Fossil Fuel-Generated Energy Consumption Reduction for New Federal Buildings and Major Renovations of Federal Buildings

The Energy Conservation and Production Act (ECPA), as amended by the Energy Independence and Security Act of 2007, requires DOE to establish revised performance standards for the construction of new Federal buildings, including commercial buildings, multi-family high- rise residential buildings and low-rise residential buildings. On October 15, 2010, DOE issued a Notice of Proposed Rulemaking (NOPR) to establish regulations implementing the fossil fuel-generated energy provisions of the ECPA performance standards for Federal buildings. In response to the NOPR, DOE received a number of comments expressing concern and encouraging DOE to re-examine the proposed regulations. In response to these comments, DOE has identified additional areas for clarification and consideration that would benefit from further public comment. In this supplemental notice of proposed rulemaking (SNOPR), DOE responds to the comments received on the NOPR and identifies and seeks comment on additional approaches to the scope of the requirements in the context of major renovations, the potential use of renewable energy certificates for compliance, and a streamlined process for agencies to seek a downward adjustment from the required reduction levels, particularly for major renovations.
Green Building Certification Systems for Federal Buildings

The U.S. Department of Energy (DOE) issues a final rule that implements a provision in the Energy Conservation and Production Act, as amended by the Energy Independence and Security Act of 2007, which requires DOE to identify a green building certification system and level that DOE determines to be the most likely to encourage a comprehensive and environmentally-sound approach to certification of green buildings. DOE's green building certification system review must be based on the General Services Administration's review of third-party green building certification systems and levels and criteria outlined in the Energy Independence and Security Act of 2007. Under the regulations established today, if a Federal agency chooses to use a green building certification system for a new building or major renovation covered by today's rule, the green building certification system for Federal buildings must meet the certification standards established in today's rule.

Energy Conservation Program: Test Procedures for External Power Supplies

The U.S. Department of Energy is proposing to revise its test procedure for external power supplies. These proposed revisions, if adopted, would harmonize the instrumentation resolution and uncertainty requirements with the second edition of the International Electrotechnical Commission (IEC) 62301 standard when measuring standby power along with other international standards programs. The proposal would also clarify certain testing set-up requirements. Finally, DOE is proposing an optional test to measure the active-mode efficiency at a 10% loading condition and an optional recording of power factor at this loading condition and each of the other required loading conditions.

Chevron U.S.A. Inc.; Application for Blanket Authorization To Export Previously Imported Liquefied Natural Gas on a Short-Term Basis

The Office of Fossil Energy (FE) of the Department of Energy (DOE) gives notice of receipt of an application (Application), filed on August 27, 2014, by Chevron U.S.A. Inc. (Chevron), requesting blanket authorization to export liquefied natural gas (LNG) previously imported into the United States from foreign sources in an amount up to the equivalent of 72 billion cubic feet (Bcf) of natural gas on a short- term or spot market basis for a two-year period commencing on December 8, 2014.\1\ The LNG would be exported from the Sabine Pass LNG Terminal owned by Sabine Pass LNG, L.P., in Cameron Parish, Louisiana, to any country with the capacity to import LNG via ocean-going carrier and with which trade is not prohibited by U.S. law or policy. Chevron states that it has contracted for 1.0 Bcf/day of terminal capacity from Sabine Pass LNG, L.P., for an initial term of 20 years that will expire June 30, 2029, with the option to extend the term. Chevron states that it does not seek authorization to export domestically-produced natural gas supplies, and notes that it currently holds a blanket authorization to import LNG from various international sources by vessel in an amount up to the equivalent of 800 Bcf of natural gas.\2\ The Application was filed under section 3 of the Natural Gas Act (NGA). EIA has submitted to the Office of Management and Budget (OMB) for clearance, under the provisions of the Paperwork Reduction Act of 1995, for the natural gas survey forms (OMB-1975-0175). EIA requests a three-year clearance for the following forms: EIA 176, ``Annual Report of Natural and Supplemental Gas Supply and Disposition,'' EIA 191, ``Monthly and Annual Underground Natural Gas Storage Report,'' EIA-757, ``Natural Gas Processing Plant Survey,'' EIA 857, ``Monthly Report of Natural Gas Purchases and Deliveries to Consumers,'' EIA-910, ``Monthly Natural Gas Marketer Survey,'' and EIA-912, ``Weekly Underground Natural Gas Storage Report.'' The proposed data collection will make minor changes to the forms and instructions to provide clarity. The number of respondents for EIA- 191, EIA-857 and EIA-757 has been increased to reflect recent survey frame research which has identified new respondents. Data confidentiality procedures for protecting the identifiability of submitted data remain unchanged for all forms with the exception of a portion of Form EIA-191. EIA is also proposing a change to the published revision policy for Form EIA-912, a Principal Federal Economic Indicator. In addition, EIA is proposing specific changes to several of the forms; these changes are described in detail in the ``Supplementary Information'' section below.
