DoD originally determined that rulemaking was required based on the portion of this part that speaks to providing assistance to non-DoD agencies. However, this part places no burden on other agencies. The description of the relationship with other agencies is in accordance with federal law, and this part is unnecessary. Therefore, this part can be removed from the CFR.

The U.S. Army Aviation and Missile Command (AMRDEC) is seeking Cooperative Research and Development Agreement (CRADA) partners to collaborate in transitioning firearm with both gas delayed and stroke piston action into commercial and/or government application(s). Interested potential CRADA collaborators will receive detailed information on the current status of the project after signing a confidentiality disclosure agreement (CDA) with AMRDEC. Under the CRADA, further research, development and testing will be conducted to further refine the principles and prototypes. Based on the results of these experiments a refined fully functioning firearm action could be designed and manufactured. The developed principles and designs might be further modified for other uses outside of the firearms industry.

This final rule removes DoD's regulation concerning the Defense Information Systems Agency (DISA) Freedom of Information Act program. On February 6, 2018, the DoD published a FOIA program final rule as a result of the FOIA Improvement Act of 2016. When the DoD FOIA program rule was revised, it included DoD component information and removed the requirement for component supplementary rules. The DoD now has one DoD-level rule for the FOIA program that contains all the codified information required for the Department. Therefore, this part can be removed from the CFR.

Military Payment Certificates

This final rule removes DoD's regulation concerning Military Payment Certificates (MPC) which are no longer used by the Federal Government nor DoD based on U.S. Treasury guidance and use of Smart Card technology. MPC's were discontinued in the late 1990's based on the U.S. Treasury determining that the remaining stock from the Vietnam War could no longer be used and it would take several years to replace them with new MPCs. The Army determined that going forward, the EagleCash Stored Value Card (SVC) will be used in lieu of MPC.

This final rule removes the Department of Defense (DoD) regulation concerning the Post-9/11 GI Bill. In 2009, when first published, this part included significant information explaining the entire program, including the responsibilities of both DoD and the Department of Veterans Affairs (VA). When the part was revised at 78 FR 34251 on June 7, 2013, however, it only addressed DoD responsibilities, as VA responsibilities are now addressed in that agency's regulations. All burdens and responsibilities pertaining to persons who are not members of the Uniformed Services are addressed in VA regulations, and repeal of this regulation will have no effect on VA regulations. Repealing this rule supports website best practices because the public user is linked to the original and appropriate source, VA. This rule is internal to DoD and should be removed.

The Department of the Navy (DoN) is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (DAJAG) (Admiralty and Maritime Law) has determined that USS CHARLESTON (LCS 18) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

The Missile Defense Agency (MDA) announces its intention to prepare an Environmental Impact Statement (EIS) in accordance with the National Environmental Policy Act (NEPA) of 1969 and the Council on Environmental Quality Regulations for implementing the procedural provisions of NEPA. MDA is proposing to construct and operate a Homeland Defense Radar-Hawaii or HDR-H (a radar to identify, track, and classify long-range ballistic missile threats in mid-course flight), an In-Flight Interceptor Communication System Data Terminal or IDT (a facility that provides communication (incorporating data provided by HDR-H) between the Ground-Based Midcourse Defense fire control system and the interceptor that are both stationed elsewhere), and associated support facilities and infrastructure on the island of Oahu, Hawaii. The purpose of the Proposed Action is to support the United States (U.S.) ballistic missile defense system and enhance homeland defense capabilities in the Pacific region including Hawaii. The 2017 National Defense Authorization Act requires the MDA to develop a plan to procure and field a ``discrimination radar'' to improve the defense of Hawaii from ballistic missile threats. MDA is preparing the EIS to evaluate the potential environmental impacts that could result from the construction and operation of the HDR-H. The Department of Defense has not made a decision concerning the location of where to construct and operate the HDR-H, but has initially evaluated the potential alternatives from a mission requirements standpoint.
