This joint Coast Guard and Environmental Protection Agency (EPA) temporary interim rule will suspend oil spill response time requirements, and certain identification and location requirements, for facilities and vessels whose response resources are relocated in support of the Deepwater Horizon SONS response. By providing oil spill removal organizations (OSROs), and facilities and vessels with their own response resources, with the temporary opportunity to relocate response resources from current locations to the Gulf of Mexico, this rule directly assists in the urgently needed immediate relocation of nationwide oil spill response resources to the Gulf of Mexico to aid in the response to the Deepwater Horizon SONS. The rule also provides notice that the Federal On-Scene Coordinator for the Deepwater Horizon SONS has requested the Armed Forces to relocate Armed Forces oil spill response resources, in particular those of the Navy, from their current locations to the Gulf of Mexico to aid in the response to the Deepwater Horizon SONS.

The Coast Guard is correcting a temporary final rule that appeared in the Federal Register on June 15, 2010 (75 FR 33696). The temporary final rule established a temporary safety zone on the waters of Port Gardner Bay, Washington in support of the City of Everett Fourth of July fireworks display and this correction reflects the correct positioning of the display. The safety zone is necessary to protect the maritime public from dangers associated with the fireworks display and will do so by restricting vessels from congregating in close proximity to the fireworks discharge site during the display. Entry into, transit through or mooring within this safety zone is prohibited unless authorized by the Captain of the Port or Designated Representative.

Commander, Ninth Coast Guard District, issued a temporary deviation from the regulation governing the operation of the Broadway Street Bridge at Mile 0.79, Water Street Bridge at Mile 0.94, Saint Paul Avenue Bridge at Mile 1.21, the Clybourn Street Bridge at Mile 1.28, Michigan Street Bridge at Mile 1.37, and the Wisconsin Avenue Bridge at Mile 1.46 over the Milwaukee River at Milwaukee, WI, during the scheduled Festa Italiana, and the Summerfest public events for the 2010 season.

The Coast Guard is withdrawing its notice of proposed rulemaking concerning the proposed change to the regulations that governed the operation of the Figure Eight Swing Bridge, at AIWW mile 278.1, at Scotts Hill, NC. The requested change would have allowed the drawbridge to open on signal every hour on the half hour for the passage of pleasure vessels.

The Coast Guard proposes that operating procedures on the Rob Roy Drawbridge across the Arkansas Waterway at mile 67.4 at Pine Bluff, AR be revised in the Code of Federal Regulations to reflect that vessel operators contact the remote drawbridge operator via microphone keying on VHF-FM Channel 12 when requesting a draw opening. This keying activates an indicator on the remote drawbridge operator's console and sends an acknowledgement tone back to the vessel and the remote drawbridge operator then establishes normal verbal radio communications. This protocol is used to isolate and differentiate these radio communications from the railroad communications that the remote drawbridge operator receives, thus ensuring that vessel calls receive immediate attention.

This rule makes non-substantive changes throughout Title 33 of the Code of Federal Regulations. The purpose of this rule is to make conforming amendments and technical corrections to Coast Guard navigation and navigable waters regulations. This rule will have no substantive effect on the regulated public. These changes are provided to coincide with the annual recodification of Title 33 on July 1.

The U.S. Coast Guard is establishing a temporary safety zone covering the waters of the Columbia River in the vicinity of Stevenson, Washington. The safety zone is necessary to help ensure the safety of the maritime public during the fireworks display and will do so by prohibiting all persons and vessels from entering the safety zone unless authorized by the Captain of the Port or his designated representative.

The Coast Guard will enforce Lights on the Lake Fireworks Display safety zone for South Lake Tahoe, from 8:30 a.m. on July 1, 2010 through 10 p.m. on July 4, 2010 in position 38[deg]57'56'' N, 119[deg]57'21'' W (NAD83). This action is necessary to control vessel traffic and to ensure the safety of event participants and spectators. During the enforcement period, unauthorized persons or vessels are prohibited from entering into, transiting through, or anchoring in the safety zone, unless authorized by the Patrol Commander (PATCOM).

The Coast Guard will enforce the Independence Day Celebration for the City of San Francisco Fireworks safety zone from 11 a.m. through 10 p.m. on July 4, 2010. The fireworks will be fired simultaneously from two separate locations. This action is necessary to control vessel traffic and to ensure the safety of event participants and spectators. During the enforcement period, unauthorized persons or vessels are prohibited from entering into, transiting through, or anchoring in the safety zone, unless authorized by the Patrol Commander (PATCOM).

The Coast Guard will enforce Kings Beach 4th of July Fireworks safety zone from 7 a.m. through 10 p.m. on July 3, 2010 in position 39[deg]13'55.37'' N, 120[deg]01'42.26'' W (NAD83). This action is necessary to control vessel traffic and to ensure the safety of event participants and spectators. During the enforcement period, unauthorized persons or vessels are prohibited from entering into, transiting through, or anchoring in the safety zone, unless authorized by the Patrol Commander (PATCOM).

The Coast Guard will enforce the Tahoe City 4th of July Fireworks Display safety zone, from 9 a.m. through 10 p.m. on July 4, 2010 in position 39[deg]10'09.09'' N, 120[deg]08'16.33'' W (NAD83). This action is necessary to control vessel traffic and to ensure the safety of event participants and spectators. During the enforcement period, unauthorized persons or vessels are prohibited from entering into, transiting through, or anchoring in the safety zone, unless authorized by the Patrol Commander (PATCOM).

