Pursuant to the Computer Matching and Privacy Protection Act of 1988, as amended, and the Office of Management and Budget's (OMB) Guidance on the statute, HUD is announcing a new matching program involving comparisons between income data provided by applicants or participants in HUD's assisted housing programs and applicants for FEMA disaster assistance. The matching program will be carried out to detect inappropriate (excessive or insufficient) housing assistance under the National Housing Act, the United States Housing Act of 1937, section 101 of the Housing and Community Development Act of 1965, the Native American Housing Assistance and Self-Determination Act of 1996, and the Quality Housing and Work Responsibility Act of 1998. The matching program will be accomplished by comparing income, family size, family address, family identity, and benefit data for individuals participating in HUD's assisted housing programs and subsidized multifamily housing programs with disaster emergency assistance data maintained by FEMA in its systems of records known as Disaster Assistance Recovery Files (FEMA/REG-2), last published at 69 FR 65615 (November 15, 2004). Specifically, HUD will compare the FEMA identity, income, family size, and benefit data to tenant-reported data included in HUD's system of records known as: (1) the Tenant Housing Assistance and Contract Verification Data (HUD/H-11), last published at 62 FR 11909 (March 13, 1997); and (2) the Public and Indian Housing Information Center (HUD/PIH-4), last published at 67 FR 20986 (April 29, 2002). The tenant comparisons will identify, based on criteria established by HUD, tenants whose incomes, family size, address, or benefit levels, etc. that require further verification to determine if the tenants received appropriate levels of rental assistance. The program also provides for the verification of the matching results and the initiation of appropriate administrative or legal actions.

The Department of Housing and Urban Development (HUD) proposes to establish two new record systems to add to its inventory of systems of records subject to the Privacy Act of 1974 (5 U.S.C. 552a), as amended. The proposed new systems of records are: Debt Collection and Asset Management System (DCAMS) and Title I Insurance System (TIIS). The primary purpose of DCAMS is to collect and maintain data needed to support activities related to the collection and servicing of various HUD/FHA debts. It contains information on individuals who have debts resulting from default on HUD/FHA insured Title I loans and from other HUD/FHA loan programs. The Title I Insurance System is used to collect and maintain the data necessary to support activities related to the servicing of loans insured under the Title I program. It contains information on individuals who have made loans insured under HUD's Title I program.

This final rule makes conforming revisions to the regulations under the single family mortgage insurance program with respect to the payment of interest at the debenture rate for mortgage insurance claims. The revisions implement a recent statutory amendment to the National Housing Act that provides for a mandatory change in the calculation of all debenture interest on mortgage insurance claims paid in cash. The statutory change mandates that, when paying insurance claims in cash, debenture interest rates for such claims must be the monthly average yield, for the month in which the default on the mortgage occurred, on United States Treasury Securities adjusted to a constant maturity of 10 years.

Pursuant to the provisions of the Privacy Act of 1974 (5 U.S.C. 552a), as amended, the Department of Housing and Urban Development HUD is giving notice that it proposes to establish five new systems of records entitled: Transit Subsidy Program, HUD's Direct Distribution Center System, One Touch Student Response System, Training Information System (TRAI), and the Training Announcement, Nomination and Confirmation System (TANCS). The purpose of each of the systems of records is as follows: Records from the Transit Subsidy System are to be used to determine and verify the transit subsidy entitlement for each HUD employee. Information from HUD's Direct Distribution Center System is used to track undelivered or returned mail. This system contains the name, address, home and office telephone number of all HUD clients and staff requesting general publication information. Records from the One Touch Student Response System are used to track training information and test results of HUD employees enrolled in training courses. The Training Information System (TRAI) contains the name, address, office telephone number, and social security number of all HUD employees enrolled and approved for training courses. An annual summary of employees' training courses is produced from these records. Also, the cost of training courses is collected for budgetary and planning purposes. The names of all HUD employees selected for training, social security number, and training course title are contained in the Training Announcement, Nomination, and Confirmation System (TANCS). Records from the system are used to monitor internal opportunities for HUD staff.

