Privacy Act of 1974; System of Records-Adult English as a Second Language (ESL) Literacy Impact Study
In accordance with the Privacy Act of 1974, as amended (Privacy Act), the Department of Education (Department) publishes this notice of a new system of records entitled ``Adult English as a Second Language (ESL) Literacy Impact Study'' (18-13-19). The National Center for Education Evaluation and Regional Assistance at the Department's Institute of Education Sciences (IES) commissioned this evaluation. It will be conducted under a contract that IES awarded in September 2004. The study will address the following questions: (1) How effective is instruction based on a literacy workbook in improving the English reading and speaking skills of low-literate adult ESL learners? (2) Is instruction based upon the workbook more effective for certain groups of students (e.g., native Spanish speakers)? (3) How well do instructors implement the instruction based upon the workbook? The system will contain information about approximately 40 adult ESL teachers and two cohorts of approximately 900 adult learners per cohort. Within each cohort, approximately 450 learners will participate in classes in which instruction based upon the literacy workbook is implemented and approximately 450 learners will participate in classes in which instruction that is not based upon the literacy workbook is implemented. The first cohort of learners will be enrolled in adult education classes during the Fall semester of 2008. The second cohort of learners will be enrolled in adult education classes during the Spring semester of 2009. The system of records will include information about the adult learners participating in the evaluation, including names and addresses; demographic information such as race, ethnicity, gender, age, and educational background; and scores on literacy assessments. The system of records will also include information about the teachers participating in the evaluation, including names; demographic information such as race, ethnicity, gender, and educational background; and teaching experience.

Office of Elementary and Secondary Education; Notice Extending the Deadline Date for Transmittal of Part II Applications and the Deadline Date for Intergovernmental Review for the Indian Education Formula Grants to Local Educational Agencies (LEAs) Program for Fiscal Year (FY) 2008
On December 19, 2007, we published in the Federal Register (72 FR 71880) a notice inviting applications for Part I and Part II of the Formula Grant Electronic Application System for Indian Education (EASIE). The December 19, 2007 notice established an April 4, 2008 deadline date for eligible applicants to apply for funding under Part II of the Formula Grants to LEAs program, and provided that applications or data submissions under Part II would be accepted only from those eligible applicants who met the Part I deadline of January 31, 2008. We are extending the Part II application deadline date to April 23, 2008, for those eligible applicants who met the Part I deadline of January 31, 2008. The change in the deadline date for Part II applications is due to the unavailability of the application system for Part II during the dates published in the Federal Register. As a result of this extension of the deadline date for Part II applications, we also are extending the intergovernmental review period required under Executive Order 12372 to July 23, 2008. Applicants must refer to the Application Notice for all other requirements concerning this program.
Family Educational Rights and Privacy
The Secretary proposes to amend the regulations governing education records maintained by educational agencies and institutions under section 444 of the General Education Provisions Act, which is also known as the Family Educational Rights and Privacy Act of 1974, as amended (FERPA). These proposed regulations are needed to implement amendments to FERPA contained in the USA Patriot Act and the Campus Sex Crimes Prevention Act, to implement two U.S. Supreme Court decisions interpreting FERPA, and to make necessary changes identified as a result of the Department's experience administering FERPA and current regulations. These changes would clarify permissible disclosures to parents of eligible students and conditions that apply to disclosures in health and safety emergencies; clarify permissible disclosures of student identifiers as directory information; allow disclosures to contractors and other outside parties in connection with the outsourcing of institutional services and functions; revise the definitions of attendance, disclosure, education records, personally identifiable information, and other key terms; clarify permissible redisclosures by State and Federal officials; and update investigation and enforcement provisions.
The Teacher Education Assistance for College and Higher Education (TEACH) Grant Program and Other Federal Student Aid Programs
The Secretary proposes to amend title 34 of the Code of Federal Regulations to establish regulations for the Teacher Education Assistance for College and Higher Education (TEACH) Grant Program. The TEACH Grant program is a non-need-based grant program that provides up to $4,000 per year to students who are enrolled in an eligible program and who agree to teach in a high-need field, at a low-income elementary or secondary school for at least four years within eight years of completing the program for which the TEACH Grant was awarded. If the grant recipient fails to complete the required teaching service, the TEACH grant is treated as a Federal Direct Unsubsidized Stafford Loan (Federal Direct Unsubsidized Loan). The Secretary also proposes to amend the regulations related to the Student Assistance General Provisions; the General Provisions for the Federal Perkins Loan Program, the Federal Work-Study Program, the Federal Supplemental Educational Opportunity Grant Program; the Federal Perkins Loan Program; the Federal Work-Study Programs; the Federal Supplemental Educational Opportunity Grant Program; the Federal Family Education Loan (FFEL) Program; the William D. Ford Federal Direct Loan Program; and the Federal Pell Grant Program to implement the TEACH Grant Program. These proposed regulations are needed to implement provisions of the Higher Education Act of 1965 (HEA), as amended by the College Cost Reduction and Access Act of 2007 (CCRAA).
