The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. This request is for the clearance of a survey instrument that would gauge current consumer perceptions of factory-built housing technologies with as primary focus on panelized and modular housing. One of the strategic goals outlined in HUD's Partnership for Advancing Technology in Housing is the increased focus on attitudes, behaviors, and motives surrounding innovation. Measuring consumer perceptions of factory-build housing provides such insight, and will also provide otherwise unavailable information essential to measuring the effectiveness of PATH's outreach and promotional campaigns.

Privacy Act of 1974; Notice of a Computer Matching Program
In accordance with the Privacy Act of 1974 (5 U.S.C. 552a), as amended by the Computer Matching and Privacy Protection Act of 1988 (Pub. L. 100-503), and the Office of Management and Budget (OMB) Guidelines on the Conduct of Matching Programs (54 FR 25818; June 19, 1989); and OMB Bulletin 89-22, ``Instructions on Reporting Computer Matching Programs to the Office of Management and Budget (OMB), Congress and the Public,'' HUD is issuing a public notice of its intent to conduct a recurring computer matching program with the VA to utilize a computer information system of HUD, the Credit Alert Interactive Verification and Reporting System (CAIVRS), with VA's debtor files. This match will allow prescreening of applicants for loans issued by or guaranteed by the Federal government to ascertain if the applicant is delinquent in paying a debt owed to or insured by the Federal government for HUD or VA direct or guaranteed loans. Before granting a loan, the lending agency and/or the authorized lending institution will be able to interrogate the CAIVRS debtor file and verify that the loan applicant is not in default on a Federal judgment or delinquent on direct or guaranteed loans of participating Federal agencies. The CAIVRS database contains delinquent debt information from the Departments of Agriculture, Education, Veteran Affairs, the Small Business Administration, and judgment lien data from the Department of Justice. Authorized users do a prescreening of CAIVRS to determine a loan applicant's credit status with the Federal government. As a result of the information produced by this match, the authorized users may not deny, terminate, or make a final decision on any loan assistance to an applicant or take other adverse action against such applicant, until an officer or employee of such agency has independently verified such information.
Revisions to the Public Housing Operating Fund Program; Correction to Formula Implementation Date
This document corrects HUD's final rule published on September 19, 2005, that implements revisions to the public housing Operating Fund Program. The final rule includes dates from the proposed rule that assumed both an initial implementation of the revised formula in fiscal year (FY) 2006 and a one-year period for PHAs to transition to the new formula. In converting the rule from a proposed to final rule, HUD unintentionally failed to revise certain dates to reflect the updated schedule for implementation of the revised formula. Accordingly, the September 19, 2005, final rule inadvertently denies PHAs the one-year transition period. This document corrects the September 19, 2005, final rule to provide that the revised allocation formula will be implemented for calendar year 2007, and adjusts the related dates specified in the rule to reflect the corrected implementation date.

Notice of Intent To Prepare a Draft Environmental Impact Statement for Development of Cedar Grove Housing in Tahoe Vista, Placer County, CA
HUD gives notice to the public, agencies, and Indian tribes that Placer County, CA, intends to prepare an Environmental Impact Statement (EIS)/Environmental Impact Report (EIR) (EIS/EIR) for development of Cedar Grove Housing located in Tahoe Vista, Placer County, CA. Placer County, acting as the lead agency, will prepare the EIS/EIR acting under its authority as the responsible entity for compliance with the National Environmental Policy Act (NEPA) in accordance with 42 U.S.C. 5304(g) and HUD regulations at 24 CFR 58.4, and under its authority as lead agency in accordance with the California Environmental Quality Act (CEQA). The EIS/EIR will be a joint document under NEPA, CEQA and the Tahoe Regional Planning Agency (TRPA) Code of Ordinances. The EIS will satisfy the requirements of NEPA and the TRPA Code of Ordinances. The EIR will satisfy requirements of the CEQA (Public Resources Code 21000 et seq.) and State CEQA Guidelines (14 California Code of Regulations 15000 et seq.), which require that all State and local government agencies consider the environmental consequences of projects over which they have discretionary authority before acting on those projects. The proposed action is subject to compliance with NEPA, because Federal Community Development Block Grant (i.e., CDBG) funds and possible other HUD housing program funds (discussed below) would be used for the development of affordable housing. This notice is given in accordance with the Council on Environmental Quality regulations at 40 CFR parts 1500-1508. All interested Federal, State, and local agencies, Indian tribes, groups, and the public are invited to comment on the scope of the EIS. If you are an agency with jurisdiction by law over natural or other public resources affected by the project, Placer County needs to know what environmental information germane to your statutory responsibilities should be included in the EIS/EIR.

