The Federal Emergency Management Agency (FEMA) has submitted the following information collection to the Office of Management and Budget (OMB) for review and clearance in accordance with the requirements of the Paperwork Reduction Act of 1995. The submission describes the nature of the information collection, the categories of respondents, the estimated burden (i.e., the time, effort and resources used by respondents to respond) and cost, and includes the actual data collection instruments FEMA will use. Since publication of the 60 day proposed collection notice, 72 FR 26140, May 8, 2007, the burden estimates have been changed to correct burden hours and cost estimates. Title: Request for Site Inspection (FEMA Form 90-1) and Landowner's Authorization/Ingress-Egress Agreement. OMB Number: 1660-0030. Abstract: FEMA Temporary Housing Assistance is used to provide mobile homes, travel trailers, or other forms of readily fabricated forms of housing for the purpose of providing temporary housing to eligible applicants or victims of federally declared disasters. This information is required to determine the feasibility of the site for installation of the housing unit and ensured written permission of the property owner is obtained to allow the housing unit on the property to include ingress and egress authorization. The Department of Homeland Security (DHS) invites the general public to comment on new data collection forms for collecting Request for Information (RFI) responses and unclassified white papers and proposals through the Broad Agency Announcement (BAA) Web site. The forms will standardize the collection of information that is both necessary and sufficient for the DHS S&T Directorate to record and track the receipt of RFI responses, unclassified white papers, and proposals. As explained herein, these forms are intended to eliminate cost and delay associated with the submission and review of documents received via non-electronic means and to improve tracking and records keeping. The Department is committed to improving its BAA processes and invites interested persons to comment on the following forms and instructions (hereinafter ``Forms Package'') for the (BAA) program: (1) DHS Science and Technology (S&T) BAA Web Site Registration (DHS FORM 10025), (2) DHS S&T BAA Registration (DHS FORM 10027), (3) DHS S&T BAA White Paper and Proposal Submission (DHS FORM 10026), and (4) DHS S&T RFI Response (DHS FORM 10028). The Commander, Eighth Coast Guard District has issued a temporary deviation from the regulation governing the operations of the Kansas City Southern Railroad Drawbridge, Mile 167.1, Monroe, Louisiana across the Ouachita River. This deviation allows the bridge to remain closed-to-navigation from 8 a.m., beginning November 1, 2007 for up to 18 consecutive days. The deviation is necessary in order to finish repairs on the pivot pier and connect the navigation span to the pivot pier.

This document amends the fee schedule for petitions and applications for immigration and naturalization benefits administered by U.S. Citizenship and Immigration Services. This rule re-adjusts the fees for Forms I-485, ``Application to Register Permanent Residence or Adjust Status,'' and applications for derivative benefits associated with Forms I-485. This rule removes the temporary adjustment of fees promulgated in previously and permits the application of the fees as were originally published in the final rule of May 30, 2007, that became effective on July 30, 2007.

Safe-Harbor Procedures for Employers Who Receive a No-Match Letter

U.S. Immigration and Customs Enforcement is amending the regulations relating to the unlawful hiring or continued employment of unauthorized aliens. The amended regulation describes the legal obligations of an employer, under current immigration law, when the employer receives a no-match letter from the Social Security Administration or receives a letter regarding employment verification forms from the Department of Homeland Security. It also describes ``safe-harbor'' procedures that the employer can follow in response to such a letter and thereby be certain that the Department of Homeland Security will not use the letter as any part of an allegation that the employer had constructive knowledge that the employee referred to in the letter was an alien not authorized to work in the United States. The final rule adds two more examples to the current regulation's definition of ``knowing'' to illustrate situations that may lead to a finding that an employer had such constructive knowledge. These additional examples involve an employer's failure to take reasonable steps in response to either of two events: The employer receives a written notice from the Social Security Administration (such as an ``Employer Correction Request'' commonly known as an employer ``no match letter'') that the combination of name and Social Security account number submitted to the Social Security Administration for an employee does not match agency records; or the employer receives written notice from the Department of Homeland Security that the immigration status or employment-authorization documentation presented or referenced by the employee in completing Form I-9 was not assigned to the employee according to Department of Homeland Security records. (Form I-9 is retained by the employer and made available to DHS investigators on request, such as during an audit.) The rule also states that DHS will continue to review the totality of relevant circumstances in determining if an employer had constructive knowledge that an employee was an unauthorized alien in a situation described in any of the regulation's examples. The ``safe-harbor'' procedures include attempting to resolve the no-match and, if it cannot be resolved within a certain period of time, verifying again the employee's identity and employment authorization through a specified process.

This rule identifies communities, where the sale of flood insurance has been authorized under the National Flood Insurance Program (NFIP), that are scheduled for suspension on the effective dates listed within this rule because of noncompliance with the floodplain management requirements of the program. If the Federal Emergency Management Agency (FEMA) receives documentation that the community has adopted the required floodplain management measures prior to the effective suspension date given in this rule, the suspension will not occur and a notice of this will be provided by publication in the Federal Register on a subsequent date.

This final rule makes a clarifying amendment to the Federal Emergency Management Agency's (FEMA) Touhy regulations. As already provided in the Touhy regulations of the Department of Homeland Security (DHS), of which FEMA is a component, FEMA is adding language to its regulations clarifying that DHS Touhy regulations are applicable to any subject matter not already covered by FEMA's regulations, including but not limited to demands or requests directed to current or former FEMA contractors. This action ensures consistency within DHS with a uniform approach and administration of Touhy regulations, and provides additional clarification with respect to agency organization and practice. This regulation will have no substantive effect on the regulated public.
Privacy Act of 1974: Implementation of Exemptions; Automated Targeting System

The Department of Homeland Security is amending its regulations to exempt certain records from particular provisions of the Privacy Act. Specifically, the Department proposes to exempt certain records of the Automated Targeting System from one or more provisions of the Privacy Act because of criminal, civil, and administrative enforcement requirements. This notice is a republication of the Treasury Department exemption regulation (title 31, Code of Federal Regulations, part 1) which previously covered the Automated Targeting System as part of the Treasury Enforcement Communications System.
