This notice announces receipt of and publishes the Samsung Electronics America, Inc. (Samsung) petition for waiver (hereafter, ``petition'') from specified portions of the U.S. Department of Energy (DOE) test procedure for determining the energy consumption of electric refrigerators and refrigerator-freezers. In its petition, Samsung provides an alternate test procedure that is the same as the test procedure DOE published in an interim final rule. DOE solicits comments, data, and information concerning Samsung's petition and the suggested alternate test procedure. Today's notice also grants Samsung an interim waiver from the electric refrigerator and refrigerator- freezer test procedure, subject to use of the alternative test procedure set forth in this notice.

In compliance with the requirements of the Paperwork Reduction Act of 1995, 44 U.S.C. 3507(a)(1)(D), the Federal Energy Regulatory Commission (Commission or FERC) is submitting the information collection, FERC-592 (Standards of Conduct for Transmission Provider; and Marketing Affiliates of Interstate Pipelines), to the Office of Management and Budget (OMB) for review of the information collection requirements. Any interested person may file comments directly with OMB and should address a copy of those comments to the Commission as explained below. The Commission issued a Notice in the Federal Register (77 FR 70746, 11/27/2012) requesting public comments. The Department of Energy (DOE) has submitted an information collection request to the OMB for reinstatement under the provisions of the Paperwork Reduction Act of 1995. A Federal Register Notice with a 60-Day comment solicitation period on this information collection was published on May 24, 2012, Vol. 77, No. 101, pg. 31000. The information collection requests a three-year approval of its Customer Electricity Data Access and Control Questionnaire, OMB Control Number 1910-5164. The proposed collection will gather and share information about customer access to electricity usage data. The information will be shared on the DOE-supported OpenEI Web site where consumers can learn about the access offered by their electricity provider to energy usage data. Visitors to the Web site will also be able to learn about measures they can take to use energy more efficiently and economically.

The Department of Energy (DOE) announces the availability of the Draft Section 3116 Basis for Determination for Closure of the H Tank Farm at the Savannah River Site (Draft HTF 3116 Basis Document) for public comment. DOE prepared the Draft HTF 3116 Basis Document pursuant to section 3116(a) of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (NDAA), which provides that the Secretary of Energy may, in consultation with the U.S. Nuclear Regulatory Commission (NRC), determine that certain waste from reprocessing of spent nuclear fuel is not high-level radioactive waste if the provisions set forth in section 3116(a) are satisfied. To make this determination, the Secretary of Energy must determine that the waste in the HTF: (1) Does not require permanent isolation in a deep geologic repository for spent fuel or high-level radioactive waste; (2) has had highly radioactive radionuclides removed to the maximum extent practical; and (3)(A) does not exceed concentration limits for Class C low-level waste and will be disposed of in compliance with the performance objectives in 10 CFR Part 61, Subpart C and pursuant to a State approved closure plan or State-issued permit; or (3)(B) exceeds concentration limits for Class C low-level waste but will be disposed of in compliance with the performance objectives of 10 CFR Part 61, Subpart C; pursuant to a State approved closure plan or State-issued permit; and pursuant to plans developed by DOE in consultation with the NRC. Although not required by the NDAA, DOE is making the Draft HTF 3116 Basis Document available for public comment. The Draft HTF 3116 Basis Document demonstrates that the cleaned and stabilized HTF tanks, ancillary structures and their stabilized residuals at HTF closure meet the public dose limits and other criteria in section 3116. DOE is consulting with the NRC and will consider public comments before preparing a final HTF 3116 Basis Document and issuing a Secretarial determination under section 3116.

The Department of Energy (DOE) has submitted an information collection request to the OMB for extension under the provisions of the Paperwork Reduction Act of 1995. The information collection requests a three-year extension of its Human Reliability Program (HRP), OMB Control Number 1910-5122. This information collection consists of forms that will certify to DOE that respondents were advised of the requirements for occupying or continuing to occupy an HRP position. The forms include: Human Reliability Program Certification (DOE F 470.3), Acknowledgement and Agreement to Participate in the Human Reliability Program (DOE F 470.4), Authorization and Consent to Release Human Reliability Program (HRP) Records in Connection with HRP (DOE F 470.5), Refusal of Consent (DOE F 470.6), and Human Reliability Program (HRP) Alcohol Testing Form (DOE F 470.7). The HRP is a security and safety reliability program for individuals who apply for or occupy certain positions that are critical to the national security. It requires an initial and annual supervisory review, medical assessment, management evaluation, and a DOE personnel security review of all applicants or incumbents. It is also used to ensure that employees assigned to nuclear explosive duties do not have emotional, mental, or physical conditions that could result in an accidental or unauthorized detonation of nuclear explosives.
