Survival Craft Equipment-Update to Type Approval Requirements

Draft Guidance for Nationally Consistent Coastal Zone Area Contingency Plan Architecture

The Coast Guard announces the availability, in the docket, of a draft guidance document intended to establish a new, nationally consistent architecture for coastal zone Area Contingency Plans (ACPs). ACPs are required by the Clean Water Act and demonstrate the planning for oil and hazardous substance incident response at the local level. ACPs for areas within the coastal zone are approved by the Coast Guard. To modernize coastal ACPs, improve usability and attain national consistency the Coast Guard is developing new policy pertaining to ACP architecture. This new, standardized construct will better enable industry plan writers of vessel and facility response plans with multiple, diverse operating areas to consistently align with Coast Guard approved ACPs. A more standardized approach will minimize confusion due to highly variable ACP structure and content and will also facilitate more efficient response, especially for large sale responses requiring mobilization of personnel and resources from outside the region. Additionally, adopting a nationally consistent architecture will facilitate the Coast Guard's development of more modern, app-based ACP products for end users.

Pilots' Medical Certificate Validity Period

The Coast Guard is issuing this final rule to extend the maximum validity period of merchant mariner medical certificates issued to first-class pilots, and masters or mates serving as pilot, from 2 years to 5 years. We are issuing this rule in response to federal advisory committee recommendations and a petition for rulemaking. This rule will reduce the frequency of medical certificate application submissions to the Coast Guard. The rule maintains the requirement for pilots to complete annual physicals and provides the Coast Guard opportunity to review the medical examinations of pilots who may become medically unqualified between medical certificate applications; therefore, the rule does not compromise safety.
Hazardous Materials Endorsement (HME) Threat Assessment Program and Transportation Worker Identification Credential (TWIC®) Program Fees

The Transportation Security Administration (TSA) administers the Hazardous Materials Endorsement (HME) and Transportation Worker Identification Credential (TWIC[supreg]) vetting programs. TSA conducts security threat assessments (STAs) of applicants to these programs, and in accordance with statutory requirements, collects fees from the applicants to recover TSA's costs to conduct the vetting and credentialing. In this Notice, TSA announces changes to the existing fee structure and fees for the HME and TWIC Programs to include initial in-person applications, in-person renewals, comparable STAs, and new online renewal fees. These updates will allow TSA to continue to improve the HME and TWIC enrollment experience, mitigate potential security risks, and ensure that the programs remain fully funded. The Coast Guard announces its intent to enter into a cooperative research and development agreement (CRADA) with companies to evaluate autonomous detection and tracking systems to determine its potential use in Search and Rescue planning. The Coast Guard will provide video output from various sensors to detect and characterize targets for search along with collaboratively developing methods to evaluate the effectiveness of the autonomous detection and tracking systems to allow for the integration with accepted search planning systems and methodologies. From a recent demonstration, the Coast Guard is currently considering partnering with Zelim to investigate their artificial intelligence-based casualty detection system, SARBox, and solicits public comment on the possible participation of other parties in the proposed CRADA, and the nature of that participation. The Coast Guard also invites other potential non-Federal participants, who have the interest and capability to bring similar contributions to this type of research, to consider submitting proposals for consideration in similar CRADAs.

The Coast Guard will enforce the Delaware River, Philadelphia, PA; Safety Zone from 9:15 p.m. through 10 p.m. on November 12, 2022, to provide for the safety of life on navigable waterways during a barge- based fireworks display. Our regulation for marine events within the Fifth Coast Guard District identifies the regulated area for this event in Philadelphia, PA. During the enforcement period, the operator of any vessel in the regulated area must comply with directions from the Patrol Commander or any Official Patrol displaying a Coast Guard ensign.

This notice corrects the October, 25, 2022 notice announcing the appointment of members of the FY 2022 Senior Executive Service (SES) Performance Review Boards (PRBs) for the Department of Homeland Security (DHS). The purpose of the PRBs is to make recommendations to the appointing authority (i.e., Component head) on the performance of senior executives (career, noncareer, and limited appointees), including recommendation on performance ratings, performance-based pay adjustments, and performance awards. The PRBs will also make recommendations on the performance of Transportation Security Executive Service, Senior Level, and Scientific and Professional employees. To make its recommendations, the PRBs will review performance appraisals, initial summary ratings, any response by the employee, and any higher- level official's findings.

BNSF Railway Bridge Across the Missouri River Between Bismarck and Mandan, North Dakota; Final Environmental Impact Statement

The Coast Guard announces the availability of a Final Environmental Impact Statement (EIS) for the proposed replacement of the BNSF Railway Bridge across the Missouri River between Bismarck and Mandan, North Dakota. This was prepared in compliance with the National Environmental Policy Act of 1969 (NEPA) and Council on Environmental Quality implementing regulations, and the National Historic Preservation Act (NHPA). This final EIS evaluates the potential environmental consequences of permitting the replacement of the existing BNSF Railway Bridge across the Missouri River between the cities of Bismarck and Mandan, ND, or the construction of a bridge adjacent to the existing bridge. The applicant proposes to remove the existing structure, which is eligible for listing on the National Register of Historic Places. The Coast Guard analyzed proposed alternatives, through the NEPA and NHPA processes, which included alternatives to construct the new bridge while retaining the existing bridge. The Coast Guard is making the final EIS available to the public on this docket. Section 4.0 of the final EIS identifies the preferred alternative, which is to construct a new bridge with 200-foot spans, and piers 20 feet upstream of the existing bridge, and to remove the existing structure.
