Mortgage and Loan Insurance Programs Under the National Housing Act-Debenture Interest Rates
This notice announces changes in the interest rates to be paid on debentures issued with respect to a loan or mortgage insured by the Federal Housing Administration under the provisions of the National Housing Act (the Act). The interest rate for debentures issued under section 221(g)(4) of the Act during the 6-month period beginning January 1, 2011, is 2\1/2\ percent. The interest rate for debentures issued under any other provision of the Act is the rate in effect on the date that the commitment to insure the loan or mortgage was issued, or the date that the loan or mortgage was endorsed (or initially endorsed if there are two or more endorsements) for insurance, whichever rate is higher. The interest rate for debentures issued under these other provisions with respect to a loan or mortgage committed or endorsed during the 6-month period beginning January 1, 2011, is 3\7/8\ percent. However, as a result of an amendment to section 224 of the Act, if an insurance claim relating to a mortgage insured under sections 203 or 234 of the Act and endorsed for insurance after January 23, 2004, is paid in cash, the debenture interest rate for purposes of calculating a claim shall be the monthly average yield, for the month in which the default on the mortgage occurred, on United States Treasury Securities adjusted to a constant maturity of 10 years.

Equal Access to Housing in HUD Programs-Regardless of Sexual Orientation or Gender Identity
As the Nation's housing agency, HUD administers programs designed to meet the goal of ensuring decent housing and suitable living environment for all. In pursuit of this goal, it is HUD's responsibility to ensure that all who are otherwise eligible to participate in HUD's programs have equal access to these programs and have the opportunity to compete fairly for HUD funds without being subject to arbitrary exclusion. There is evidence, however, that lesbian, gay, bisexual, and transgender (LGBT) individuals and families are being arbitrarily excluded from some housing opportunities in the private sector. Through this proposed rule, HUD strives to ensure that its core programs are open to all eligible individuals and families regardless of sexual orientation or gender identity.

Notice of Proposed Information Collection; Comment Request; Section 3 Business Self-Certification Application
The information collection associated with the Section 3 Business Self-Certification Pilot Program is being submitted to the Office of Management and Budget (OMB) as a new collection, as required by the Paperwork Reduction Act. The Office of Fair Housing and Equal Opportunity will be implementing a six-month Section 3 Business Self- Certification pilot program in five metropolitan areas: (1) Washington, DC; (2) Los Angeles, CA; (3) New Orleans, LA; (4) Detroit, MI; and (5) Miami, FL. The findings from this pilot program will allow HUD to determine the feasibility of implementing the Section 3 Business Self- Certification program nationally. The proposed Section 3 Business Self- Certification Application Form has been developed to allow eligible businesses to self-certify that they meet the regulatory definition of a Section 3 Business Concern set forth at 24 CFR part 135. Eligible firms will complete and submit the form electronically to HUD, and will be placed into a registry of Section 3 Businesses maintained on HUD's Web site. Agencies that receive Section 3 covered HUD funding will be encouraged to contact the firms listed in HUD's registry of Section 3 Businesses to facilitate the award of contracts and subcontracts to these entities.

Notice of Submission of Proposed Information Collection to OMB; American Housing Survey
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The American Housing Survey (AHS) provides a periodic measure of the size and composition of the country's housing inventory. Title 12, United States Code, Sections 1701Z-1, 1701Z- 2(g), and 1710Z-10a mandate the collection of this information. Like the previous surveys, the 2011 AHS collects data on subjects such as the amount and types of changes in the inventory, the physical condition of the inventory, the characteristics of the occupants, housing costs, the persons eligible for and beneficiaries of assisted housing, and the number and characteristics of vacancies. The 2011 AHS will collect additional data on potential health and safety hazards in the home and modifications made to assist occupants living with disabilities. Selected neighborhood and journey to work questions will not be collected in the 2011 survey and the mortgage questions will be redesigned. There is no AHS-Metropolitan Sample in the 2011 survey. But, a supplemental sample of housing units will be selected for 30 metropolitan areas. The supplemental sample will be combined with existing sample in these areas in order to produce metropolitan estimates using the National data. Policy analysts, program managers, budget analysts, and Congressional staff use AHS data to advise executive and legislative branches about housing conditions and the suitability of public policy initiatives. Academic researchers and private organizations also use AHS data in efforts of specific interest and concern to their respective communities. The Department of Housing and Urban Development (HUD) needs the AHS data for two important uses. 1. With the data, policy analysts can monitor the interaction among housing needs, demand and supply, as well as changes in housing conditions and costs, to aid in the development of housing policies and the design of housing programs appropriate for different target groups, such as first-time home buyers and the elderly. 2. With the data, HUD can evaluate, monitor, and design HUD programs to improve efficiency and effectiveness.

