The Department of Homeland Security (DHS or the Department) is amending its regulations governing the process by which U.S. Citizenship and Immigration Services (USCIS) selects H-1B registrations for the filing of H-1B cap-subject petitions (or H-1B petitions for any year in which the registration requirement is suspended), by generally first selecting registrations based on the highest Occupational Employment Statistics (OES) prevailing wage level that the proffered wage equals or exceeds for the relevant Standard Occupational Classification (SOC) code and area(s) of intended employment.

This final rule adopts, with minor technical edits, an interim final rule with request for comments published in the Federal Register on May 13, 2020, establishing standards and procedures by which the Federal Emergency Management Agency (FEMA) may require certain contracts or orders that promote the national defense be given priority over other contracts or orders and setting new standards and procedures by which FEMA may allocate materials, services, and facilities to promote the national defense under emergency and non-emergency conditions pursuant to section 101 of the Defense Production Act of 1950, as amended. These regulations are part of FEMA's response to the ongoing COVID-19 emergency.

While this information collection continues to include the Flood Mitigation Assistance (FMA) and Pre- Disaster Mitigation (PDM) programs, it introduces the Building Resilient Infrastructure and Communities (BRIC) program, and addresses the process for using a BRIC fiscal year (FY) 20 National Competition Panel Review Expression of Interest Form to solicit panel members to review competitive BRIC grant applications. After reviewing all the comments submitted, FEMA has decided to use the BRIC FY20 National Competition Panel Review Expression of Interest Form to solicit interest from potential panelists.
Delayed Deployment Date for Modification of Test Program Regarding Electronic Foreign Trade Zone Admission Applications for Expanded Zone Identification Numbers

This notice announces that the deployment date for the expanded zone identification number modifications to the electronic Foreign Trade Zone admission applications test is delayed until April 25, 2021. On September 25, 2020, U.S. Customs and Border Protection published a notice in the Federal Register announcing modifications to the electronic FTZ admission applications test including, inter alia, the expansion of the zone identification number from seven to nine digits. These zone identification number changes were to have been implemented on January 25, 2021, and this notice announces that the deployment date in the Automated Commercial Environment is delayed until April 25, 2021.

Removal of Certain Explosive Chemicals From the Chemical Facility Anti-Terrorism Standards

The Cybersecurity and Infrastructure Security Agency (CISA) is considering removing all 49 Division 1.1 explosive chemicals of interest from Appendix A of the Chemical Facility Anti-Terrorism Standards (CFATS) regulations. Currently, both CISA and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) regulate facilities possessing these chemicals for security concerns. Removing these chemicals of interest from coverage under CFATS would reduce regulatory requirements for facilities currently covered by both CFATS and ATF's regulatory frameworks and relieve compliance burdens for a small number of affected facilities.

Safety Zone; Super Bowl LV; Hillsborough Bay and River, Tampa, FL

The Coast Guard is proposing to establish a temporary safety zone on certain waters of Garrison Channel, Seddon Channel Turning Basin, and the Hillsborough River, in the vicinity of downtown Tampa, Florida during the Super Bowl LV celebrations from January 29, 2021, through February 7, 2021. The safety zone is necessary to protect the public and Super Bowl event personnel from the hazards associated with potential vessel traffic within the area of the safety zone. All persons and vessels would be required to transit through the safety zone at a steady speed and may not slow down, stop or anchor except in the case of unforeseen mechanical failure or other emergency unless given prior authorization from the Captain of the Port. Any person or vessel forced to slow or stop in the established zone must immediately notify the Captain of the Port Tampa via VHF channel 16. We invite your comments on this proposed rulemaking.
