Adjustment of Civil Monetary Penalties for Inflation
The Department of Education (Department) issues these final regulations to adjust the Department's civil monetary penalties (CMPs) for inflation. This adjustment is required by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (2015 Act), which amended the Federal Civil Penalties Inflation Adjustment Act of 1990 (Inflation Adjustment Act). These final regulations provide the 2021 annual inflation adjustments being made to the penalty amounts in the Department's final regulations published in the Federal Register on January 14, 2020 (2020 final rule).

Privacy Act of 1974; Matching Program
This provides notice of the re-establishment of the matching program between the U.S. Department of Education (Department) and the Social Security Administration (SSA), which sets forth the terms, safeguards, and procedures under which the SSA will disclose to the Department data related to the Medical Improvement Not Expected (MINE) disability data of beneficiaries and recipients under title II and title XVI of the Social Security Act from the SSA system of records entitled the Disability Control File (DCF) and the Master Beneficiary Record (MBR). This matching program will enable the Department to contact the individuals who have a balance on a loan under title IV of the Higher Education Act of 1965, as amended (HEA), have a title IV loan written off due to default, or have an outstanding service obligation under the Teacher Education Assistance for College and Higher Education (TEACH) Grant Program to inform those borrowers and TEACH Grant recipients of the total and permanent disability (TPD) process. Once informed, those borrowers who wish to apply for a discharge may do so more efficiently and effectively.

The Secretary is providing notice that the newly-enacted Consolidated Appropriations Act, 2021 (the 2021 Appropriations Act) supersedes the Department of Education's (Department's) notice published in the Federal Register on December 23, 2020, that reopened the HEERF grant program application period for certain limited applicants (Reopening Notice). The 2021 Appropriations Act prevents the Department from accepting or processing any applications for new awards under section 18004(a)(1) of the CARES Act (i.e., the ``Student Aid Portion'' program (Catalog of Federal Domestic Assistance Number (CFDA) 84.425E) and the ``Institutional Portion'' program (CFDA 84.425F)).

The Secretary announces dates for State educational agencies (SEAs) to submit expenditure and revenue data and average daily attendance statistics on ED Form 2447 (the National Public Education Financial Survey (NPEFS)) for fiscal year (FY) 2020, revisions to those reports, and revisions to reports for previous fiscal years. The Secretary sets these dates to ensure that data are available to serve as the basis for timely distribution of Federal funds. The U.S. Census Bureau is the data collection agent for this request of the Department of Education's (the Department's) National Center for Education Statistics (NCES). The data will be published by NCES and will be used by the Secretary in the calculation of allocations for FY 2022 appropriated funds.

Notice Reopening the Application Period for Certain Applicants Under the Higher Education Emergency Relief Fund (HEERF), Sections 18004(a)(1), 18004(a)(2), and 18004(a)(3); Coronavirus Aid, Relief, and Economic Security (CARES) Act
The Secretary is reopening the application period for certain institutions of higher education (IHEs) that previously applied for HEERF, CARES Act funds. The Secretary takes this action to specifically allow those eligible applicants that previously submitted timely applications but were denied funding due to technical errors with their submission, additional time to submit their Certifications and Agreements (applications), and associated data submissions for approved information collections under OMB control numbers 1801-0005, 1840-0842, and 1840-0843. This reopening also permits prior applicants that did not apply for the full amount of their allocation within a particular funding stream to resubmit their applications, in order to receive the full allocation amount they were eligible to receive. This reopening does not apply to any IHE that did not apply for HEERF, CARES Act funds during a previous open period, or allow an IHE to apply to a new CARES Act funding stream.
