Privacy Act of 1974: Implementation of Exemptions
The Department of Homeland Security is giving notice of a revised and updated system of records pursuant to the Privacy Act of 1974 for the Office of Inspector General, Office of Investigations. In this proposed rulemaking, the Department proposes to exempt portions of this system of records from one or more provisions of the Privacy Act because of criminal, civil and administrative enforcement requirements.
Privacy Act of 1974: System of Records; Transportation Security Threat Assessment System (T-STAS) and Registered Traveler (RT) Operations Files
TSA is altering two existing systems of records under the Privacy Act of 1974. The revisions affect the Transportation Security Threat Assessment System (T-STAS), DHS/TSA 002, and Registered Traveler (RT) Operations Files, DHS/TSA 015, and will update the ``Categories of individuals covered by the system'' section for both systems, and the ``Categories of records in the system'' section for the T-STAS system.
Drawbridge Operation Regulations; Upper Mississippi River, Ft. Madison, Burlington, and Dubuque, IA, and Rock Island Arsenal, IL
The Coast Guard is temporarily revising the operating regulations for the Ft. Madison Drawbridge, mile 383.9, the Burlington RR Drawbridge, mile 403.1, the Illinois Central Railroad Drawbridge, mile 579.9, and the Rock Island Arsenal Drawbridge, mile 482.9, all located along the Upper Mississippi River. The temporary revision established the winter operating schedules for these four drawbridges while still providing for the reasonable needs of navigation.
Agency Information Collection Activities: Submission for OMB Review; Comment Request
The Federal Emergency Management Agency (FEMA) has submitted the following information collection to the Office of Management and Budget (OMB) for review and clearance in accordance with the requirements of the Paperwork Reduction Act of 1995. The submission describes the nature of the information collection, the categories of respondents, the estimated burden (i.e., the time, effort and resources used by respondents to respond) and cost, and includes the actual data collection instruments FEMA will use. Title: The National Flood Insurance ProgramBiennial Report. OMB Number: 1660-0003. Abstract: The NFIP Biennial Report enables FEMA to meet its regulatory requirement under 44 CFR 59.22(b)(2). It also enables FEMA to be more responsive to the ongoing changes that occur in each participating community's flood hazard area. These changes include, but are not limited to, new corporate boundaries, changes in flood hazard areas, new floodplain management measures, and changes in rate of floodplain development. It is also used to evaluate the effectiveness of the community's floodplain management activities. The evaluation is accomplished by analyzing information provided by the community, such as the number of variances and flood plain permits granted by each community in relationship to other information contained in the Biennial Report, as well as other data available in FEMA's Community Information System (CIS). The Biennial Report also provides an opportunity for the National Flood Insurance Program (NFIP) participating communities to request technical assistance in implementing a floodplain management program. FEMA regional offices use this information as a means to know which communities need support and guidance. In addition, the NFIP Biennial Report is one of the tools used to assist FEMA in meeting its regulatory requirement under section 575 of the National Flood Insurance Reform Act of 2004. A ``yes'' answer to Items A-D in Section I of the report will provide the basis for FEMA to follow-up by contacting the community for clarification and/or elaboration regarding changes and activities occurring in a community's flood hazard area. This information will be used in ranking and prioritizing one community's mapping needs against all other communities in the NFIP and for determining how the limited flood hazard mapping funds are allocated for map updates. Affected Public: State, local and Tribal governments. Number of Respondents: 20,500 respondents. Estimated Time per Respondent: 2.49 hours. Estimated Total Annual Burden Hours: 11,375. Frequency of Response: Every two years. National Infrastructure Protection Plan
The purpose of this notice is to inform the public and interested security partners that the draft National Infrastructure Protection Plan (NIPP) Base Plan is available for review and comment. The Department of Homeland Security (DHS) is responsible for developing this comprehensive, integrated national plan for the protection of the Nation's critical infrastructure and key resources under the authority of Homeland Security Presidential Directive-7 (HSPD-7), Critical Infrastructure Identification, Prioritization, and Protection.