The Coast Guard will enforce the safety zones for annual fireworks events in the Captain of the Port Detroit zone from 9 p.m. on June 23, 2010 through 11 p.m. on September 6, 2010. This action is necessary and intended to ensure safety of life on the navigable waters immediately prior to, during, and immediately after fireworks events. Enforcement of the safety zones will establish restrictions upon, and control movement of, vessels in a specified area immediately prior to, during, and immediately after fireworks events. During the enforcement periods, no person or vessel may enter the safety zone without permission of the Captain of the Port.

The Coast Guard is establishing a temporary safety zone on Marquette Harbor, Lake Superior, Marquette, MI. This zone is intended to restrict vessels from a portion of Marquette Harbor during the Marquette 4th of July Fireworks display. This temporary safety zone is necessary to protect spectators and vessels from the hazards associated with a firework display.

The Coast Guard is establishing a 700-foot radius safety zone on the navigable waters of Buggs Island Lake in Clarksville, VA in support of the Fireworks for the Virginia Lake Festival event. This action is intended to restrict vessel traffic movement to protect mariners and spectators from the hazards associated with aerial fireworks displays.

The Coast Guard is establishing a temporary safety zone on Lake Michigan near Michigan City, Indiana. This zone is intended to restrict vessels from a portion of Lake Michigan due to a high speed boat racing event. This temporary safety zone is necessary to protect the surrounding public and their vessels from the hazards associated with a high speed boat racing event.

The Coast Guard is establishing a temporary safety zone on the waters of Lake Michigan within Chicago Harbor, Chicago, Illinois. This zone is intended to restrict vessels from a portion of Chicago Harbor due to a fireworks display. This temporary safety zone is necessary to protect the surrounding public and vessels from the hazards associated with a fireworks display.

This document corrects the preamble to a proposed rule published in the Federal Register on June 17, 2010, entitled ``Bulk Solid Hazardous Materials: Harmonization With the International Maritime Solid Bulk Cargoes (IMSBC) Code.'' This correction provides correct information with regard to the preliminary environmental analysis checklist.

The Coast Guard is establishing a permanent Special Local Regulation on the navigable waters of Long Island Sound between Port Jefferson, NY and Captain's Cove Seaport, Bridgeport, CT due to the annual Swim Across the Sound event. This special local regulation is necessary to provide for the safety of life by protecting swimmers and their safety craft from the hazards imposed by marine traffic. Entry into this zone is prohibited unless authorized by the Captain of the Port Long Island Sound, New Haven, CT.

The Coast Guard is establishing a temporary safety zone on the Chesapeake Bay in the vicinity of Ocean View Beach Park, Norfolk, VA in support of the Shore Thing & Independence Day Fireworks event. This action is intended to restrict vessel traffic movement on the Chesapeake Bay to protect mariners from the hazards associated with fireworks displays.

The Coast Guard is establishing a temporary safety zone on the waters of the Alligator River at East Lake, North Carolina. The safety zone is intended to temporarily restrict vessel traffic movement in the zone area and is necessary to provide for the safety of mariners on navigable waters during maintenance on the U.S. Highway 64 Swing Bridge.

The Coast Guard is establishing a temporary safety zone in the navigable waters of Weber Point off Stockton, CA in support of a July 4th fireworks display. This safety zone is established to ensure the safety of participants and spectators from the dangers associated with the pyrotechnics. Unauthorized persons or vessels are prohibited from entering into, transiting through, or remaining in the safety zone without permission of the Captain of the Port or his designated representative.

The Coast Guard is establishing a temporary safety zone on East Moran Bay, Lake Huron, St. Ignace, MI. This zone is intended to restrict vessels from a portion of Lake Huron during the Festivals & Fireworks Celebration fireworks display taking place on ten separate occasions from June 26, 2010 through September 5, 2010. This temporary safety zone is necessary to protect spectators and vessels from the hazards associated with fireworks displays.

The Coast Guard is establishing a temporary safety zone in the navigable waters of Suisun Bay off Pittsburg, CA in support of a July 4th fireworks display. This safety zone is established to ensure the safety of participants and spectators from the dangers associated with the pyrotechnics. Unauthorized persons or vessels are prohibited from entering into, transiting through, or remaining in the safety zone without permission of the Captain of the Port or his designated representative.

The Coast Guard proposes to harmonize its regulations with International Maritime Organization (IMO) amendments to Chapter VI and Chapter VII to the International Convention for the Safety of Life at Sea, 1974, as amended, (SOLAS) that make the International Maritime Solid Bulk Cargoes (IMSBC) Code mandatory. The amendments require that all vessels subject to SOLAS and carrying bulk solid cargoes other than grain must comply with the IMSBC Code. The Coast Guard proposes to amend its regulations governing the carriage of solid hazardous materials in bulk to allow use of the IMSBC Code as an equivalent form of compliance for all domestic and foreign vessels operating in U.S. navigable waters. Proposed changes to the Coast Guard regulations will also expand the list of solid hazardous materials authorized for bulk transportation by vessel and include special handling procedures based on the IMSBC Code and existing special permits. These proposed changes would reduce the need for the current special permits for the carriage of certain solid hazardous materials in bulk.

The Coast Guard is establishing a 420-foot radius safety zone on the navigable waters of Cape Charles City Harbor in Cape Charles, VA, in support of the Fourth of July Fireworks event. This action is intended to restrict vessel traffic movement to protect mariners and spectators from the hazards associated with aerial fireworks displays.
