Fair Housing Act Design and Construction Requirements: Adoption of Additional Safe Harbors: Extension of Public Comment Period
On January 15, 2020, HUD published a proposed rule in the Federal Register inviting public comment on amendments to HUD's Fair Housing Act design and construction regulations. The January 15, 2020, proposed rule set March 16, 2020, as the comment due date. Section 8 Housing Assistance Payments Program-Fiscal Year 2020 Inflation Factors for Public Housing Agency Renewal Funding
This notice establishes Renewal Funding Inflation Factors to adjust Fiscal Year (FY) 2020 renewal funding for the Housing Choice Voucher (HCV) program of each public housing agency (PHA), as required by the Further Consolidated Appropriations Act, 2020. The notice apportions the expected percent change in national Per Unit Cost (PUC) for the HCV program, 4.25 percent, to each PHA based on the change in Fair Market Rents for their operating area to produce the FY 2020 RFIFs. HUD's FY 2020 methodology is the same as that which was used in FY 2019.

Executive Order 13891 Promoting the Rule of Law Through Improved Agency Guidance Documents: Announcing the Availability of the HUD Guidance Portal
On October 9, 2019, the President issued Executive Order (E.O.) 13891, ``Promoting the Rule of Law Through Improved Agency Guidance Documents.'' Among other things, Section 3 of the E.O. requires agencies to provide a single online guidance portal for the public to access all effective guidance. In addition, Office of Management and Budget Memorandum M-20-02 dated October 31, 2019, advises that agencies should announce the existence of the guidance portal by Federal Register notice. Consistent with this guidance, today's notice advises the public that HUD has comprehensively reviewed its guidance documents, determined which have continued effect, and is making them available on https://www.hud.gov/guidance.
Privacy Act of 1974; Matching Program
Pursuant to the Privacy Act of 1974, as amended by the Computer Matching and Privacy Protection Act (CMPPA) of 1988, HUD is providing notice of its intent to execute a new computer matching agreement with the U.S. Department of Education (ED). The matching agreement covers the exchange of data obtained by ED pertaining to delinquent debt. The purpose of the match is to update the Credit Alert Verification Reporting System (CAIVRS), which is maintained by HUD.

This notice provides updated Administrative Guidelines (Guidelines) and requirements for Project-Based Voucher (PBV) Subsidy Layering Reviews (SLRs), to include new PBV Housing Assistance Payments (HAP) contract terms provisions, as amended by the Housing Opportunity Through Modernization Act of 2016 (HOTMA), and SLR requirements for Mixed-Finance projects that may or may not include PBV assistance. This notice also provides transparency on HUD's expectations regarding cash flow, debt coverage ratios, net operating income, and operating expense trending requirements.
Economic Growth, Regulatory Relief, and Consumer Protection Act: Initial Guidance on Property Inspections and Environmental Reviews
Section 209 of the Economic Growth, Regulatory Relief, and Consumer Protection Act (the ``Economic Growth Act'') added section 38 to the United States Housing Act of 1937 and makes several amendments pertaining to small public housing agencies (PHAs). This notice explains how HUD designates small PHAs and implements section 209 provisions that reduce regulatory burden on small PHAs by reducing the number of inspections required for units with section 8(o) voucher assistance, and providing an exemption from environmental review requirements for development and modernization projects that have a total cost of not more than $100,000. This notice also identifies the small PHAs that are eligible for this section 209 regulatory relief.
Notice of HUD Vacant Loan Sales (HVLS 2020-1)
This notice announces HUD's intention to competitively offer multiple residential reverse mortgage pools consisting of approximately 700 reverse mortgage notes secured by properties with a loan balance of approximately $150 million. The sale will consist of due and payable Secretary-held reverse mortgage loans. The mortgage loans consist of first liens secured by single family, vacant residential properties, where all borrowers are deceased, and no borrower is survived by a non- borrowing spouse. This notice also generally describes the bidding process for the sale and certain persons who are ineligible to bid. This is the sixth sale offering of its type and the sale will be held on March 18, 2020.

Mortgage and Loan Insurance Programs Under the National Housing Act-Debenture Interest Rates
This Notice announces changes in the interest rates to be paid on debentures issued with respect to a loan or mortgage insured by the Federal Housing Administration under the provisions of the National Housing Act (the Act). The interest rate for debentures issued under Section 221(g)(4) of the Act during the 6-month period beginning January 1, 2020, is 2\1/4\ percent. The interest rate for debentures issued under any other provision of the Act is the rate in effect on the date that the commitment to insure the loan or mortgage was issued, or the date that the loan or mortgage was endorsed (or initially endorsed if there are two or more endorsements) for insurance, whichever rate is higher. The interest rate for debentures issued under these other provisions with respect to a loan or mortgage committed or endorsed during the 6-month period beginning January 1, 2020, is 1\3/4\ percent.

Streamlining and Aligning Formaldehyde Emission Control Standards for Certain Wood Products in Manufactured Home Construction With Title VI of the Toxic Substance Control Act
HUD is issuing a final rule to implement the Formaldehyde Standards for Composite Wood Products Act of 2010, which added Title VI to the Toxic Substances Control Act (TSCA). The purpose of TSCA Title VI is to reduce exposures to formaldehyde emissions from composite wood products, thereby resulting in benefits from avoided adverse health effects. In addition, HUD is removing certain aspects of the current manufactured housing formaldehyde standards requirements that are not addressed by TSCA. This final rule follows publication of a March 22, 2019, proposed rule and takes into consideration the public comments received on the proposed rule. This final rule also incorporates by reference, ASTM D6007-14 and ASTM E1333-14, the current standard requirements for formaldehyde concentration and emissions rate air chamber testing.
Manufactured Home Construction and Safety Standards
This proposed rule would amend the Federal Manufactured Home Construction and Safety Standards (the Construction and Safety Standards) by adopting recommendations made to HUD by the Manufactured Housing Consensus Committee (MHCC). The National Manufactured Housing Construction and Safety Standards Act of 1974 (the Act) requires HUD to publish in the Federal Register any proposed revised Construction and Safety Standard submitted by the MHCC. The MHCC has prepared and submitted to HUD its third group of recommendations to improve various aspects of the Construction and Safety Standards. HUD has reviewed those proposals and has made editorial revisions to several and HUD proposes correlating additions for several of the proposals. HUD has decided not to go forward in this proposed rule with certain revisions recommended by the MHCC due to pending regulations for improving energy efficiency in manufactured homes currently being prepared by the Department of Energy. In addition, HUD has decided not to move forward with a new proposal to add requirements for draftstopping to the Manufactured Home Construction and Safety Standards. As agreed, these recommendations are being published to provide notice of the proposed revisions and an opportunity for public comment.
