The Department of Energy (DOE) today publishes a final rule to amend the Department's regulations to decrease the random drug testing rate of DOE contractor employees in testing designated positions (TDP). Today's final rule also makes minor technical changes that delete: A sentence pertaining to specimen collection and handling in order to conform the section with the current U.S. Department of Health and Human Services' Mandatory Guidelines for Federal Workplace Drug Testing Programs; and obsolete references to the Personnel Security Assurance Program and the Personnel Assurance Program.
Reimbursement for Costs of Remedial Action at Active Uranium and Thorium Processing Sites

This Notice announces the Department of Energy (DOE) acceptance of claims in FY 2008 from eligible active uranium and thorium processing sites for reimbursement under Title X of the Energy Policy Act of 1992. For FY 2008, Congress has appropriated approximately $19.8 million for reimbursement of certain costs of remedial action at these sites. The approved amount of claims submitted during FY 2007 and unpaid approved balances for claims submitted in prior years will be paid by April 30, 2008, subject to the availability of funds. If the available funds are less than the total approved claims, these payments will be prorated, if necessary, based on the amount of available FY 2008 appropriations, unpaid approved claim balances (approximately $5.8 million), and claims received in May 2007 (approximately $26 million).

The Department of Energy (DOE) is initiating the rulemaking and data collection process to consider establishing amended energy conservation standards for certain fluorescent lamp ballasts and to consider whether energy conservation standards should apply to additional fluorescent lamp ballasts. Accordingly, DOE will hold an informal public meeting to discuss and receive comments on its planned analytical approach and issues it will address in this rulemaking proceeding. DOE welcomes written comments from the public on this rulemaking. To inform stakeholders and to facilitate this process, DOE has prepared a Framework Document which details the analytical approach and identifies several issues on which DOE is particularly interested in receiving comment. A copy of the Framework Document is available at: https://www.eere.energy.gov/buildings/appliancestandards/resid ential/ fluorescentlampballasts.html. In a separate rulemaking proceeding, DOE plans to review and to consider amendments to the test procedures used for determining the performance of fluorescent lamp ballasts. However, DOE is requesting preliminary comments on the fluorescent lamp ballast test procedure in this Framework Document.
Update of the Federal Energy Regulatory Commission's Fees Schedule for Annual Charges for the Use of Government Lands

In accordance with the Commission's regulations, the Commission by its designee, the Executive Director, is updating its schedule of fees for the use of government lands. The yearly update is based on the most recent schedule of fees for the use of linear rights- of-way prepared by the United States Forest Service. Since the next fiscal year will cover the period from October 1, 2007 through September 30, 2008 the fees in this notice will become effective October 1, 2007. The fees will apply to fiscal year 2008 annual charges for the use of government lands. The Commission has concluded, with the concurrence of the Administrator of the Office of Information and Regulatory Affairs of OMB that this rule is not a ``major rule'' as defined in section 251 of the Small Business Regulatory Enforcement Fairness Act of 1996, 5 U.S.C. 804(2).

Comments are invited on: (a) Whether the extended collection of information is necessary for the proper performance of the functions of the agency, including whether the information shall have practical utility; (b) the accuracy of the agency's estimate of the burden of the proposed collection of information, including the validity of the methodology and assumptions used; (c) ways to enhance the quality, utility, and clarity of the information to be collected; and (d) ways to minimize the burden of the collection of information on respondents, including through the use of automated collection techniques or other forms of information technology.

On November 16, 2007, DOE and the Department of the Interior's Bureau of Land Management (BLM; the ``agencies'') published a notice in the Federal Register (72 FR 64591) announcing the availability of the Draft Programmatic Environmental Impact Statement (Draft PEIS) titled, Designation of Energy Corridors on Federal Land in the 11 Western States (DOE/EIS-0386). That notice also announced that the agencies had scheduled 15 public hearings to receive comments on the Draft PEIS. The agencies now announce that they will hold an additional public hearing in Elko, Nevada.

The Federal Energy Regulatory Commission affirms its basic determinations in Order No. 890, granting rehearing and clarification regarding certain revisions to its regulations and the pro forma open- access transmission tariff, or OATT, adopted in Order Nos. 888 and 889 to ensure that transmission services are provided on a basis that is just, reasonable, and not unduly discriminatory. The reforms affirmed in this order are designed to: (1) Strengthen the pro forma OATT to ensure that it achieves its original purpose of remedying undue discrimination; (2) provide greater specificity to reduce opportunities for undue discrimination and facilitate the Commission's enforcement; and (3) increase transparency in the rules applicable to planning and use of the transmission system.