Pollution Prevention Equipment
The Coast Guard proposes to revise its pollution prevention equipment regulations to make them consistent with new International Maritime Organization (IMO) guidelines and specifications issued under the International Convention for the Prevention of Pollution from Ships (MARPOL) Annex I. These revisions should effectively implement MARPOL Annex I regulations, reduce the amount of oil discharged from vessels, and eliminate the use of ozone-depleting solvents in equipment tests. The proposed rule would require newly constructed vessels carrying oil in bulk to install cargo monitors that meet revised standards and require all vessels replacing or installing oil separators and bilge alarms to install equipment that meets revised standards. Tests for approval of this equipment would also be revised both to deal with common bilge contaminants and to eliminate the use of ozone-depleting solvents.
Environmental Assessment and Draft Finding of No Significant Impact for the Decommissioning and Excessing of the U.S. Coast Guard Cutter MACKINAW (WAGB-83)
The U.S. Coast Guard (USCG) announces the availability of the Environmental Assessment (EA) and Draft Finding of No Significant Impact (FONSI) for the Decommissioning and excessing of the U.S. Coast Guard Cutter USCGC MACKINAW (WAGB-83) in Cheboygan, Michigan and invites comments as part of the National Environmental Policy Act (NEPA) process. The EA evaluates the environmental and socioeconomic impacts of the Proposed Action. The Draft FONSI records the USCG's determination that the Proposed Action would have no significant impact on the environment. The U.S. Coast Guard also announces the development of a Memorandum of Agreement to resolve potential adverse effects to a historic property and invites comments as part of the public involvement process under Section 106 of the National Historic Preservation Act (NHPA).
National Boating Safety Activities: Funding for National Nonprofit Public Service Organizations
The Coast Guard seeks applications for fiscal year 2006 grants and cooperative agreements from national, nongovernmental, nonprofit public service organizations. The Boating Safety Financial Assistance Program is listed in section 97.012 of the Catalog of Federal Domestic Assistance. These grants and cooperative agreements would be used to fund projects on various subjects promoting recreational boating safety on the national level. This notice provides information about the grant and cooperative agreement application process and some of the subjects of particular interest to the Coast Guard.
Drawbridge Operation Regulations: Jamaica Bay and Connecting Waterways, NY
The Commander, First Coast Guard District, has issued a temporary 90-day deviation from the drawbridge operation regulations to test an alternate drawbridge operation regulation for the Beach Channel Railroad Bridge mile 6.7, across Jamaica Bay, New York. Under this temporary deviation, in effect from December 1, 2005 through February 28, 2006, the bridge may remain closed during the commuter rail rush hours in the morning and afternoon, Monday through Friday, except Federal holidays. The purpose of this temporary deviation is to test an alternate drawbridge operation schedule for 90 days and solicit comment from the public.
Drawbridge Operation Regulations: Taunton River, MA
The Commander, First Coast Guard District, has issued a temporary deviation for the Brightman Street Bridge, at mile 1.8, across the Taunton River between Fall River and Somerset, Massachusetts. Under this temporary deviation the bridge may remain closed from 9 p.m. on December 2, 2005 through 5 a.m. on December 12, 2005. The purpose of this temporary deviation is to facilitate scheduled bridge repairs.
Drawbridge Operation Regulation; Tennessee River, Chattanooga, TN
The Coast Guard is changing the regulation governing the Chief John Ross Drawbridge, mile 464.1, across the Tennessee River at Chattanooga, Tennessee. Under the temporary change, the drawbridge need not open for river traffic and may remain in the closed-to-navigation position from 8 a.m., December 1, 2005 until 8 a.m., July 1, 2006. This temporary change will allow the drawbridge to be maintained in the closed-to-navigation position to allow major repair work to be performed on the bridge.
Drawbridge Operation Regulations: Newtown Creek, Dutch Kills, English Kills, and Their Tributaries, NY
The Commander, First Coast Guard District, has issued a temporary deviation from the drawbridge operation regulations for the Metropolitan Avenue Bridge, mile 3.4, across English Kills at New York City, New York. Under this temporary deviation the bridge may remain in the closed position from November 14, 2005 through November 20, 2005. This temporary deviation is necessary to facilitate scheduled bridge maintenance.

