This final rule clarifies the role and purpose of the Letter of Recommendation (LOR) issued by the Coast Guard Captain of the Port regarding the suitability of a waterway for liquefied natural gas (LNG) or liquefied hazardous gas (LHG) marine traffic. It also establishes a separate process for reconsideration of LORs by the Coast Guard. The process applies only to LORs issued after the effective date of the rule.

The Coast Guard is establishing a temporary safety zone in the navigable waters of the San Francisco Bay near Yerba Buena Island, CA in support of the Bay Bridge Construction Safety Zone from November 1, 2012 through July 31, 2013. This safety zone is being established to protect mariners transiting the area from the dangers associated with over-head construction operations. Unauthorized persons or vessels are prohibited from entering into, transiting through, or remaining in the safety zone without permission of the Captain of the Port or their designated representative.

This action is a supplemental notice of proposed rulemaking (SNPRM) to the Coast Guard's October 24, 2012, notice of proposed rulemaking (NPRM) that proposed to establish a security zone during activities associated with the Presidential Inauguration in Washington, DC from January 15, 2013 through January 24, 2013 (77 FR 64943). This supplemental proposal extends the southern boundary of the proposed security zone. This rule prohibits vessels and people from entering the security zone and requires vessels and persons in the security zone to depart the security zone, unless specifically exempt under the provisions in this rule or granted specific permission from the Coast Guard Captain of the Port Baltimore. This action is intended to temporarily restrict vessel traffic in portions of the Potomac and Anacostia Rivers during the event.

The Coast Guard is establishing five special local regulations during the month of December for holiday boat parades which are scheduled to occur on the navigable waterways in vicinities of Fort Lauderdale, Pompano Beach, Palm Beach, Boynton Beach, Delray Beach, and Miami, Florida. These special local regulations are necessary to protect the public from the hazards associated with marine parades. The special local regulations consist of a series of moving zones, to include buffer areas, around participant vessels as they transit the navigable waters of the United States during these events. Persons and vessels that are not participating in the marine parade are prohibited from entering, transiting through, anchoring in, or remaining within any of the regulated areas unless authorized by the Captain of the Port Miami or a designated representative.

These records were destroyed in accordance with the applicable records retention schedule, with the following exceptions: (1) Records for individuals who were an actual match to a government watchlist; and (2) records for individuals who were a close match but subsequently cleared as not posing a potential or actual threat to transportation. This notice reflects that these two categories of records from the Transportation Worker Identification Credentialing Prototype Phase must continue to be retained in accordance with the applicable records retention schedule, and will be maintained under the authority of the Department of Homeland Security/ Transportation Security Administration-002 Transportation Security Threat Assessment System System of Records (May 19, 2010, 75 FR 28046), which covers the Security Threat Assessment process associated with the Transportation Worker Identification Credentialing and other Transportation Security Administration vetting programs.

On July 30, 2012, FEMA published in the Federal Register a proposed flood hazard determination notice at FR 77 44651 that contained a table which included a Web page address through which the Preliminary Flood Insurance Rate Map (FIRM), and where applicable, the Flood Insurance Study (FIS) report for the communities listed in the table could be accessed. The information available through the Web page address has subsequently been updated. The table provided here represents the proposed flood hazard determinations and communities affected for Mecklenburg County, North Carolina, and Incorporated Areas.

As part of its January 2011 report on a Coast Guard investigation into the citizenship of owners of a publicly traded company, the National Vessel Documentation Center recommended requesting comments and information on the various measures that publicly traded companies employ to comply with the statutory requirement that at least 75 percent of the ownership of companies that operate vessels engaged in the coastwise trade be vested in U.S. citizens. On November 3, 2011, the Coast Guard published a notice in the Federal Register seeking those comments and that information. The Coast Guard read the written submissions and listened to oral comments generated by that notice and issues today's notice to inform industry and the public on how the Coast Guard plans to exercise its discretion in enforcing the referenced U.S. citizen ownership requirement.

Drawbridge Operation Regulation; Shark River (South Channel), Avon Township, NJ

The Coast Guard is removing the existing drawbridge operation regulation that governs the opening of the S35 Bridge, mile 0.9, across Shark River (South Channel) at Avon Township, NJ. The existing regulation contains a drawbridge operation schedule for the S35 Bridge. However, the existing bridge was modified in 2006 from a movable bridge to a fixed bridge. Since the bridge is no longer a movable bridge, the regulation controlling the opening and closing of the bridge is no longer necessary.

The remote drawbridge operator will ensure the drawspan can safely be opened, immediate move it to the open to navigation position, and then maintain constant contact with the vessel until it has completely transited the bridge.

This action is necessary to prevent maritime traffic from interfering with spilled oil recovery operations, removal of sunken recreational vessels, debris, and cargo containers, and to ensure the safety of the response crews on scene. It will do so by prohibiting vessels from entering or remaining in the RNA unless authorized by the COTP or his Designated Representative.

The Coast Guard has issued a temporary deviation from the operating schedule that governs the LA 302 (Kerner) swing span bridge across the Barataria Bayou, mile 35.7, at Lafitte, Louisiana. The deviation is necessary to allow a movie production crew to safely film at the bridge site. This deviation allows the bridge to remain closed to navigation for 12 hours on two separate nights.

This rule identifies communities where the sale of flood insurance has been authorized under the National Flood Insurance Program (NFIP) that are scheduled for suspension on the effective dates listed within this rule because of noncompliance with the floodplain management requirements of the program. If the Federal Emergency Management Agency (FEMA) receives documentation that the community has adopted the required floodplain management measures prior to the effective suspension date given in this rule, the suspension will not occur and a notice of this will be provided by publication in the Federal Register on a subsequent date. Also, information identifying the current participation status of a community can be obtained from FEMA's Community Status Book (CSB). The CSB is available at https://www.fema.gov/fema/csb.shtm.
