Changes in Certain Multifamily Mortgage Insurance Premiums

In accordance with HUD regulations, this notice announces the changes of the mortgage insurance premiums (MIP) for the following Federal Housing Administration (FHA) multifamily mortgage insurance programs whose commitments will be issued or reissued in Fiscal Year (FY) 2006: All sections of the National Housing Act where the mortgagor equity is produced from the proceeds of the sale of low- income housing tax credits (LIHTC): The MIP is reduced to 45 basis points. Section 207/223(f) refinance or purchase of apartments: The MIP is reduced to 45 basis points. Section 223(a)(7) refinance of FHA insured apartment mortgages: The MIP is reduced to 45 basis points. Under the Department of Housing and Urban Development Reform Act of 1989, Pub. L. 101-235 (approved December 15, 1989) and HUD's implementing instructions, a sponsor is required to submit a certification regarding governmental assistance, including any low- income housing tax credits, with all mortgage insurance applications.

Section 8(c)(1) of the United States Housing Act of 1937 (USHA) requires the Secretary to publish FMRs periodically, but not less than annually, to be effective on October 1 of each year. On June 2, 2005, HUD published a notice on proposed fair market rents (FMRs) for Fiscal Year (FY) 2006. In the June 2, 2005, notice, HUD advised that it would also publish a separate notice to identify any areas that may be newly eligible for 50th percentile FMRs as well as any areas that remain eligible or that are no longer eligible for 50th percentile FMRs, as provided in HUD's regulations. This notice provides this information. It identifies 24 areas eligible for 50th percentile FMRs, which consists of areas that remain eligible for 50th percentile FMRs plus areas that are newly eligible.

On March 21, 2005, HUD published its Fiscal Year (FY) 2005 Notice of Funding Availability, Policy Requirements and General Section to the SuperNOFA for HUD's Discretionary Programs (SuperNOFA). The FY2005 SuperNOFA announced that, for the first time and consistent with the Administration's Electronic Government (E-Government) Initiative, applicants for HUD funding would be required to submit their applications electronically through the governmentwide grant portal, Grants.gov. While to date, the majority of applicants have been submitting successfully their applications electronically through Grants.gov, other applicants were found to have experienced difficulties with electronic submission to such an extent that they were unable to successfully submit their applications. This notice announces that HUD is taking action to respond to these concerns and is conducting a quality assurance review to identify applicants that correctly followed all electronic application submission procedures, including registration for electronic submission, but were unable to submit an application because of technological problems. This notice provides HUD's review procedures as well as outlines the application submission procedures an applicant may follow if HUD determines that the applicant complied with all electronic submission requirements of the FY2005 SuperNOFA but was unable to submit an application because of technological difficulties. If HUD makes this determination, the applicant will be contacted by HUD and invited to submit a paper application.

This proposed rule would revise HUD's regulations governing the disposition of multifamily projects that are HUD-owned or secured by a HUD-held mortgage which are being foreclosed to implement statutory amendments made by the Consolidated Appropriations Act, 2004. The proposed rule would require a potential purchaser of such a project to certify that all other properties owned by the purchaser, and located in the same city or town as the project being purchased, are in substantial compliance with applicable state or local government housing statutes, regulations, ordinances, and codes. A potential purchaser of a multifamily project, from a state or local government that previously had acquired the property from HUD would also be required to submit evidence of substantial compliance with applicable state or local housing requirements. The proposed rule would also expand the scope of the participation and compliance requirements for HUD's Federal Housing Administration programs to include purchasers of multifamily housing projects from state or local governments, in cases where the property had previously been acquired by the state or local government from HUD.