The Great Lakes Regional Waterways Management Forum will hold a meeting to discuss various waterways management issues. Potential agenda items will include navigation, ballast water regulations, Automatic Identification Systems (AIS), waterways management, and discussions about the agenda for the next meeting. The meeting will be open to the public.
Remedial Action Project for Petroleum and Metals Impacted Soil at Passage Island Light Station, Keweenaw County, MI; Environmental Assessment
The U.S. Coast Guard (USCG) announces its intent to prepare an Environmental Assessment (EA) for remedial action associated with petroleum and metals impacted soil at the Passage Island Light Station, Keweenaw County, Michigan. This letter shall serve as notification for a thirty-day scoping period for the Draft EA. This scoping announcement provides interested parties with information on the USCG Passage Island Light Station, existing environment, and proposed action in advance of issuance of the Draft EA for this project. The Draft EA will assess the alternatives to address impacted soil at the light station. The USCG seeks public and agency input on the scope of the Draft EA. Specifically, the USCG requests input on any environmental concerns that the public may have related to the existing impacted soil, the remedial action alternatives, or sources of relevant data or information for inclusion in the Draft EA.
Security Zone; Sea Buoy at the Entrance of St. Mary's River to Kings Bay, GA
The Coast Guard is establishing a temporary moving security zone around foreign naval submarines in transit within the area between 12 nautical miles offshore from the baseline, also known as the shoreline, at the mouth of the St. Mary's River to the Kings Bay Naval Submarine Base, Kings Bay, GA. The security zone includes all waters within 500 yards in any direction of the submarine. The rule prohibits entry into the security zone without the permission of the Captain of the Port (COTP) Jacksonville or his designated representative. Persons or vessels that receive permission to enter the security zone must proceed at a minimum safe speed, must comply with all orders issued by the COTP or his designated representative, and must not proceed any closer than 100 yards, in any direction, to the submarine. This security zone is needed to ensure public safety and to prevent sabotage or terrorist acts against the submarine.
Security Zone; Protection of Military Cargo, Captain of the Port Zone Puget Sound, WA
The Captain of the Port Puget Sound will begin enforcing the Budd Inlet security zone in West Bay, Olympia, Washington on Thursday, October 27, 2005, at 8 a.m. Pacific Daylight Time. The security zone provides for the security of Department of Defense assets and military cargo in the navigable waters of Puget Sound and adjacent waters. The security zone will be enforced until Tuesday, November 1, 2005, at 11:59 p.m. Pacific standard time.

Suspension of Community Eligibility
This rule identifies communities, where the sale of flood insurance has been authorized under the National Flood Insurance Program (NFIP), that are scheduled for suspension on the effective dates listed within this rule because of noncompliance with the floodplain management requirements of the program. If FEMA receives documentation that the community has adopted the required floodplain management measures prior to the effective suspension date given in this rule, the suspension will not occur and a notice of this will be provided by publication in the Federal Register on a subsequent date.
Security Zone; High Capacity Passenger Vessels and Alaska Marine Highway System Vessels in Alaska
The Coast Guard is revising its proposed rule published March 9, 2005, to establish permanent moving security zones around all escorted High Capacity Passenger Vessels (``HCPV'') and escorted Alaska Marine Highway System Vessels (``AMHS vessels'') during their transit in the navigable waters of the Seventeenth Coast Guard District. The 250-yard speed restriction zone, the 25-yard security zone around moored and anchored vessels, and the waiver request process in the notice of proposed rulemaking (NPRM) have been eliminated. The Coast Guard has revised the proposed security zones prohibiting any vessel from entering within 100 yards of an escorted HCPV or escorted AMHS vessel while in transit. These security zones are necessary to mitigate potential terrorist acts and enhance public and maritime safety and security. Permission to enter these security zones may be granted by the designated on-scene representative.
