Notice of Availability of a Draft Environmental Impact Statement for the Ashburton Avenue Urban Renewal Plan and Master Plan, Yonkers, Westchester County, NY
The Department of Housing and Urban Development gives notice to the public, agencies, and Indian tribes of the availability of the Draft Environmental Impact Statement (EIS) for review and comment for: (1) The Ashburton Avenue Urban Renewal Plan and Ashburton Avenue Master Plan and (2) the Mulford Gardens HOPE VI Revitalization Plan in the City of Yonkers, Westchester County, New York. The Draft EIS was prepared by the City of Yonkers, NY acting under its authority as the Responsible Entity for compliance with the National Environmental Policy Act of 1969 (NEPA) in accordance with 24 CFR 58.4. The Draft EIS has been prepared to satisfy the requirements of both NEPA and the New York State Environmental Quality Review Act of 1978, as amended (6 NYCRR part 617). The EIS and NEPA process will also be used to address historic preservation and cultural resource issues under Section 106 of the National Historic Preservation Act, 16 U.S.C. 470f. This notice is given in accordance with the Council on Environmental Quality regulations at 40 CFR parts 1500-1508. The Draft EIS analyzes two interrelated actions: (1) The Ashburton Avenue Master Plan and Urban Renewal Plan and (2) the Mulford Gardens HOPE VI Revitalization Plan. The analysis of the Ashburton Avenue Master Plan and Urban Renewal Plan consists of a broad or generic discussion of the potential impacts resulting from the adoption of the two broad planning documents. The analysis of the Mulford Gardens HOPE VI Revitalization Plan, which is geographically contained within the Master Plan and Urban Renewal Area, is a site-specific analysis. Due to the timing of these two actions, both the generic Draft EIS for the Master Plan and Urban Renewal Plan and the site-specific EIS for the HOPE VI Revitalization Plan are contained in this one document. Each of the chapters in the document contains discussion and analysis for both the generic Master Plan and Urban Renewal Plan and the site-specific HOPE VI Revitalization Plan.
Public Housing Graduation Incentive Bonus Program; Correction
On June 2, 2005, HUD published its notice of funding availability (NOFA) for the Public Housing Graduation Incentive Bonus program. The NOFA includes a provision that disqualifies applicants that request funding in excess of the applicable maximum award. The Department has determined that this provision was erroneously included in this NOFA. This notice corrects this error by removing the provision from the NOFA. Except for the changes discussed here, and the other technical change published on July 29, 2005, the original NOFA published on June 2, 2005, is unchanged.

Notice of Submission of Proposed Information Collection to OMB; Loss Mitigation Evaluation
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. Mortgagees servicing HUD insured mortgages are required to document all loss mitigation efforts for delinquent loans and to submit the documentation to HUD if requested.
Notice of Submission of Proposed Information Collection to OMB; Builder's Certification/Guarantee and New Construction Subterranean Termite Soil Treatment Record
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. This is a request for approval to continue the request for the subject information from the public. Builders must certify HUD insured structures are free of termite hazards. An authorized pest control company must perform treatments for termites. The builder guarantees the treated area against infestation for one year.
Revisions to the Public Housing Operating Fund Program
This rule amends the regulations of the Public Housing Operating Fund Program (Operating Fund Program) to provide a new formula for distributing operating subsidy to public housing agencies (PHAs) and to establish requirements for PHAs to convert to asset management. HUD developed the final rule with the active participation of PHAs, public housing residents, and other relevant parties using the procedures of the Negotiated Rulemaking Act of 1990. These regulatory changes improve and clarify the current regulations governing the Operating Fund Program and take into consideration the recommendations of the congressionally funded study by the Harvard University Graduate School of Design on the cost of operating well-run public housing. The final rule follows publication of an April 14, 2005, proposed rule, and takes into consideration the public comments received.
Notice of Submission of Proposed Information Collection to OMB; Single Family Mortgage Insurance on Hawaiian Homelands
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. This information collection documents the native status of Hawaiian borrowers to meet statutory requirements of the single-family mortgage insurance program for Hawaiian Homelands and to assist borrowers in resolving defaults.
Notice of Submission of Proposed Information Collection to OMB; Request for Credit Approval of Substitute Mortgagor
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. A buyer may assume an FHA-insured mortgage by becoming the substitute mortgagor through the credit approval process. Prior to releasing a seller from liability on the mortgage note or for mortgages after December 15, 1989, HUD or a Direct Endorsement (DE) lender must review the credit of the assumer and record the approval.

Government National Mortgage Association: Excess Yield Securities
The Government National Mortgage Association (Ginnie Mae) is developing a new program under which Ginnie Mae will guarantee securities backed by the excess servicing income relating to one or more mortgage pools or loan packages underlying previously issued Ginnie Mae mortgage-backed securities (Excess Yield Securities). This proposed rule would clarify the authority of Ginnie Mae to guarantee this new product and would provide Ginnie Mae the opportunity to consider public comment before implementing the program.
Notice of HUD's Fiscal Year (FY) 2005 Notice of Funding Availability Policy Requirements and General Section to SuperNOFA for HUD's Discretionary Grant Programs; Community Development Technical Assistance NOFA; Competition Reopening Announcement
On March 21, 2005, HUD published its Fiscal Year (FY) 2005, Notice of Funding Availability (NOFA) Policy Requirements and General Section to the SuperNOFA for HUD's Discretionary Grant Programs. The CD-TA NOFA competition, which was included in the SuperNOFA, closed on June 1, 2005. This document announces the reopening of the CD-TA NOFA competition.
Mixed-Finance Development for Supportive Housing for the Elderly or Persons With Disabilities and Other Changes to 24 CFR Part 891
This final rule implements statutory changes that enable the use of mixed-finance and for-profit participation in the Section 202 Supportive Housing program for the elderly and the Section 811 Supportive Housing program for persons with disabilities, as well as makes other changes to those programs. The rule uses the mixed-finance development model to leverage the capital and expertise of the private developer community to create attractive and affordable supportive housing developments for the elderly and for persons with disabilities. In addition, the rule provides for the leveraging of low-income housing tax credits as well as other sources of funding. The rule sets standards for the participation of limited partner investors (who may be for-profit entities) in partnership with a sole-purpose nonprofit general partner; describes eligible fees and expenses; lays out the use of capital advances in the mixed-finance context; and covers other matters relevant to mixed-finance development of these projects. This final rule follows an interim rule published on December 1, 2003, and takes into consideration public comments on the interim rule.