Section 8(c)(1) of the United States Housing Act of 1937 (USHA) requires the Secretary to publish FMRs periodically, but not less than annually, adjusted to be effective on October 1 of each year. Today's notice proposes FMRs for FY2007. The proposed numbers would amend FMR schedules used to determine payment standard amounts for the Housing Choice Voucher program, to determine initial renewal rents for some expiring project-based Section 8 contracts, and to determine initial rents for housing assistance payment (HAP) contracts in the Moderate Rehabilitation Single Room Occupancy program. Other programs may require use of FMRs for other purposes. The proposed FY2007 FMRs continue to use the revised Office of Management and Budget (OMB) area definitions that were issued in 2003 and were used in establishing FY2006 FMR areas and FMRs. They also continue to use the same calculation methodology. They differ, however, in that a limited number of additional modifications to the county- based statistical areas as defined by OMB have been made in response to public comments received on the December 16, 2005, Federal Register notice on the proposed FY2006 income limit calculation methodology. In the FY2006 FMRs, HUD disaggregated OMB-defined areas when the FMRs of their components as defined by FY2005 FMR areas differed by more than 5 percent to better reflect housing market relationships. Most FY2006 FMR areas consisting of multiple FY2005 FMR areas after the 5 percent test was applied to rents had similar income limits among the component parts. A few such areas would have substantial declines in income limits for some of their component parts under the FY2006 FMR area definitions. Income limit decreases are disruptive to certain HUD and other Federal housing subsidy programs. Income limit areas generally have the same boundaries as FMR areas. In order to minimize large changes in income limits in these combined areas with similar rents but differing income levels, HUD is proposing for FY2007 FMRs to form FMR sub-areas within OMB-defined metropolitan areas in all cases where sub-area median family incomes differ from OMB-defined area median family incomes by more than 5 percent. The FMR estimates have been trended to April 2007, the mid- point of FY2007.

On January 20, 2006, HUD published its Fiscal Year FY2006, Notice of Funding Availability Policy Requirements and General Section (General Section) to the SuperNOFA for HUD's Discretionary Programs. On March 8, 2006, HUD published its FY2006, SuperNOFA, for HUD's Discretionary Grant Programs. This notice announces that HUD has extended the submission deadline date for the Community Development- Technical Assistance Program, Fair Housing Initiatives Program, Housing Choice Voucher-Family Self-Sufficiency Program, and Rural Housing and Economic Development Program NOFAs that were part of the FY2006 SuperNOFA. Specifically, this notice extends the submission deadline dates for only those applicants located in areas designated by the President as disaster areas, as the result of severe storms and flooding that began on May 12, 2006 and adversely affected areas of the State of Maine, Commonwealth of Massachusetts and State of New Hampshire. The areas included in the President's Emergency Declaration and covered by this Notice are the Maine county of York; the Massachusetts counties of Essex, Middlesex and Suffolk; and the New Hampshire counties of Belknap, Carroll, Hillsborough, Merrimack, Rockingham and Strafford. For those applicants located in one of these counties, the revised deadline date is June 27, 2006 at 11:59:59 p.m. eastern time. All electronic applications are available at https:// www.Grants.gov and must be received and validated by Grants.gov by the deadline date and time. As provided by the General Section, applicants wishing to submit a hard copy application must obtain a waiver from HUD. Manufactured Housing Consensus Committee-Rejection of Subpart I Proposal

The Manufactured Housing Consensus Committee (MHCC) has submitted to HUD recommended regulatory text that would revise HUD's current Subpart I regulations that implement statutory requirements concerning how manufacturers and others address reports of problems with manufactured homes, including notifications to consumers and correction of safety defects and of homes that fail to meet the Federal construction and safety standards. The National Manufactured Housing Construction and Safety Standards Act of 1974 expressly limits HUD to either accepting such an MHCC recommendation in its entirety for publication as a proposed rule, or rejecting the recommendation, providing the MHCC a written explanation of the reasons for rejection, and publishing in the Federal Register the rejected proposal, the reasons for rejection, and any recommended modifications. The Secretary commends the careful work of the MHCC on this initiative and would accept almost all of the MHCC's recommendation. HUD has met with the MHCC numerous times on these regulations, and the Department and the MHCC have worked together to draft a clear and comprehensive revision of these regulations. However, because HUD believes that certain language included in the MHCC recommendation is contrary to the statute, HUD cannot accept the proposal. Nevertheless, in accordance with a different statutory procedure that is available, and in an effort to resolve the remaining differences between what HUD could accept and what was included in the MHCC recommendation, HUD has also submitted to the MHCC for its review a HUD proposal for revision of subpart I that is based on the MHCC recommendation, with a few modifications as discussed in this notice. As required by the statute, the full text of the MHCC's recommendation is set forth in this notice for informational purposes, along with HUD's reasons for not accepting all of the recommendations and an explanation of the modifications HUD has suggested to the MHCC. A set of principles that the MHCC drafted to guide its development of its recommendation is also set out in this notice. In accordance with statutory procedure, after HUD has received the MHCC's comments on HUD's proposal to revise Subpart I and HUD has considered those comments, HUD expects to publish separately a proposed rule revising Subpart I for public comment.
Manufactured Home Installation Program