Notice of Availability: HUD's Fiscal Year (FY) 2010 NOFA for the Capital Fund Education and Community Facilities Program-Technical Correction and Extension of Deadline Date
On October 18, 2010, HUD posted on https://www.Grants.gov its Notice of Funding Availability (NOFA) for the Fiscal Year (FY) 2010 Capital Fund Education and Community Facilities (CFCF) Program. The NOFA made available approximately $35 million in assistance for development of facilities to provide early childhood education, adult education, and/or job training programs for public housing residents. Today's Federal Register publication announces that HUD has posted on https://www.Grants.gov a technical correction that makes several corrections and clarification to NOFA. Specifically, the corrected NOFA clarifies that Public Housing Agencies (PHAs) may submit multiple applications, but each application must include only one site. HUD has also revised the NOFA to specify tie breaking criteria. Further, in order to provide applicants with sufficient time to submit new or revised applications that incorporate the corrections and clarifications to the NOFA, HUD has extended the application deadline to February 3, 2011. Potential applicants should review carefully the corrected NOFA to best determine whether to submit an updated application which incorporates the corrections and clarifications related to this notice. Applicants who submitted their applications prior to the technical correction notice can choose to submit an updated application that reflects the corrections and clarifications, but are not required to if they determine no changes are needed for their application. Applicants are reminded that if they submitted any portion of their application by fax with their initial application submission and choose to submit a revised application, then they will have to refax the materials after they submit the revised application to HUD. Please refer to the General Section for instructions regarding materials that are faxed and how HUD matches faxes to applications. For each site for which a PHA submits an application, the last version of the application received by https:// www.Grants.gov by the deadline date, in accordance with the timely receipt requirements, will be the application that is reviewed and rated. Notice of Submission of Proposed Information Collection to OMB Exigent Health and Safety Deficiency Correction Certification
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. HUD's Uniform Physical Condition Standards (UPCS) regulation (24 CFR part 5, subpart G) provides that HUD housing must be decent, safe, sanitary, and in good repair. Public housing agencies (PHAs) must maintain housing in a manner that meets prescribed physical condition standards to be considered decent, safe, sanitary, and in good repair. The UPCS regulation also provides that all area and components of the housing must be free of health and safety hazards. HUD conducts physical inspections of the HUD-funded housing to determine if the UPCS standards are being met. Pursuant to the UPCS inspection protocol, at the end of the inspection (or at the end of each day of a multi-day inspection) the inspector provides the property representative with a copy of the ``Notification of Exigent and Fire Safety Hazards Observed'' form. Each exigent health and safety (EHS) deficiency that the inspector observed that day is listed on the form. The property representative signs the form acknowledging receipt. PHAs are to correct EHS deficiencies (i.e., emergency work orders) within 24 hours. PHAs are to notify HUD, using the electronic format, within three business days of the date of inspection, which is the date the PHA was provided notice of these deficiencies, that the deficiencies were corrected within the prescribed time frames.
Notice of Submission of Proposed Information Collection to OMB Survey of Market Absorption of New Multifamily Units
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. This survey provides the data necessary to measure the rate at which different types of new rental apartments and new condominium apartments are absorbed, that is, taken off the market, usually by being rented or sold, over the course of the first twelve months following completion of a building. The data is collected at quarterly intervals until the twelve months expire or until the units in a building are completely absorbed. The survey also provides estimates of the characteristics of apartments being absorbed, and provides a basis for analyzing the degree to which apartment-building activity is meeting the present and future needs of the public. Data are collected under Title 12, U.S.C. Sec. 1701Z-1 and 2.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The Housing Discrimination Information Form (HUD-903.1) is necessary for the collection of pertinent information from persons or entities who wish to file housing discrimination complaints with HUD under the Fair Housing Act of 1968 (Act), as amended [42 U.S.C. 3601 et seq.]. The Housing Discrimination Information Form (``Form'') provides for uniformity and easy use by the person filing the complaint. The Form is used to collect information needed to contact aggrieved persons, and for verifying HUD's authority [``jurisdiction''] to investigate complaints under the Act. This information is subsequently used to notify persons or entities that have been accused of engaging in discriminatory housing practices [``respondents''], as required under 42 U.S.C. 3610(1)(B)(ii) of the Act, and under 24 CFR 103.202(a) of HUD's Regulation implementing the Act. The Form may be submitted to HUD by mail, electronically via the Internet, or presented in person to HUD's Office of Fair Housing and Equal Opportunity (FHEO). HUD/FHEO staff uses this information collection as a source of pertinent data for the Title Eight Automated Paperless Office Tracking System (``TEAPOTS''), HUD's automated Fair Housing Act complaint processing database. FHEO staff will use the information provided to contact aggrieved persons; to make initial assessments regarding HUD's authority (jurisdiction) to investigate allegations of unlawful housing discrimination; to formally notify any persons and entities who have been accused of violating the Act; and to prepare for conducting administrative complaint investigations.

Notice of Funding Availability (NOFA) for HUD's Fiscal Year 2010; Resident Opportunity and Self-Sufficiency (ROSS)-Service Coordinators Program; Extension of Application Due Date
On October 21, 2010, HUD posted on https://www.Grants.gov, its Notice of Funding Availability (NOFA) for the FY2010 Resident Opportunity and Self-Sufficiency (ROSS) Service Coordinators Program. The NOFA establishes an application due date of Monday, February 21, 2011, which inadvertently falls on the federal holiday of Washington's Birthday (commonly referred to as Presidents Day). To help ensure that applicants have sufficient time to submit their applications, are not deprived, this notice announces that HUD has posted an extension of the application due date on https://www.Grants.gov. The new deadline for submission of applications is Wednesday, February 23, 2011. Applicants do not need to download a new application or resubmit their applications as a result of this notice.

Privacy Act of 1974; Computer Matching Program Between the Department of Housing and Urban Development (HUD) and the Department of Health and Human Services (HHS): Matching Tenant Data in Assisted Housing Programs
Pursuant to the Computer Matching and Privacy Protection Act of 1988, as amended, HUD is providing notice of its intent to execute a new computer matching agreement with HHS for a recurring matching program with HUD's Office of Public and Indian Housing (PIH) and Office of Housing, involving comparisons of information provided by participants in any authorized HUD rental housing assistance program with the independent sources of income information available through the National Directory of New Hires (NDNH) maintained by HHS. Specifically, the HUD-HHS computer matching program will now include program participants of HUD's new Disaster Housing Assistance Program (DHAP), in addition to participants of previously authorized HUD rental housing assistance programs and conditions requiring HUD's annual Quality Control for Rental Assistance Subsidy Determinations (``QC'') study to provide a statistical measurement of subsidy error within HUD rental housing assistance programs. The most recent renewal of the current matching agreement expires on January 5, 2011.
