testing Laboratories.
