This final rule establishes the basis and procedures for removing real estate brokers from HUD's qualified selling broker list and for prohibiting removed brokers from using HUD's systems to participate in the sale of HUD-owned, single family properties. This rule is similar to existing removal rules for Federal Housing Administration (FHA) appraisers, consultants, and nonprofit organizations, and provides HUD a more expeditious disciplinary procedure for real estate brokers than the suspension and debarment procedures that would otherwise be applicable. This final rule follows publication of a September 17, 2004, proposed rule, and takes into consideration the public comments received on the proposed rule.

Prior to acquisition, the mortgagee/loan servicer must provide a notice of acquisition and form HUD-9539 to any occupant of the property. The occupants may submit the form, which provides information on occupation, income, and obligations to HUD requesting to remain in the property. HUD uses the information to determine whether the occupant qualifies, to maintain rental accounts, and to facilitate collection of overdue rents. HUD may provide pertinent information to a local real estate broker who manages the property. Occupants who are accepted must execute a month-to-month lease.

The purpose of this notice is to provide instructions and advice to potential applicants applying for funding under HUD's competitive grant programs that are available through Grants.gov. This notice provides information to help applicants better understand the electronic submission process. To facilitate the Fiscal Year (FY) 2007 federal grant application process, prospective applicants for HUD funding should immediately begin the registration process or renew their registration from prior years. HUD believes that by facilitating a better understanding of the electronic submission process, applicants will be able to more easily make the transition to electronic application submission. Grants.gov is the Federal portal for applicants to electronically find and apply for over 1,000 funding opportunities made available by the twenty-six federal grant-making agencies. Grants.gov offers the applicant community a common Web site where applicants can use one password and ID to apply for a variety of federal assistance programs. To date, all 26 Federal grant-making agencies have posted their funding opportunities and electronic application packages to Grants.gov. To apply on-line electronically, Grants.gov requires an electronically authorized signature, known as eAuthentication. This requirement for an authenticated electronic signature serves to protect the applicant and the applicant's information, and to assure federal agencies that they are interacting with officials authorized to submit applications on behalf of applicant entities. Through this notice, HUD is encouraging applicants to complete or update their registration, in advance of HUD posting its FY2007 grant opportunities. HUD found that issuing an Early Registration Notice in FY2006 eliminated many of the registration issues that applicants faced in FY2005, the first year that HUD used Grants.gov for posting its annual SuperNOFA. HUD believes that by issuing this notice in advance of the FY2007 funding cycle, applicants will have sufficient time to carefully review registration and submission requirements and to have their questions addressed regarding the registration and submission processes. HUD anticipates that it will post its funding opportunities in late 2006 or early 2007. HUD strongly encourages prospective applicants for FY2007 HUD grants to register or renew their registration for application submission via Grants.gov as soon as possible by following the instructions in this notice.

On July 28, 2006, HUD published a notice entitled, ``Implementation Guidance for Section 901 of the Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006.'' This notice extends the period for eligible public housing agencies (PHAs) located within the most heavily impacted areas of Louisiana and Mississippi that are subject to a declaration by the President of a major disaster under the Robert T. Stafford Disaster Relief and Emergency Assistance Act in connection with Hurricanes Katrina or Rita to submit Notices of Intent and Fungibility Plans in accordance with the July 28, 2006, notice. Section 901 of the supplemental appropriations act authorizes PHAs to combine assistance provided under sections 9(d) and (e) of the United States Housing Act of 1937 (Act) and assistance provided under section 8(o) of the Act, for the purpose of facilitating the prompt, flexible, and efficient use of funds provided under these sections of the Act to assist families who were receiving housing assistance under the Act immediately prior to Hurricane Katrina or Rita and were displaced from their housing by the hurricanes. In addition to extending the PHA submission deadline, this notice removes the restriction that the combined funding may not be spent for uses under the housing choice voucher (HCV) program. If approved by HUD, the combined funding may now be used for eligible purposes under the HCV program. Any use of combined funds under the HCV program must also be in accordance with the requirement to assist those families who were receiving housing assistance under the public housing or HCV program immediately prior to Hurricane Katrina or Rita and were displaced from their housing by the hurricane. A PHA that already has an approved Fungibility Plan may request HUD approval to change the Plan in order to use the combined funds for HCV program eligible purposes. As provided in the July 28, 2006 Federal Register notice, PHAs must submit to HUD requests for approval of any substantial deviations from the approved Fungibility Plan, and HUD will respond to such requests within 10 calendar days.

The Office of Federal Housing Enterprise Oversight (OFHEO) is issuing a final regulation that sets forth record retention requirements with respect to the record management programs of the Federal National Mortgage Association and the Federal Home Loan Mortgage Corporation consistent with the safety and soundness responsibilities of OFHEO under the Federal Housing Enterprises Financial Safety and Soundness Act of 1992.

The National Manufactured Home Construction and Safety Standards Act authorized HUD to promulgate and enforce reporting standards for the production of manufactured housing. HUD uses these information collections to calculate and collect monitoring inspection fees for manufactured housing.

The data are collected from manufactured home dealers. The principal user, HUD, used the statistics to monitor trends in this type of low-cost housing; to formulate policy, draft legislation, and evaluate programs.

This interim rule provides authority for Indian tribes to receive a minimum grant amount under the need component of the Indian Housing Block Grant (IHBG) Formula for Fiscal Year (FY) 2007. The minimum funding provision currently in effect in HUD's regulations limited authority for receipt of a minimum grant amount to FY2006. HUD and Indian tribes, through negotiated rulemaking procedures, developed and published a proposed rule to address ways to improve and clarify the IHBG Formula regulations, including the minimum funding provisions. The reinstatement of the authority for minimum grant amounts in FY2007 will avoid hardship to the affected tribes until the revised minimum funding provisions contained in the negotiated rule are issued as a final rule and become effective.

In accordance with section 102(a)(4)(C) of the Department of Housing and Urban Development Reform Act of 1989, this announcement notifies the public of funding decisions made by the Department in competitions for funding under the Office of Healthy Homes and Lead Hazard Control Grant Programs Notices of Funding Availability (NOFA). This announcement contains the name and address of the award recipients and the amounts to be awarded.

Public Housing Agencies (PHAs) apply to HUD for approval to implement homeownership programs to make public housing dwelling units, public housing developments, and other housing units available for purchase by low-income families as their principal residence. PHAs approved to administer homeownership programs must report annually to HUD on progress made in program implementation. Interested families are required to submit applications to PHAs for approval to purchase subject dwellings.

The Department is soliciting public comments on the subject proposal. HUD is required to collect debt owed to the agency. As part of the collection process, demand for repayment is made on the debtor(s) in response, debtors opt to ignore the debt, pay the debt or dispute the debt. Disputes and offers to repay the debt result in information collections. Borrowers who wish to pay less than the full amount due must submit a Personal Financial Statement and Settlement Offer. HUD uses the information to analyze debtors' financial positions and then approve settlements, repayment agreements, and preauthorized electronic payments to HUD. Borrowers who wish to dispute must provide information to support their positions.

In this notice, the Assistant Secretary for Administration designates the Order of Succession for the Office of Administration. This Order of Succession supersedes the Order of Succession for the Assistant Secretary for Administration published on June 23, 2003. Effective Date: June 14, 2006.
