The Acting Administrator of the Drug Enforcement Administration is issuing this temporary scheduling order to extend the temporary schedule I status of beta-hydroxythiofentanyl (N-[1-[2- hydroxy-2-(thiophen-2-yl)ethyl]piperidin-4-yl]-N-phenylpropio namide) also known as N-[1-[2-hydroxy-2-(2-thienyl)ethyl]-4-piperidinyl]-N- phenylpropanamide including its isomers, esters, ethers, salts and salts of isomers, esters and ethers. The schedule I status of beta- hydroxythiofentanyl currently is in effect through May 12, 2018. This temporary order will extend the temporary scheduling of beta- hydroxythiofentanyl for one year, or until the permanent scheduling action for this substance is completed, whichever occurs first.

If finalized, this action would impose the regulatory controls and administrative, civil, and criminal sanctions applicable to schedule I controlled substances on persons who handle (manufacture, distribute, import, export, engage in research, conduct instructional activities or chemical analysis, or possess), or propose to handle beta-hydroxythiofentanyl.

Department of Justice's Initiative to Seek Termination of Legacy Antitrust Judgments

This notice describes the Department of Justice's new initiative for seeking unilaterally to terminate ``legacy'' antitrust judgments. Legacy antitrust judgments are those judgments that do not include an express termination date and that a court has not terminated by an order. The vast majority of these judgments were entered before 1979, when the Division adopted the general practice of using sunset provisions to terminate a judgment automatically, usually 10 years after entry of the judgment. Nearly 1300 legacy judgments remain open on the books of the Antitrust Division, and nearly all of them likely remain open on the dockets of courts around the country. Many of these legacy judgments do not serve their original purpose of protecting competition. To eliminate the burden on defendants, courts, and the Division of complying with, overseeing, and enforcing outdated judgments, the Division has announced an initiative whereby it unilaterally will seek to terminate legacy judgments, as appropriate. The initiative provides for public notice and comment before the Division seeks to terminate a judgment. The Division has established a website to keep the public apprised of this initiative and its efforts to terminate outdated judgments: www.justice.gov/atr/ JudgmentTermination.

The fee to cover the average cost of incarceration for Federal inmates was $34,704.12 ($94.82 per day) in FY 2016 and $36,299.25 ($99.45 per day) in FY 2017. The average annual cost to confine an inmate in a Residential Re-entry Center was $29,166.54 ($79.69 per day) for FY 2016 and $32,309.80 ($88.52 per day) for FY 2017.

This scheduling action discharges the United States obligations under the Single Convention on Narcotic Drugs (1961). The Department of Justice, Civil Division, intends to request approval from the Office of Management and Budget (OMB) for a generic information collection clearance that will allow Civil to conduct a variety of surveys, focus groups, listening sessions and website content testing. Civil will submit request for review and approval to the Office of Management and Budget (OMB), in accordance with the Paperwork Reduction Act of 1995. Over the next three (3) years, Civil anticipates undertaking a variety of new surveys and data collections as well as reassessing ongoing elder justice website projects that address elder abuse and elder justice issues. This work will entail development of new survey instruments, redesigning and/or modifying existing surveys and creating or modifying established surveys. In order to inform Civil data collection protocols, to develop accurate estimates of respondent burden and to minimize respondent burden associated with each new or modified data collection, Civil will engage in pilot and field test activities to refine instrumentation and data collection methodologies. Civil envisions using a variety of techniques, including, but not limited to, tests of different types of survey and data collection operations, focus groups, pilot testing, exploratory interviews, questionnaires, usability testing and electronic data collection instruments. Following standard Office of Management and Budget (OMB) Requirements, Civil will submit a change request to OMB individually for every group of data collection activities undertaken under this generic clearance. Civil will provide OMB with a copy of the individual instruments or questionnaires (if one is used), as well as other materials describing the project.
