The Department of Education (``Department'') establishes interim final requirements for the American Rescue Plan Elementary and Secondary School Emergency Relief (``ARP ESSER'') Fund, under section 2001 of the American Rescue Plan (``ARP'') Act of 2021. These requirements are intended to promote accountability, transparency, and the effective use of funds by: Ensuring that each State educational agency (``SEA'') meaningfully engages in stakeholder consultation and takes public input into account in the development of its ARP ESSER plan; ensuring that each local educational agency (``LEA'') develops a plan for the use of its ARP ESSER funds and engages in meaningful consultation and seeks public input as it develops the LEA ARP ESSER plan; and clarifying how an LEA must meet the statutory requirement to develop a plan for the safe return to in-person instruction and continuity of services.

The Department of Education (Department) proposes two priorities for the American History and Civics Education programs, including the Presidential and Congressional Academies for American History and Civics(Academies) and National Activities programs, Assistance Listing Numbers 84.422A and 84.422B. We may use these priorities for competitions in fiscal year (FY) 2021 and later years. We propose these priorities to support the development of culturally responsive teaching and learning and the promotion of information literacy skills in grants under these programs.

The Secretary announces the annual updates to the ICR plan formula for 2021 to give notice to borrowers and the public regarding how monthly ICR payment amounts will be calculated for the 2021-2022 year under the William D. Ford Federal Direct Loan (Direct Loan) Program, Assistance Listing Number 84.063.

The Secretary is announcing the availability of new HEERF grant funding under section 314(a)(2) of the CRRSAA for eligible institutions of higher education (institutions) under the Minority Serving Institutions (MSIs) program, Assistance Listing Number 84.425L, to address needs directly related to the coronavirus. The institutions eligible for funding under this part include institutions that generally would be eligible to apply for the following grant programs under the Higher Education Act of 1965, as amended (HEA), and that are listed on the CRRSAA Section 314(a)(2) MSI Allocation Table: Title V, part A Developing Hispanic-Serving Institutions; Title V, part B Promoting Post-baccalaureate Opportunities for Hispanic Americans; and certain Title III, part A programs for Minority Serving Institutions, which are the Strengthening Asian American and Native American Pacific Islander-Serving Institutions (AANAPISI), Strengthening Alaska Native and Native Hawaiian-Serving Institutions (ANNH), Strengthening Native American-Serving Nontribal Institutions (NASNTI), and Strengthening Predominantly Black Institutions (PBI) programs. The Department of Education (Department) proposes to establish a priority and definition under the Teacher and School Leader Incentive Program (TSL), Assistance Listing Number 84.374A. We may use this priority and definition for competitions in fiscal year (FY) 2021 and later years. We propose a priority that clarifies the extent to which TSL-funded grant project activities are concentrated in High-Need Schools and a definition that clarifies what High-Need School means for the purposes of the TSL program.

The Department of Education (Department) proposes to establish four priorities and one requirement under the Innovative Approaches to Literacy (IAL) program, Assistance Listing Number 84.215G. We may use one or more of these priorities and this requirement for competitions in fiscal year (FY) 2021 and later years. The proposed priorities are intended to expand the range of applicants benefiting from Federal funding and promote greater innovation, by supporting students in urban areas and students from low-income families. The proposed priorities are also designed to enhance the coordination between local educational agencies (LEAs) and school libraries, particularly in carrying out literacy activities, and promote learning environments that are racially, ethnically, culturally, disability and linguistically responsive and inclusive, supportive, and identity-safe.

Consistent with the President's Executive order titled ``Supporting the Reopening and Continuing Operation of Schools and Early Childhood Education Providers,'' the U.S. Department of Education (Department) is requesting information to enable teachers, faculty, staff, schools, districts, institutions of higher education (IHEs), early childhood education providers, other places of educational instruction, and States to share lessons learned and best practices for operating safely and supporting all children and students, including children and students with disabilities, English learners, racial and ethnic minorities, and other underserved children and students, teachers, faculty, and staff during the pandemic. We will consider this information when populating a Safer Schools and Campuses Best Practices Clearinghouse. Responding to the request for information or undertaking any of the lessons learned included in the Clearinghouse are completely voluntary activities and are not prerequisites to receipt of any Federal funding.
