This document provides the final text of regulations governing the employee protection (whistleblower) provisions of the Consumer Product Safety Improvement Act of 2008 (CPSIA). An interim final rule governing these provisions and request for public comment was published in the Federal Register on August 31, 2010. Three comments were received. This rule responds to those comments and establishes the final procedures and time frames for the handling of retaliation complaints under CPSIA, including procedures and time frames for employee complaints to the Occupational Safety and Health Administration (OSHA), investigations by OSHA, appeals of OSHA determinations to an administrative law judge (ALJ) for a hearing de novo, hearings by ALJs, review of ALJ decisions by the Administrative Review Board (ARB) (acting on behalf of the Secretary of Labor), and judicial review of the Secretary's final decision.

In order to meet its statutory responsibilities under the INA, the Department is revising the existing collection of information pertaining to employers seeking to apply for labor condition applications to allow them to bring foreign labor to the U.S. on a temporary basis. The Secretary uses the collected information to determine if employers are meeting their statutory and regulatory obligations.

The Office of Trade and Labor Affairs (OTLA) in the Bureau of International Labor Affairs of the U.S. Department of Labor has determined that an extension of time is required for its review of a public submission concerning Mexico filed under Article 16.3 of the North American Agreement on Labor Cooperation (NAALC). OTLA received the submission on November 14, 2011, from the Sindicato Mexicano de Electricistas (SME) and 93 other organizations. The submission is available at https://www.dol.gov/ilab/programs/otla/ freetradeagreement.htm. OTLA accepted the submission for review on January 13, 2012 (77 FR 4366 (Jan. 27, 2012)), in accordance with its Procedural Guidelines, which are available at https://www.dol.gov/ilab/programs/otla/ proceduralguidelines.htm. Acceptance triggers a 180-day review period within which OTLA must issue a public report, including a summary of the proceedings and any findings and recommendations, unless circumstances as determined by OTLA require an extension of time. On May 25, 2012, OTLA received a supplemental submission from the submitters containing new allegations. In accordance with Section H.7 of its Guidelines, OTLA has determined that the circumstances require an extension of time to permit a thorough consideration of the supplemental submission and of information obtained after an OTLA fact- finding visit to Mexico in March.

Also, notwithstanding any other provisions of law, no person shall be subject to penalty for failing to comply with a collection of information if the collection of information does not display a currently valid OMB control number (see 5 CFR 1320.5(a) and 1320.6). This data collection request consists of follow-up surveys for a sample of WIA customers participating in the WIA Evaluation and data for use in estimating the costs of WIA services and training received by sample group members. In addition, it includes data for a supplemental study to learn about services to veterans, the services they receive, and their outcomes. Since the WIA Evaluation is excluding veterans from the net-impact study, this supplemental study provides the opportunity to analyze veterans' experiences in the 28 WIA Evaluation sites.

OSHA also is including the construction industry in this rulemaking to ensure consistency among the Agency's standards. OSHA is publishing a direct final rule in today's Federal Register taking this same action.
