Proposed Waivers and Extensions of Project Periods: Presidential Academies and Congressional Academies
The Secretary proposes to waive the requirements in 34 CFR 75.250 and 75.261(c)(2) of the Education Department General Administrative Regulations (EDGAR), as they apply to projects funded under the Presidential Academies for American History and Civics Education, and 34 CFR 75.261(c)(2), as it applies to the project funded under the Congressional Academies for Students of American History and Civics Education. These regulations, respectively, generally prohibit project periods exceeding five years and any project period extensions involving the obligation of additional Federal funds. A waiver as proposed would mean that (1) the project period for the two current five-year grants funded under the Presidential Academies for American History and Civics Education would be extended through fiscal year (FY) 2012, for up to an additional 24-month budget period, instead of ending in FY 2010, and these grantees could thus receive additional Federal funding (out of FY 2010 funds) beyond the five-year limitation contained in 34 CFR 75.250 and notwithstanding the limitation in 34 CFR 75.261(c)(2) that prohibits extension of a project period if it involves the obligation of additional Federal funds; and (2) the project period of the one current three-year grantee funded under the Congressional Academies for Students of American History and Civics Education would be extended through FY 2012, for up to an additional 24-month budget period, instead of ending in FY 2010, and this grantee would continue to receive additional Federal funds (out of FY 2010 funds) notwithstanding the limitation in 34 CFR 75.261(c)(2) that prohibits extension of a project period if it involves the obligation of additional Federal funds.

On June 23, 2010, we published in the Federal Register (75 FR 35894) a notice inviting applications for new awards using fiscal year (FY) 2009 funds for the Smaller Learning Communities Program. There are errors in two of the dates in that notice. We are correcting those dates in this notice.

Notice of a Waiver of Section 1605 of the American Recovery and Reinvestment Act of 2009 (ARRA) for Indian River Central School District, Philadelphia, New York
In this notice, the Department of Education (the Department) announces its waiver of the Buy American requirements in section 1605(a) of the ARRA (Buy American Requirements) for the Indian River Central School District in Philadelphia, New York (Indian River District) and the justification for this waiver. This waiver permits use of compatible telephones, servers, and software as well as American Power Conversion (APC) power supply and surge suppression equipment in the Indian River District's telecommunications project, which is supported with Impact Aid funds appropriated under the ARRA.

This document corrects errors in the June 14, 2010 notice.
Promise Neighborhoods Program
On May 5, 2010, we published in the Federal Register (75 FR 10492) a notice inviting applications for new awards for FY 2010 for the Promise Neighborhoods Program (May 5 notice). The May 5 notice established a deadline of June 25, 2010, for the submission of applications under this competition. Through this notice, we are correcting the May 5 notice and are extending the deadline for transmittal of applications and the deadline for intergovernmental review.

Smaller Learning Communities Program
The Assistant Secretary for Elementary and Secondary Education announces final priorities, requirements, definition, and selection criteria under the Smaller Learning Communities (SLC) program. The Assistant Secretary may use these priorities, requirements, definition, and selection criteria, in addition to other previously established priorities, definitions and requirements, for a competition using fiscal year (FY) 2009 funds and may use them in later years. We take this action to focus Federal financial assistance on an identified national need. We intend these final priorities, requirements, definition, and selection criteria to enhance the effectiveness of SLC projects in improving academic achievement and helping to prepare students for postsecondary education and careers.

Program Integrity Issues

Vocational Rehabilitation Service Projects for American Indians With Disabilities
The Secretary is adopting as final, without changes, interim final regulations for the American Indian Vocational Rehabilitation Services (AIVRS) program to permit a consortium of Indian tribes to establish a separate legal entity to apply for a grant under this program. These final regulations are needed to enable the Department to make grants to Indian tribes that choose to form a consortium and, rather than authorizing one of the Indian tribes of the consortium to serve as the grantee, create a separate legal entity that serves as the grantee on behalf of the consortium and that is responsible for using the grant funds to provide services to all the Indian tribes in the consortium.
Centers for Independent Living Program-Training and Technical Assistance
The Assistant Secretary for Special Education and Rehabilitative Services announces a priority under the Centers for Independent Living ProgramTraining and Technical Assistance. The Assistant Secretary may use this priority for competitions in fiscal year (FY) 2010, using American Recovery and Reinvestment Act of 2009 (ARRA) funds appropriated for the Centers for Independent Living (CIL) program authorized under title VII, chapter 1, part C of the Rehabilitation Act of 1973, as amended (the Act), and competitions in later years. We take this action to improve outcomes for individuals with significant disabilities by enhancing the quality of independent living (IL) services provided to those individuals and the efficiency of the delivery of those services by CILs funded through the CIL program.

The Department proposes to amend this system of records notice by: (1) Adding a new routine use to allow reporting on the activities of the Inspector General regarding American Recovery and Reinvestment Act funds to the Recovery Accountability and Transparency Board (RATB) as established by the American Recovery and Reinvestment Act of 2009 (Pub.