Manufactured Housing Dispute Resolution Program
This proposed rule would establish a federal manufactured housing dispute resolution program and guidelines for the creation of state-administered dispute resolution programs. Under the National Manufactured Housing Construction and Safety Standards Act of 1974, as amended by the Manufactured Housing Improvement Act of 2000, HUD is required to establish a program for the timely resolution of disputes among manufacturers, retailers, and installers of manufactured homes regarding responsibility, and the issuance of appropriate orders, for the correction or repair of defects in manufactured homes that are reported during the one-year period beginning on the date of installation.

Organization and Functions
The Office of Federal Housing Enterprise Oversight (OFHEO) is revising the regulation that describes its organization and functions. The revisions reflect changes in OFHEO's organizational structure and the functional responsibilities of some of its offices.
Project-Based Voucher Program
This rule replaces the current project-based certificate (PBC) regulations with a comprehensive new project-based voucher program. This rule is based on statutory authorities enacted in 1998 and 2000, and follows a proposed rule and public comment.
Notice of Submission of Proposed Information Collection to OMB; Multifamily Financial Management Template
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The Uniform Financial Reporting Standards (UFRS) regulation requires HUD's multifamily housing program participants to submit financial data electronically, using generally accepted accounting principles, in a prescribed format. Electronic submissions of this data require use of a template. HUD uses this information to monitor the owners' compliance with regulatory requirements and to assess fiscal performance.
Notice of HUD's Fiscal Year (FY) 2005 Notice of Funding Availability (NOFA) Policy Requirements and General Section to SuperNOFA for HUD's Discretionary Grant Programs (SuperNOFA); Youthbuild Program, Notice of Extension of Application Submission Date for Areas in South Florida Affected by Hurricane Katrina
This notice announces the extension of submission deadline dates for one program announced in the Fiscal Year 2005 SuperNOFA, the Youthbuild NOFA, for those applicants located within four counties of south Florida that were significantly affected by the initial impact of Hurricane Katrina, including the counties of Broward, Collier, Miami- Dade, and Monroe. The submission deadline for this funding opportunity was August 25, 2005, the same day that Hurricane Katrina affected south Florida. For those applicants located in one of these four counties, the revised submission date is October 17, 2005. For applicants not in one of these four counties in south Florida, the submission deadline remains unchanged.

HUD's Draft Section 504 Self-Evaluation Report on HUD-Conducted Programs and Activities; Reopening of Comment Period
On June 22, 2005, HUD published a notice in the Federal Register soliciting comments on its draft section 504 self-evaluation report of HUD-conducted programs, activities, and regional office facilities. The draft report was prepared consistent with HUD's responsibilities under section 504 of the Rehabilitation Act of 1973, as amended, and under HUD's implementing regulations. The public comment period closed on July 22, 2005. HUD has received numerous requests to re-open the period for public comment. This notice announces the reopening of the public comment period on the section 504 draft self-evaluation report.

Notice of Submission of Proposed Information Collection to OMB; Builder's Certification/Guarantee and New Construction Subterranean Termite Soil Treatment Record
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. Builders must certify HUD insured structures to be free of termite hazards. Authorized pest control companies must perform treatments for termites. The builder guarantees the treated area against infestation for one year. A reassessment of the burden has led to the determination that the information collected is a standard and usual business practice. The collection of this information is an industry wide standard; not solely an FHA requirement.

