The NPRM is being withdrawn because of multiple objections to the proposed change from users of that waterway.

This document supplements the Coast Guard's September 2009 proposal to amend Anchorage Ground No. 19 located east of the Edgewater-Weehawken Federal Channel on the Hudson River. The revised proposal is necessary to facilitate safe navigation and provide safe and secure anchorages for vessels operating in the area. This supplemental notice of proposed rulemaking amends the NPRM that incorrectly stated that the current Edgewater-Weehawken Federal Channel would be relocated as part of the proposal to amend Anchorage Ground No. 19. This SNPRM also cancels two proposed changes to the Anchorage Regulation discussed in the NPRM and provides an additional opportunity for comment on the proposed changes to the regulations for Anchorage 19.

The deviation is necessary to allow the Quad Cities Marathon to cross the bridge. This deviation allows the bridge to be maintained in the closed to navigation position for four hours from 7:30 a.m. to 11:30 a.m. on September 26, 2010.

In addition, this rule provides for the temporary suspension of all vessel traffic within the regulated navigation area during certain periods of construction. Congress requires that classification societies conducting certain work in the United States must either be full members of International Association of Classification Societies (IACS) or approved by the Coast Guard. In this proposed rule, the Coast Guard proposes application procedures and performance standards that classification societies must meet in order to be approved. Through this proposed rule, the Coast Guard seeks to improve marine safety and environmental protection by assuring the consistency and quality of work conducted by classification societies that review, examine, survey, or certify the construction, repair, or alteration of a vessel in the United States.

Commander, Ninth Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the Duluth Aerial Bridge across the Duluth Ship Canal, mile 0.25, at Duluth, MN. This deviation will test a change to the drawbridge operation schedule to determine whether a permanent change to the schedule is needed. The deviation will allow scheduled openings on the hour and half-hour for vessels under 300 gross tons from May 3 to October 29, 2010, between the hours of 6 a.m. and 9 p.m., seven days per week. The bridge will open on signal for all vessels from 9 p.m. to 6 a.m., and at all times for Federal, state, and local government vessels used for public safety, vessels in distress, commercial vessels engaged in rescue or emergency salvage operations, vessels engaged in pilot duties, vessels seeking shelter from severe weather, and all commercial vessels 300 gross tons or greater.

Inland Navigation Rules

By this final rule, the Coast Guard is placing the Inland Navigation Rules into the Code of Federal Regulations. This move is in accordance with the Coast Guard and Maritime Transportation Act of 2004, which repeals the Inland Navigation Rules as of the effective date of these regulations. Future updates of the Inland Navigation Rules will be accomplished through rulemaking rather than legislation.

The Coast Guard is establishing a safety zone on the navigable waters of Mission Bay in support of the Sea World Summer Nights Fireworks. This safety zone is necessary to provide for the safety of the participants, crew, spectators, participating vessels, and other vessels and users of the waterway. Persons and vessels are prohibited from entering into, transiting through, or anchoring within this safety zone unless authorized by the Captain of the Port, or his designated representative.

The Commander, Fifth Coast Guard District has issued a temporary deviation from the regulations governing the operation of the Berkley Bridge (I-264), across the Elizabeth River, Eastern Branch, mile 0.4, at Norfolk, VA. The deviation is necessary to facilitate structural repairs to the lift spans. This deviation allows the drawbridge to remain in the closed to navigation position.
