Notice of a Change in Status of the Extended Benefit (EB) Program for New Mexico
The Department of Labor's (DOL) Employment and Training Administration (ETA) published in the Federal Register on April 27, 2021, concerning New Mexico's EB change. On March 17, 2021, New Mexico Senate Bill 52 was enacted authorizing the use of the optional TUR trigger to determine New Mexico's EB status, and based on data released on March 15, 2021 by BLS, the seasonally-adjusted 3-month average total unemployment rate (TUR) for New Mexico rose above the 8.0 percent threshold necessary to trigger ``on'' to a High Unemployment Period for EB. However, in New Mexico, with the exception of general appropriation legislation, laws go into effect 90 days after date of enactment. This delay was not originally considered, and the original Federal Register Notice published on April 27, 2021 (86 FR 22268) contained an incorrect status change for New Mexico. Therefore, DOL is issuing this correction.

Exercise of Time-Limited Authority To Increase the Fiscal Year 2021 Numerical Limitation for the H-2B Temporary Nonagricultural Worker Program and Portability Flexibility for H-2B Workers Seeking To Change Employers
The Secretary of Homeland Security, in consultation with the Secretary of Labor, is exercising his time-limited Fiscal Year (FY) 2021 authority and increasing the numerical limitation on H-2B nonimmigrant visas to authorize the issuance of no more than 22,000 additional visas through the end of the second half of FY 2021 to those businesses likely to suffer irreparable harm, as attested by the employer on a new attestation form. In addition to making additional visas available under the FY 2021 time-limited authority, DHS is exercising its general H-2B regulatory authority to temporarily provide portability flexibility by allowing H-2B workers who are already in the United States to begin work immediately after an H-2B petition (supported by a valid temporary labor certification) is received by USCIS, and before it is approved.
Request for Public Comments: Exploration of a Multi-Program, Integrated Case Management System

This action seeks a revision of the Form 9141C, and its instructions; the rest of the forms and instructions will be renewed without changes. Strengthening Wage Protections for the Temporary and Permanent Employment of Certain Immigrants and Non-Immigrants in the United States: Delay of Effective and Transition Dates
On March 12, 2021, the Department of Labor (Department or DOL) published a final rule delaying the effective date of the January 14, 2021, rule entitled Strengthening Wage Protections for the Temporary and Permanent Employment of Certain Aliens in the United States (the rule or Final Rule), from March 15, 2021 until May 14, 2021. On March 22, 2021, the Department proposed to further delay the effective date of the rule by eighteen months from May 14, 2021 until November 14, 2022, along with corresponding proposed delays to the rule's transition dates. The Department proposed an additional delay to provide a sufficient amount of time to thoroughly consider the legal and policy issues raised in the rule, and offer the public, through the issuance of a Request for Information, an opportunity to provide information on the sources and methods for determining prevailing wage levels covering employment opportunities that United States (U.S.) employers seek to fill with foreign workers on a permanent or temporary basis through certain employment-based immigrant visas or through H-1B, H-1B1, or E-3 nonimmigrant visas. The Department also proposed the further delay to provide agency officials with a sufficient amount of time to compute and validate prevailing wage data covering specific occupations and geographic areas, complete and thoroughly test system modifications, train staff, and conduct public outreach to ensure an effective and orderly implementation of any revisions to the prevailing wage levels. The Department invited written comments from the public for 30 days, until April 21, 2021, on the proposed further delay and received 627 timely comments. The Department has reviewed the comments received in response to the proposal and will delay the effective date of the Final Rule for a period of 18 months, along with corresponding delays to the rule's transition dates.

This Notice announces proposed modifications to the allotment formula for the National Farmworker Jobs Program (NFJP), which is authorized under the Workforce Innovation and Opportunity Act (WIOA), Section 167, and presents preliminary State planning estimates for Program Year (PY) 2021. These allotments are estimates based on the funds appropriated in the Consolidated Appropriations Act, 2021 (from this point forward will be referred to as the ``the Act''). There are vacant positions on the WIAC representing State agencies with responsibility for workforce investment activities (State Workforce Agency representatives) and representatives of State workforce and labor market information (LMI) directors. While this notice is directed specifically to obtaining nominations for the current vacancies, LMI director and State Workforce Agency representatives, individuals qualified for the other five membership categories listed below in the SUPPLEMENTARY INFORMATION section are invited to submit nomination materials, and DOL will consider these nominees in the event that seats in those categories become available. When submitting nomination materials, please indicate the category or categories for which the nominee would like to be considered. Adjudication of Temporary and Seasonal Need for Herding and Production of Livestock on the Range Applications Under the H-2A Program
The Department of Labor (the Department) proposes to amend its regulations regarding the adjudication of temporary need for employers seeking herding or production of livestock on the range job opportunities under the H-2A program. Consistent with a court-approved settlement agreement, this notice of proposed rulemaking (NPRM or proposed rule) would rescind the regulation that governs the period of need for such job opportunities to ensure the Department's adjudication of temporary or seasonal need is conducted in the same manner for all applications for temporary agricultural labor certification.
Notice of a Change in Status of the Extended Benefit (EB) Program for the Virgin Islands
This notice announces a changes in benefit period eligibility under the EB program that have occurred since the publication of the last notice regarding the State's EB status: Based on the data submitted by the Virgin Islands for the week ending April 10, 2021, the Virgin Islands' 13-week IUR was 4.83 percent, falling below the 5.0 percent IUR threshold necessary to remain ``on'' EB. Therefore, the EB period for the Virgin Islands ends on May 1, 2021. The state will remain in an ``off'' period for a minimum of 13 weeks.
Notice of Intent To Reestablish the Advisory Committee on Apprenticeship (ACA) Charter and Request for Member Nominations
The Secretary of Labor (Secretary) has determined that the reestablishment of the Advisory Committee on Apprenticeship (ACA or Committee) is necessary and in the public interest. The Department of Labor (DOL) intends to reestablish the ACA charter with revisions which are not intended to change the Committee's purpose or original intent. The revisions update the charter to ensure its closer alignment with the Department's current apprenticeship priorities. Additionally, DOL is requesting nominations of qualified candidates to be considered for appointment to the ACA.