HUD gives notice to the public, agencies, and Indian tribes that the City of Redding, CA, has prepared a Supplement to the Draft Environmental Impact Statement (SDEIS)/ Environmental Impact Report (EIR) for the Stillwater Business Park project located in Redding, CA. The comment period on the DEIS closed in early May 2005. The City of Redding, CA has prepared the Supplement to the Draft EIS/EIR under its authority as the responsible entity for compliance with the National Environmental Policy Act (NEPA) in accordance with 42 U.S.C. 3547(c) and HUD regulations at 24 CFR 58.4 and under its authority as lead agency in accordance with the California Environmental Quality Act (CEQA). The Supplement to the Draft EIS/EIR is a joint NEPA and CEQA document. The EIR will satisfy requirements of the CEQA (Public Resources Code 21000 et seq.) and state CEQA Guidelines (14 California Code of Regulations 15000 et seq.) that require all state and local government agencies to consider the environmental consequences of projects over which they have discretionary authority before acting on those projects. Because HUD Economic Development Initiative (EDI) special project funds would be used, the proposed action is also subject to NEPA. EPA, State and Tribal Assistance Grants (STAG) will also fund water and wastewater related infrastructure. EPA is acting as a cooperating agency for this process. This notice is given in accordance with the Council on Environmental Quality regulations at 40 CFR parts 1500-1508. All interested Federal, State, and local agencies, Indian tribes, groups, and the public are invited to comment on the supplement to the draft EIS.
Notice of Submission of Proposed Information Collection to OMB; Multifamily Project Applications and Construction Prior to Initial Endorsement
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. Information provided is the application for HUD/FHA multifamily mortgage insurance. The information from sponsors and general contractors, and submitted by a HUD-approved mortgage, is needed to determine project feasibility, mortgagor/contractor acceptability, and construction cost. Documentation from operators/manager of health care facilities is also Required as part of the application for firm commitment or mortgage insurance. Project owners/sponsors may apply for permission to commence construction prior to initial endorsement.
Regulatory and Administrative Waivers Granted for Public and Indian Housing Programs to Assist with Recovery and Relief in Hurricane Katrina Disaster Areas
This notice advises the public of HUD regulations and other administrative requirements governing HUD's Office of Public and Indian Housing (PIH) programs that have been waived in order to facilitate the delivery of safe and decent housing under these programs to families and individuals who have been displaced from their housing by Hurricane Katrina. Entities that administer PIH programs, which include public housing agencies (PHAs), Indian and tribally designated housing entities (TDHEs), and local and tribal governments, and are located in an area declared by the President to be a federal disaster area as a result of Hurricane Katrina, may defer compliance with the regulations and other requirements listed in this notice for an initial period of 12 months or such other period as may be specified in this notice. PIH program administrators that are not located in a disaster area but assisting with Hurricane Katrina recovery and relief may request waiver of the regulations and administrative requirements listed in this notice, and HUD review and response is available through an expedited waiver request and response process. PIH program administrators, located in an area declared a federal disaster area as a result of Hurricane Katrina, or PIH program administrators not located in such an area but assisting with Hurricane Katrina relief and recovery efforts, may request waiver of a regulation or other administrative requirement through the expedited waiver process provided in this notice. This notice applies only to PIH programs or to cross-cutting regulatory or administrative requirements that are applicable to PIH program administrators.

Notice of HUD's Fiscal Year (FY) 2005 Notice of Funding Availability Policy Requirements and General Section to SuperNOFA for HUD's Discretionary Grant Programs; Housing Opportunities for Persons With AIDS (HOPWA); Second Competition-Extension of Application Deadline
On August 22, 2005, HUD published its NOFA for the Housing Opportunity for Persons With AIDS Program, second competition for Fiscal Year 2005. Because of the effects of Hurricane Katrina, HUD is extending the application deadline for this NOFA.
Final Fair Market Rents for the Housing Choice Voucher Program and Moderate Rehabilitation Single Room Occupancy Program for Fiscal Year 2006
Section 8(c)(1) of the United States Housing Act of 1937 (USHA) requires the Secretary to publish FMRs periodically, but not less than annually, adjusted to be effective on October 1 of each year. The primary uses of FMRs are to determine payment standard amounts for the Housing Choice Voucher program, to determine initial renewal rents for some expiring project-based Section 8 contracts, to determine initial rents for housing assistance payment (HAP) contracts in the Moderate Rehabilitation Single Room Occupancy program, and to serve as a rent ceiling in the HOME rental assistance program. Today's notice provides final FY2006 FMRs for all areas that reflect the estimated 40th and 50th percentile rent levels trended to April 1, 2006. Today's notice, however, does not include final determinations on 50th percentile rent levels, as proposed in HUD's notice published on August 25, 2005. The 30-day public comment period on that notice ended September 26, 2005, and HUD is evaluating the public comments. A notice that provides final determinations on 50th percentile FMRs will be issued subsequently, and as further discussed in Section VII of this notice. This notice also invokes the Secretary's authority to waive regulatory requirements for exception FMRs in areas affected by Hurricane Katrina and by displacement of residents of the affected area.