Notice of Funding Availability for Fiscal Year (FY) 2004 HOPE VI Main Street Grants; Notice of Extension of Application Submission Date for Areas Affected by Hurricane Katrina
This notice announces that HUD has extended the submission deadline date for the Fiscal Year (FY) 2004 HOPE VI Main Street Grants Notice of Funding Availability (NOFA) for those applicants located in areas designated by the President as disaster areas, and other areas that experienced major power outages due to Hurricane Katrina. These areas include the entire state of Louisiana; the entire state of Mississippi; the Alabama counties of Baldwin, Bibb, Calhoun, Clarke, Choctaw, Green, Hale, Jefferson, Mobile, Shelby, Sumter, Tuscaloosa, and Washington; and the Florida counties of Broward, Miami-Dade, Monroe, and Palm Beach. The application submission deadline for this funding opportunity was September 2, 2005. For those applicants located in one of these states or counties, the revised submission date is September 7, 2005 at 5:15 p.m. For applicants unaffected by Hurricane Katrina, the submission deadline remains unchanged.

Eligibility of Firefighters and Emergency Medical Technicians To Participate in the Officer Next Door Sales Program
This notice announces the eligibility of firefighters and emergency medical technicians to purchase HUD-acquired homes located in HUD-designated revitalization areas at a discount, in accordance with HUD's regulations for the Officer Next Door (OND) Sales Program. Inclusion in the OND Sales Program is designed to help more firefighters and emergency responders become homeowners, and will further the goals of the OND Sales Program to accelerate the revitalization of America's cities by promoting the integration of dedicated role models and mentors into the community. Elsewhere in today's Federal Register, HUD has published a proposed rule that would establish the Good Neighbor Next Door (GNND) Sales Program. The GNND Sales Program would build upon and replace the existing OND Sales Program and Teacher Next Door Sales Program, combining them into one broader program. The proposed rule, when made final, will codify the eligibility of law enforcement officers, teachers, firefighters and emergency medical technicians to participate in the new Good Neighbor Next Door Sales Program.
Disposition of HUD-Acquired Single Family Property; Good Neighbor Next Door Sales Program
This proposed rule would establish regulations for HUD's new Good Neighbor Next Door (GNND) Sales Program. The requirements for the new program are closely modeled on those for HUD's Officer Next Door (OND) and Teacher Next Door (TND) Sales Programs. The GNND Sales Program would replace and build upon the success of these two existing sales programs. The purpose of the GNND Sales Program is to improve the quality of life in distressed urban communities by encouraging law enforcement officers, teachers, and firefighters/emergency responders whose daily responsibilities and duties represent a nexus to the needs of the community to purchase and live in homes in these communities. Although the requirements governing the new GNND Sales Program would be similar to the existing requirements for the Officer and Teacher Next Door Sales Programs, HUD is also proposing to make several important modifications and improvements to the existing requirements.

Mortgage and Loan Insurance Programs Under the National Housing Act-Debenture Interest Rates
This notice announces changes in the interest rates to be paid on debentures issued with respect to a loan or mortgage insured by the Federal Housing Administration (FHA) under the provisions of the National Housing Act (the Act). The interest rate for debentures issued under section 221(g)(4) of the Act during the 6-month period beginning July 1, 2005, is 4\7/8\ percent. The interest rate for debentures issued under any other provision of the Act is the rate in effect on the date that the commitment to insure the loan or mortgage was issued, or the date that the loan or mortgage was endorsed (or initially endorsed if there are two or more endorsements) for insurance, whichever rate is higher. The interest rate for debentures issued under these other provisions with respect to a loan or mortgage committed or endorsed during the 6-month period beginning July 1, 2005, is 4\1/2\ percent. However, as a result of a recent amendment to section 224 of the Act, if an insurance claim relating to a mortgage insured under sections 203 or 234 of the Act and endorsed for insurance after January 23, 2004, is paid in cash, the debenture interest rate for purposes of calculating a claim shall be the monthly average yield, for the month in which the default on the mortgage occurred, on United States Treasury Securities adjusted to a constant maturity of 10 years.
Notice of Regulatory Review
The Office of Federal Housing Enterprise Oversight (OFHEO) is issuing notice of a regulatory review that will be conducted in accordance with the process set forth in OFHEO Policy Guidance titled, ``Regulatory Review,'' which was issued on April 2, 2001 (Doc. : PG-01-001) (Policy Guidance). OFHEO will review its regulations to consider whether existing regulations have become inefficient or create unwarranted burden, and will identify possible revisions where such conditions are found. OFHEO is seeking public comment on its regulations for consideration in the regulatory review.