This proposed rule would establish a federal manufactured home installation program. HUD is required to establish such a program in accordance with the National Manufactured Housing Construction and Safety Standards Act of 1974, as amended by the Manufactured Housing Improvement Act of 2000. States that have their own installation programs that include the elements required by statute are permitted to administer under their state installation programs, the new requirements that would be established through this proposed and final rulemaking. The new elements required by statute to be integrated into an acceptable manufactured home installation program are: Establishment of qualified installation standards; licensing and training of installers; and inspection of the installation of manufactured homes.

This statement of policy advises the public that HUD does not view two recent fair housing federal court decisions as in any way affecting the authority of state and local agencies to enforce their own fair housing laws that HUD has certified as substantially equivalent to the federal Fair Housing Act. State and local fair housing enforcement agencies administering substantially equivalent fair housing laws have the authority to enforce those statutes and ordinances against any respondent, including a national bank, within their jurisdictions. This is not a new policy. This statement of policy clarifies existing regulations at 24 CFR 115.202.

This final rule amends HUD's regulations that address the predatory practice of property ``flipping'' and establishes certain time restrictions regarding the sale of properties whose purchase is being financed with Federal Housing Administration (FHA) mortgage insurance. The final rule broadens the exceptions to the time restrictions on sales to include government-sponsored enterprises (GSEs), state- and federally chartered financial institutions, nonprofits organizations approved to purchase HUD Real Estate-Owned (REO) single-family properties at a discount with resale restrictions, local and state governments and their instrumentalities, and, upon announcement by HUD through issuance of a notice, sales of properties in areas designated by the President as Federal disaster areas. This final rule follows publication of a December 23, 2004, interim rule, and takes into consideration the public comments received on the interim rule.

HUD is proposing changes to its regulations governing Fannie Mae and Freddie Mac (collectively, the government sponsored enterprises or GSEs) to reinforce the efforts of HUD and the GSEs to prevent predatory lending practices. The changes proposed by this rule would allow HUD to keep up-to-date with and combat new predatory lending practices as they are discovered and, therefore, strengthen HUD's oversight role in monitoring GSE practices to ensure that the loans the GSEs purchase are not contrary to responsible lending practices.

HUD gives notice to the public, agencies, and Indian tribes that the City of Bremerton, WA, intends to prepare an Environmental Impact Statement (EIS) for the redevelopment of Westpark public housing community located in Bremerton, WA. The City of Bremerton, as the Responsible Entity for compliance with the National Environmental Policy Act (NEPA) in accordance with 24 CFR 58.4, and the Bremerton Housing Authority (BHA), as lead agency for compliance with the Washington State Environmental Policy Act (SEPA, RCW 43.21C) will perform the joint environmental review. This notice is in accordance with regulations of the Council on Environmental Quality at 40 CFR parts 1500-1508. This notice solicits comments on HUD's Accelerated Claim and Asset Disposition (ACD) program before HUD proceeds to issue a proposed rule that will commence the rulemaking process that will result in codification of the requirements for the ACD program, thus making the ACD program a permanent part of HUD's single family mortgage insurance programs. Under the ACD program, HUD will pay claims upon assignment of certain defaulted mortgage loans (``assets'') insured by the Federal Housing Administration (FHA). The purpose of the ACD program is to help FHA maximize the recovery on assets sold by HUD. HUD seeks comments on the ACD Demonstration program, including recommendations of cost- effective, efficient improvements and alternatives that should be made part of the permanent program.
