DoD is issuing a final rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement a section of the National Defense Authorization Act for Fiscal Year 2024 that modifies certain definitions associated with the Procurement Technical Assistance Program.

This notice provides the point of contact, address, and telephone number for the Local Redevelopment Authority (LRA) for the Pueblo Chemical Depot, formerly known as the Pueblo Depot Activity, in Pueblo, Colorado to be closed, managed, and disposed of by the Army pursuant to the National Defense Authorization Act (NDAA) for Fiscal Year 2024 and in accordance with procedures and authorities of the Defense Base Closure and Realignment Act of 1990. The Pueblo Depot Activity Development Authority, dba PuebloPlex, was recognized as the LRA by the Secretary of Defense, acting through the DoD, Office of Local Defense Community Cooperation (OLDCC) on July 25, 2024. This rule implements within DoD (the Department) amendments made by the Helping American Victims Afflicted by Neurological Attacks (HAVANA) Act of 2021, which provide authority for the Secretary of State and other agency heads to provide payments to certain individuals who have incurred qualifying injuries to the brain. This rule covers current and former DoD employees, and dependents of current or former DoD employees and is vitally important to those who have experienced such injuries.

As required by the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (NDAA-23), this document proposes to reduce financial harm to civilians who are not covered beneficiaries of the Military Health System (MHS), and who receive healthcare services at DoD military medical treatment facilities (MTF). The rulemaking, once finalized, will implement the MHS Modified Payment and Waiver Program (MPWP) through which the DoD will apply a sliding fee scale and/or a catastrophic fee waiver to medical invoices of certain non-beneficiaries and will accept payments from health insurers of non-beneficiaries as full payment except for copays, coinsurance, deductibles, nominal fees and non-covered services.
