Energy Conservation Program for Consumer Products: Proposed Determination of Miscellaneous Residential Refrigeration Products as Covered Products
Document Number: 2013-25943
Type: Proposed Rule
Date: 2013-10-31
Agency: Department of Energy
The U.S. Department of Energy (DOE) has preliminarily determined that wine chillers and other residential refrigeration products that incorporate a compressor but do not meet the current regulatory definitions for electric refrigerator, refrigerator-freezer, and freezer, qualify for coverage under the Energy Policy and Conservation Act (EPCA) as amended. This proposal also covers residential ice makers. Today's notice supplements an earlier proposed determination in which DOE tentatively concluded that residential refrigeration products that do not incorporate a compressor should be covered by energy conservation standards. As part of its review of residential refrigeration products generally, DOE is soliciting public comment on the feasibility of covering compressor-based miscellaneous residential refrigeration products based on the same criteria that had been evaluated earlier for non-compressor based residential refrigeration products.

Assistance to Foreign Atomic Energy Activities
Document Number: 2013-25551
Type: Proposed Rule
Date: 2013-10-29
Agency: Department of Energy
On September 7, 2011, DOE issued a notice of proposed rulemaking (NOPR) to propose the first comprehensive updating of regulations concerning Assistance to Foreign Atomic Energy Activities since 1986. The NOPR reflected a need to make the regulations consistent with current global civil nuclear trade practices and nonproliferation norms, and to update the activities and technologies subject to the Secretary of Energy's specific authorization and DOE reporting requirements. It also identified destinations with respect to which most assistance would be generally authorized. Remaining destinations would require a specific authorization by the Secretary of Energy. After careful consideration of all comments received, DOE published a supplemental notice of proposed rulemaking (SNOPR) on August 2, 2013, to respond to those comments, propose new or revised rule changes, and afford interested parties an opportunity to comment. A public meeting on the SNOPR was held at DOE's headquarters on August 5, 2013. A second public meeting will be held on November 15, 2013 at the Washington Grand Hyatt, 1000 H St. NW., Washington, DC 20001. In conjunction with the timing of this second public meeting, the Department is extending the comment period to November 29, 2013. The extension will facilitate conducting the second public meeting and afford additional time for the public to review and comment on the proposed regulation. The Department looks forward to hearing feedback from the public on the proposed regulations.

Energy Conservation Program for Consumer Products: Test Procedures for Direct Heating Equipment and Pool Heaters
Document Number: 2013-24352
Type: Proposed Rule
Date: 2013-10-24
Agency: Department of Energy
The U.S. Department of Energy (DOE) proposes to revise its test procedures for direct heating equipment and pool heaters established under the Energy Policy and Conservation Act. This rulemaking will fulfill DOE's statutory obligation to review its test procedures for covered products at least once every seven years. For direct heating equipment, the proposed amendments would add provisions for testing vented home heating equipment that utilizes condensing technology, and to incorporate by reference six industry test standards to replace the outdated test standards which are referred to in the existing DOE test procedure. These industry standards reflect the current practice in test set-up and test conditions for testing direct heating equipment. For pool heaters, the proposed amendments would incorporate by reference ANSI/Air-conditioning, Heating, and Refrigeration Institute (AHRI) Standard 1160-2009, ``Performance Rating of Heat Pump Pool Heaters,'' and ANSI/American Society of Heating, Refrigerating, and Air-conditioning Engineers (ASHRAE) Standard 146- 2011, ``Method of Testing and Rating Pool Heaters,'' to establish a test method for electric pool heaters (including heat pump pool heaters). The proposed amendments would also clarify the test procedure's applicability to oil-fired pool heaters. DOE is also announcing a public meeting to discuss and receive comments on issues presented in this test procedure rulemaking.

Transmission Planning Reliability Standards
Document Number: 2013-24828
Type: Rule
Date: 2013-10-23
Agency: Department of Energy, Federal Energy Regulatory Commission
Under section 215 of the Federal Power Act, the Federal Energy Regulatory Commission approves Transmission Planning (TPL) Reliability Standard TPL-001-4, submitted by the North American Electric Reliability Corporation, the Commission-certified Electric Reliability Organization. Reliability Standard TPL-001-4 introduces significant revisions and improvements by requiring annual assessments addressing near-term and long-term planning horizons for steady state, short circuit and stability conditions. Reliability Standard TPL-001-4 also includes a provision that allows a transmission planner to plan for non-consequential load loss following a single contingency by providing a blend of specific quantitative and qualitative parameters for the permissible use of planned non-consequential load loss to address bulk electric system performance issues, including firm limitations on the maximum amount of load that an entity may plan to shed, safeguards to ensure against inconsistent results and arbitrary determinations that allow for the planned non-consequential load loss, and a more specifically defined, open and transparent, verifiable, and enforceable stakeholder process. The Commission finds in the Final Rule that the proposed Reliability Standard is just, reasonable, not unduly discriminatory or preferential, and in the public interest. In addition, the Commission directs NERC to modify Reliability Standard TPL-001-4 to address the concern that the standard could exclude planned maintenance outages of significant facilities from future planning assessments and directs NERC to change the TPL-001-4, Requirement R1 Violation Risk Factor from medium to high.
