This voluntary collection allows TSA to conduct transportation security- related assessments during site visits with security and operating officials of certain surface transportation modes.

The Transportation Security Administration (TSA) is amending its interpretive rule that provides guidance to the public on the types of items that TSA considers to be weapons, explosives, and incendiaries, which are prohibited in airport sterile areas, in the cabins of aircraft, or in passengers' checked baggage. This document adds a limited type of unpressurized gas cylinders for air guns used in competitive shooting to those items that may be placed in checked baggage but continue to be prohibited in sterile areas and aircraft cabins. This document also provides clarification on prohibited sharp objects and certain self-defense items.

Vetting of Certain Surface Transportation Employees

The Transportation Security Administration (TSA) is proposing a regulation to implement provisions of the Implementing Recommendations of the 9/11 Commission Act of 2007 (9/11 Act) that require security vetting of certain public transportation, railroad, and over-the-road-bus (OTRB) employees. In accordance with the 9/11 Act, TSA proposes to require security-sensitive employees of certain public transportation operators and railroads to undergo a Level 2 security threat assessment (STA) that includes an immigration check and terrorism watchlist check to determine whether the applicant may pose a security threat. Further, TSA proposes to require security coordinators of certain public transportation, railroad, and OTRB operators to undergo a Level 3 STA, which includes the Level 2 check plus a criminal history records check. TSA proposes appeal and waiver procedures for individuals who are adversely impacted by the vetting. Finally, TSA proposes to establish user fees to recover TSA's costs for vetting, as required by law.

To carry out this purpose, the information collection involves watch lists used by TSA to determine the prescreening status of individuals based on Secure Flight Passenger Data (SFPD) submitted by covered aircraft operators. TSA is revising this collection to reduce the number of non-governmental entities with access to the federal watch lists.
Exemption for Exclusive Area Agreements at Certain Airports

The Transportation Security Administration (TSA) has statutory authority to grant an exemption from a regulation if TSA determines the exemption is in the public interest. TSA is granting an exemption from an aviation security regulation to permit eligible airport operators to enter into Exclusive Area Agreements (EAA) with Amazon Air, subject to requirements set forth in the Exemption. Also, TSA is rescinding an exemption issued on July 26, 2021, that permitted three airports to enter into EAAs with Amazon Air, as they are now covered by this exemption.

In this final rule, the Department of Homeland Security (DHS) makes the 2023 annual inflation adjustment to its civil monetary penalties. On November 2, 2015, the President signed into law The Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (the 2015 Act). Pursuant to the 2015 Act, all agencies must adjust their civil monetary penalties annually and publish the adjustment in the Federal Register. Accordingly, this final rule adjusts the Department's civil monetary penalties for 2023 pursuant to the 2015 Act and Executive Office of the President (EOP) Office of Management and Budget (OMB) guidance. The new penalties will be effective for penalties assessed after January 13, 2023 whose associated violations occurred after November 2, 2015.
