The Federal Housing Finance Agency (FHFA) is issuing a final regulation to provide the procedures and guidelines under which it will implement the Privacy Act of 1974, as amended. The regulation provides the policies and procedures whereby individuals may obtain notification of whether an FHFA system of records contains information about the individual and, if so, how to access or amend a record under the Privacy Act. Upon adoption of this regulation the Privacy Act regulations of the Federal Housing Finance Board and the Office of Federal Housing Enterprise Oversight, will be removed.

On June 9, 2009, HUD published a notice in the Federal Register (74 FR 27340) to announce that a revised version of the Capital Fund Recovery Competition (CFRC) NOFA had been issued and posted to the HUD website. That brief notice stated that the deadline date for Category 4 (Creation of Energy Efficient, Green Communities) applications is July 29, 2009. In fact, the correct deadline date for Category 4 applications is July 21, 2009. The July 21, 2009 deadline date for Category 4 applications is correctly stated in the revised CFRC NOFA posted on HUD's Web site on June 3, 2009. While the requirements for submitting an application for this assistance are those provided in the CFRC NOFA, HUD is using today's Federal Register notice to avoid any confusion in its applicant community.
Protecting Tenants at Foreclosure: Notice of Responsibilities Placed on Immediate Successors in Interest Pursuant to Foreclosure of Residential Property

Through this notice, HUD seeks to ensure that individuals or entities that participate in HUD programs or with whom HUD interacts through its programs are aware of obligations imposed on immediate successors of interest in any residential property pursuant to a foreclosure to provide tenants residing in such property, including but not limited to tenants with Section 8 rental assistance, with at least 90 days' advance notice of the need to vacate the property, where the successor desires to have the tenants vacate. In addition, except for purchasers who will occupy the property as the primary residence, successors take their interest subject to the remaining term of any bona fide lease. These obligations are broadly imposed on immediate successors in interest by the Helping Families Save Their Homes Act of 2009. While HUD is directing this notice to entities and individuals that participate in HUD programs or with whom HUD interacts in its HUD programs (for example, approved mortgagees, approved nonprofit organizations, housing counseling agencies, and public housing agencies), these obligations are not limited to FHA-insured or HUD- assisted housing. The responsibility for meeting the new tenant protection requirements applies to all successors in interest of residential property, regardless of whether a Federally related mortgage is present. The immediate successors in interest of a residential property, which is being foreclosed, bear direct responsibility for meeting the requirements of the law. These protections are self-executing, and became effective May 20, 2009.

The Omnibus Appropriations Act, 2009 (Pub. L. 111-8) makes available $30 million for incremental Section 8 Housing Choice Vouchers (HCV) for non-elderly disabled families served by entities (which this NOFA will limit to public housing agencies (PHAs)) with demonstrated experience and resources for supportive services). This money should fund approximately 4,000 HCVs. On May 7, 2009, HUD posted on its Web site its Notice of Funding Availability (NOFA) for competitive grants for the Neighborhood Stabilization Program 2 (NSP2), authorized under the American Recovery and Reinvestment Act of 2009 (Recovery Act) (Pub. L. 111-5, approved February 17, 2009). The purpose of the NSP2 program is to stabilize neighborhoods whose viability has been and continues to be damaged by the economic effects of properties that have been foreclosed upon and abandoned. Today's Federal Register publication announces that HUD has posted a notice correcting the NSP2 NOFA on its Web site. Specifically, the notice corrects the NSP2 NOFA to, among other things, permit NSP2 applicants to use a combined index score to determine whether they meet the geographic targeting threshold requirement, correct section (C) of the eligible activities table, and rescind the aggregate 5 percent purchase discount while leaving the 1 percent discount on individual purchases intact. The Federal Housing Finance Agency (FHFA) is issuing a proposed regulation that would require the Federal National Mortgage Association, the Federal Home Loan Mortgage Corporation, the Federal Home Loan Banks (regulated entities) to report to FHFA any fraudulent financial instruments that they purchased or sold. The proposed regulation would also require the regulated entities to establish and maintain internal controls, procedures, and training programs to ensure that any such fraudulent instruments are detected and reported.

Today's Federal Register publication announces that HUD has posted on its Web site a revised NOFA that corrects Appendix A of the NOFA and extends the deadline for submitting waiver requests to reduce the statutory match. Specifically, HUD inadvertently omitted a number of jurisdictions that are eligible for the FY2009 Lead Hazard Reduction Demonstration Grant Program from part A of Appendix A, entitled ``Cities, Towns, Counties, and States Having at Least One Place or County with 3,500 or More Occupied Rental Housing Units Built Before 1940, and Eligible States and Tribes.'' The revised Appendix A is available at http://www.hud.gov/offices/lead/09NOFA/leadcombo.cfm. In addition, in order to provide equal opportunity to all eligible applicants, the deadline for submitting waiver requests to reduce the statutory match amount from 25% to 10% is being extended from June 10, 2009 to June 23, 2009. The period for HUD to review the requests is extended from June 22, 2009 to June 30, 2009. The deadline for receipt of the applications in HUD headquarters remains 5:00 PM eastern time July 20, 2009.

The corrections, changes, and clarifications to the NOFA include, among other items, the following: adding threshold funding caps in Categories 1, 2 and 3 for public housing agencies (PHAs) designated as High Performers; adding a rating factor on High Performer status to Category 4; amending the Capacity threshold requirement relating to the Capital Fund; clarifying the threshold requirement of Category 2, Public Housing Transformation, that deals with the census tract and the concentration of poverty; adding definitions of leverage and match and adding tie-breaking criteria based on leverage and match; amending the leverage ratio criteria in Category 1 required for Round 1 consideration; amending the Category 3 threshold requirement to require that any demolition and/or disposition applications had to be submitted to HUD no later than the date of the publication of the revised NOFA; and clarifying certain other Category 4 rating factors and funding limits. Please see the revised NOFA document for all the corrections, changes, and clarifications made. To permit applicants time to prepare applications that take into account these and other changes incorporated in the revised NOFA, HUD is revising the application deadline dates for each funding category: For Threshold-Based applications (Categories 1, 2 and 3), the Department will assign the first Ordinal on July 6, 2009; but will begin accepting applications on June 22, 2009. For Rated and Ranked applications (Category 4), the deadline date for applications is July 29, 2009, but HUD will begin accepting applications on June 22, 2009.
