This interim final rule implements Section 716 of the National Defense Authorization Act for Fiscal Year 2013 which establishes a five year pilot program that would generally require TRICARE for Life beneficiaries to obtain all refill prescriptions for covered maintenance medications from the TRICARE mail order program or military treatment facility pharmacies. Covered maintenance medications are those that involve recurring prescriptions for chronic conditions, but do not include medications to treat acute conditions. Beneficiaries may opt out of the pilot program after one year of participation. This rule includes procedures to assist beneficiaries in transferring covered prescriptions to the mail order pharmacy program. This regulation is being issued as an interim final rule in order to comply with the express statutory intent that the program begin early in calendar year 2013. Public comments, however, are invited and will be considered for possible revisions to this rule for the second year of the program.

Section 358 of the Ike Skelton National Defense Authorization Act for Fiscal Year 2011 required the Department of Defense (DoD) to designate a senior official and a lead organization to serve as a clearinghouse for the coordination of DoD review of applications filed with the Secretary of Transportation. Applications referred to the DoD involve proposals for the construction of structures that may affect navigable air space. Section 358 requires DoD to issue procedures for addressing the impacts of those structures on military operations and determining if they pose an unacceptable risk to the national security of the United States. Section 358 requires the establishment of a comprehensive strategy for addressing military impacts of renewable energy projects and other energy projects and annual reports to Congress; these requirements are not part of this rule and will be addressed separately. Nor does this rule deal with other proposal review processes not included in section 358, such as those applied by the Bureau of Land Management, Department of the Interior.

This rule establishes policy, assigns responsibilities, and provides procedures for operational contract support (OCS), including OCS program management, contract support integration, and integration of defense contractor personnel into contingency operations outside the United States. This rule was published as an interim final rule on December 29, 2011, to procedurally close gaps and ensure the correct planning, oversight and management of DoD contractors supporting contingency operations, by updating the existing outdated policy. The then existing policies were causing significant confusion, as they did not reflect current practices and legislative mandates. The inconsistencies between local Geographic Command guidance and the DoD- wide policies and the Defense Federal Acquisition Regulations Supplement were confusing for those in the fieldin particular, with regard to policy on accountability and visibility requirements.

The Per Diem, Travel and Transportation Allowance Committee is publishing Civilian Personnel Per Diem Bulletin Number 290. This bulletin lists revisions in the per diem rates prescribed for U.S. Government employees for official travel in Alaska, Hawaii, Puerto Rico, the Northern Mariana Islands and Possessions of the United States when applicable. AEA changes announced in Bulletin Number 194 remain in effect. Bulletin Number 290 is being published in the Federal Register to assure that travelers are paid per diem at the most current rates.