Merchant Marine Personnel Advisory Committee
A working group of the Merchant Marine Personnel Advisory Committee (MERPAC) will meet to discuss Task Statement 53, ``Medical Certification Standards and Disqualifying Medical Conditions for Merchant Mariners.'' MERPAC advises the Secretary of Homeland Security on matters relating to the training, qualifications, licensing, certification, and fitness of seamen serving in the U.S. merchant marine. This meeting will be open to the public.
Drawbridge Operation Regulations: Saugus River, MA
The Coast Guard has temporarily changed the drawbridge operation regulations that govern the operation of the General Edwards SR1A Bridge, at mile 1.7, across the Saugus River between Lynn and Revere, Massachusetts. This temporary change to the drawbridge operation regulations allows the bridge to remain in the closed position from November 1, 2005 through April 30, 2006. This action is necessary to facilitate structural maintenance at the bridge.

Title: Post Construction Elevation Certificate/Floodproofing Certificate. OMB Number: 1660-0008. Abstract: The Elevation Certificate and Floodproofing Certificate are used in conjunction with the application for flood insurance. The certificates are required for proper rating of post Flood Insurance Rate Map (FIRM) structures, which are buildings constructed after the publication of the FIRM, for flood insurance in Special Flood Hazard Areas. In addition, the Elevation Certificate is needed for pre-FIRM structures being rated under post-FIRM flood insurance rules. The certificates provide community officials and others standardized documents to readily record needed building elevation information. The certificates are supplied to insurance agents, community officials, surveyors, engineers, architects, and NFIP policyholders/ applicants. Surveyors, engineers, and architects complete the Elevation Certificate. Engineers and architects complete the Floodproofing Certificate. Community officials are provided the building elevation information required to document and determine compliance with the community's floodplain management ordinance. NFIP policyholders/ applicants provide the appropriate certificate to insurance agents. The certificate is then used in conjunction with the flood insurance application so that the building can be properly rated for flood insurance. Estimated Time per Respondent: The estimated response time for this collection varies depending on the level of government and the scope of the plan. Response time can be as short as 8 hours for a State's review of a local mitigation plan or as long as 2,080 hours for the actual development of a new mitigation plan. On average the collection takes approximately 545 hours. Estimated Total Annual Burden Hours: 571,200 hours. Frequency of Response: Once every three years with 3/5 year updates. Drawbridge Operation Regulations; Shark River (South Channel), NJ
The Commander, Fifth Coast Guard District, has approved a temporary deviation from the regulations governing the operation of the Route 71 Bridge, at mile 0.8, across Shark River (South Channel), at Belmar, New Jersey. This deviation allows the drawbridge to provide vessel openings upon two hours advance notice each day from 8 a.m. to 3 p.m. and from 6 p.m. to 10 p.m. beginning on Monday, October 31 until Thursday, November 3, 2005, to facilitate emergency mechanical repairs.
Impact Study: Increasing Passenger Weight and Size on Passenger Vessels
The U.S. Coast Guard is conducting a study of the potential impacts that would result from increasing the passenger weight and size regulatory standards used when calculating the intact stability of domestic passenger vessels. The study will include an assessment of the potential impact on industry, identify the regulations potentially requiring change, develop a regulatory implementation strategy and other work associated with the implementation of new passenger weight and size standards.
Adjustment of the Immigration Benefit Application Fee Schedule; Correction
U.S. Citizenship and Immigration Services (USCIS) published a notice in the Federal Register on September 26, 2005 at 70 FR 56182 to increase the fees for immigration benefit applications and petitions to account for cost increases due to inflation. In the fee table of the September 26, 2005 notice, USCIS added a footnote ``6'' next to the new fee for the Form N-600K. Footnote ``6'' shows an increase in fee from $200 to $215 for an application filed on behalf of an adopted child (as compared to the base fee increase from $240 to $255). The placement of this footnote and its lack of specificity regarding which ``application'' it was meant to refer to have created some ambiguity regarding the adopted child fee for the Form N-600, which similarly was adjusted from $200 to $215 (as compared to the new base fee of $255 referenced in the Notice). Accordingly, this notice clarifies the prior notice by amending footnote ``6'' to state specifically that it refers to both the Form N- 600 and the Form N-600K.
