Prohibition of the Escrowing of Tax Credit Equity
This rule conforms HUD's Federal Housing Administration multifamily mortgage insurance regulations to a provision in Title VIII of the Housing and Economic Recovery Act of 2008 that prohibits a requirement that tax credit sales proceeds be placed into escrow, at the time of initial endorsement, for assurance of project completion and to pay the initial service charge, carrying charges, and legal and organizational expenses incident to the construction of the project. This rule does not prohibit HUD from requiring escrows of funds for other purposes, such as for working capital. The rule also makes other changes to reduce burdens on the use of tax credits.

Rules of Practice and Procedure
The Federal Housing Finance Agency (FHFA) solicits written comment on a proposed rule to implement the Housing and Economic Recovery Act of 2008 (HERA) amendments to the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (Safety and Soundness Act) and the Federal Home Loan Bank Act (Bank Act) pertaining to the civil enforcement powers of FHFA, and the Rules of Practice and Procedure for enforcement proceedings. The Safety and Soundness Act, as amended by sections 1151-1158 of HERA, authorizes FHFA to initiate enforcement proceedings against the Federal National Mortgage Association and the Federal Home Loan Mortgage Corporation (together, the Enterprises) and the Federal Home Loan Banks (the Banks) (collectively, the regulated entities), and entity-affiliated parties as defined in the Safety and Soundness Act. When final, the rule will replace the existing Rules of Practice and Procedure promulgated by the Office of Federal Housing Enterprise Oversight (OFHEO) and the Federal Housing Finance Board (Finance Board) formerly charged with overseeing the regulated entities. The proposed rule may provide FHFA personnel, the regulated entities, entity-affiliated parties, and other interested parties with the clear guidance necessary to prepare for and participate in the administrative enforcement action process to increase the efficiency and transparency of FHFA's administrative enforcement hearings.
Buy American Exceptions Under the American Recovery and Reinvestment Act of 2009
In accordance with the American Recovery and Reinvestment Act of 2009 (Pub. L. 111-05, approved February 17, 2009) (Recovery Act), and implementing guidance of the Office of Management and Budget (OMB), this notice advises that certain exceptions to the Buy American requirement of the Recovery Act have been determined applicable for work using Capital Fund Recovery Formula and Competition (CFRFC) grant funds. Specifically, an exception was granted to the Chicago Housing Authority for the purchase and installation of marmoleum and linoleum floor tiles, dishwashers that are compliant with the Americans with Disabilities Act (ADA-compliant dishwashers), Ground Fault Circuit Interrupter (GFCI) outlets and an Audio/Video entry and dwelling communications system at the Pomeroy Apartments.

Section 8(c)(1) of the United States Housing Act of 1937 (USHA) requires the Secretary to publish FMRs periodically, but not less than annually, adjusted to be effective on October 1 of each year. Today's notice proposes FMRs for FY 2011 to be used to determine payment standard amounts for the Housing Choice Voucher (HCV) program, to determine initial renewal rents for some expiring project-based Section 8 contracts, and to determine initial rents for Housing Assistance Payment (HAP) contracts in the Moderate Rehabilitation Single Room Occupancy program. Other programs may require use of FMRs for other purposes.

Approximately $79 million is made available through this NOFA, by the Consolidated Appropriations Act, 2010 (Pub. L. 111-117, approved December 16, 2009), to support the delivery of a wide variety of housing counseling services to homebuyers, homeowners, low- and moderate-income renters and the homeless. The primary objectives of the program are to improve financial literacy, expand homeownership opportunities, improve access to affordable housing, and preventing foreclosure.

Privacy Act of 1974; Notice of a New Privacy Act System of Records (SORN), Ginnie Mae Mortgage-Backed Securities Unclaimed Funds System
The Department proposes to establish a new Privacy Act SORN subject to the Privacy Act of 1974 (5 U.S.C. 552a), as amended, entitled Ginnie Mae Mortgage-Backed Security Unclaimed Funds System. The new record system will be used to track unclaimed security holder payments. Such unclaimed payments are owed to certificate holders of Ginnie Mae-guaranteed mortgage-backed securities who cannot be located by the Ginnie Mae servicer. Ginnie Mae tracks this information to ensure that security holders are paid properly.
Privacy Act of 1974; Notice of a New Privacy Act System of Records (SORN), Ginnie Mae Master Subservicer System
The Department proposes to establish a new Privacy Act SORN subject to the Privacy Act of 1974 (5 U.S.C. 552a), as amended. The Ginne Mae Master Subservicer System will be used to perform a wide range of loan servicing functions required to process transactions relating to the servicing of home and project loans on behalf of Ginnie Mae. These services include, but are not limited to, servicing current, delinquent and defaulted loans, both pooled and non-pooled, including foreclosure services, management and disposition of acquired properties (Real Estate Owned).
Notice of Availability: Notice of Fiscal Year (FY) 2009 Implementation of the Veterans Homelessness Prevention Demonstration Program
Through this notice, HUD announces the availability on its website of the funding criteria, policies and procedures for the administration of the statutorily authorized Preventing Homelessness Among the Nation's Veterans Demonstration Program, referred to as the Veterans Homelessness Prevention Demonstration Program (VHPD), in a limited number of U.S. communities. The Omnibus Appropriations Act for 2009 (Pub. L. 111-8, approved March 11, 2009), authorizes the VHPD and appropriates $10 million for HUD to conduct the demonstration. Consistent with this authority, HUD has coordinated with the Department of Veterans Affairs and the Department of Labor in selecting a limited number of urban and rural sites in which to carry out this demonstration. The purpose of the VHPD is to explore ways for the federal government to offer early intervention homelessness prevention, primarily to veterans returning from wars in Iraq and Afghanistan. It is anticipated that this demonstration program will provide an opportunity to understand the unique needs of this new cohort of veterans, and will support efforts to identify, reach and assist them to regain and maintain housing stability.
