Defense Science Board Meeting
The Defense Science Board will meet in closed session on October 28-29, 2009 to discuss interim finding and recommendations resulting from ongoing Task Force activities. The Board will also discuss plans for future consideration of scientific and technical aspects of specific strategies, tactics, and policies as they may affect the U.S. national defense posture and homeland security.

This modification project will be designed to increase wetland restoration outputs. This supplemental EIS will be tiered off of the programmatic final EIS for the Louisiana Coastal Area (LCA)Louisiana, Ecosystem Restoration Study, November 2004, and the final EIS for the LCALouisiana, Freshwater Diversion to Barataria and Breton Sound Basins Study, September 1984. The record of decision (ROD) for the programmatic final EIS was signed on November 18, 2005 and the ROD for the freshwater diversion final EIS was signed on July 16, 1987.

Final Environmental Impact Statement (FEIS) for Stationing and Training of Increased Aviation Assets Within U.S. Army Alaska
The Department of the Army announces the availability of an FEIS for the implementation of the decision to increase numbers and types of aviation assets and training at Fort Wainwright, Fort Richardson, or other military installations in Alaska. The proposed aviation unit, an Aviation Task Force or Combat Aviation Brigade, would potentially consist of up to 62 medium and heavy lift helicopters, 30 combat scout helicopters, 24 attack helicopters, and between 1,200 to 2,850 Soldiers.
Notice of Availability of the Draft Environmental Impact Statement (DEIS) for Grow the Army Actions at Fort Lewis and the Yakima Training Center (YTC), WA
The Department of the Army announces the availability of a DEIS that analyzes the environmental and socioeconomic impacts of implementing the stationing and realignment decisions in the 2007 ``Grow the Army'' Programmatic EIS (GTA PEIS) and other ongoing Army realignment and stationing initiatives pertaining to Fort Lewis and YTC. The GTA PEIS Record of Decision (ROD) specified the stationing of additional units at Fort Lewis including an Expeditionary Sustainment Command, and directed unit restructuring actions that would increase active duty strength at Fort Lewis by approximately 1,900 Soldiers. The DEIS also analyzes Fort Lewis and YTC as potential locations for the stationing of approximately 1,000 combat service support (CSS) Soldiers consisting of quartermaster, medical, transportation, headquarters or other CSS units to support combat operations, and the potential stationing of a medium Combat Aviation Brigade (CAB) consisting of approximately 2,800 soldiers and 110 helicopters.

Notice of Record of Decision for Norfolk Harbor Channel Dredging, Norfolk and Portsmouth, VA
The Department of the Navy (DON), after carefully weighing the operational and environmental consequences of the proposed action, announces its decision to deepen approximately five miles of Norfolk Harbor Channel, the Federal navigational channel in the Southern Branch of the Elizabeth River, separating Norfolk and Portsmouth, Virginia. Dredging in the heavily-used waterway would occur from the Lamberts Point Deperming Station in the Lamberts Bend Reach, south to Naval Support Activity Norfolk Naval Shipyard, commonly referred to as the Norfolk Naval Shipyard (NNSY), in the Lower Reach. Dredged material would be placed at The U.S. Army Corps of Engineers' (USACE) Craney Island Dredged Material Management Area (CIDMMA). The deepening project will establish continuously safe and expeditious transit routes for U.S. Naval Ships to Lamberts Point Deperming Station and NNSY. Dredging would occur completely within the existing USACE-maintained federal navigation channel. Proposed Suspension and Modification of Nationwide Permit 21
In the July 15, 2009, issue of the Federal Register (74 FR 34311) the U.S. Army Corps of Engineers published a proposal to take two actions concerning Nationwide Permit 21, which authorizes discharges of dredged or fill material into waters of the United States for surface coal mining activities. The two proposed actions are to suspend NWP 21 to prohibit its use to authorize surface coal mining activities in the Appalachian region of Kentucky, Ohio, Pennsylvania, Tennessee, Virginia, and West Virginia, and then to modify NWP 21 to make that prohibition permanent until NWP 21 expires on March 18, 2012. In the July 15, 2009, notice we also offered commenters opportunity to request a public hearing. In the August 13, 2009, issue of the Federal Register (74 FR 40815), we extended the comment period to September 14, 2009. We have received several requests to hold public hearings, and have determined that hearings would afford us the opportunity to gain additional information to assist us in reaching decisions on these two proposed actions. Therefore, we will be holding public hearings in each of the six affected states. Written comments to supplement the hearing records may be submitted until October 26, 2009.

This restoration project will examine measures to increase the stability of the land bridge separating Caillou (Sister) Lake from the Gulf of Mexico. This SEIS will tier from the programmatic EIS for the Louisiana Coastal Area (LCA)Louisiana, Ecosystem Restoration Study, November 2004. Army Science Board (ASB)
The notice of an open meeting scheduled for Sep 15, 2009 published in the Federal Register on August 31, 2009 (74 FR 44828) has a revised classification and agenda. The survivability and deployability study of ground platforms session (1230-1330) will be a classified session at the Secret clearance level. A second unclassified session (1345-1430) has been added to adopt recommendations from the ASB Installation 2025 study. The meeting will now be adjourned at 1445 EDT.

Federal Acquisition Regulation; FAR Case 2008-027, Federal Awardee Performance and Integrity Information System
The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) are proposing to amend the Federal Acquisition Regulation (FAR) to implement Section 872 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009. Section 872 requires the General Services Administration to establish and maintain a data system containing specific information on the integrity and performance of covered Federal agency contractors and grantees. Section 872 also requires awarding officials to review the data system and consider other past performance information when making any past performance evaluation or responsibility determination.
Federal Acquisition Regulation; FAR Case 2008-016, Termination for Default Reporting
The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) are proposing to amend the Federal Acquisition Regulation (FAR) to establish procedures for contracting officers to provide contractor information into the Past Performance Information System (PPIRS). This case sets forth requirements for reporting defective cost or pricing data and terminations for cause or default. Evaluation of past performance information, especially terminations, manages risks associated with timely, effective and cost efficient completion of contracts, a key objective of the President's March 4, 2009, Memorandum on Government Contracting.

Intent To Prepare a Second Supplemental Environmental Impact Statement to the Final EIS on Herbert Hoover Dike Major Rehabilitation and Evaluation Report, Reaches 2 and 3 (Belle Glade to Moore Haven), in Palm Beach, Hendry, and Glades Counties, FL
Herbert Hoover Dike is the levee and water control system that provides flood protection to communities surrounding Lake Okeechobee. The purpose of this project is to evaluate rehabilitation solutions for Reaches 2 and 3 of the dike so that the authorized level of flood protection can be provided to reduce the risk of a catastrophic failure or breach of the embankment. Reaches 2 and 3 of the HHD extend for approximately 27 miles between an area west of Belle Glade, Palm Beach County to east of Moore Haven, Glades County, FL. On July 8 2005, the Jacksonville District, U.S. Army Corps of Engineers (Corps) issued a Final Supplemental Environmental Impact Statement (FSEIS) for the Major Rehabilitation actions proposed for Herbert Hoover Dike (HHD), Reach 1. On September 23, 2005, a Record of Decision was signed adopting the preferred alternative as the Selected Plan for Reach 1.
TRICARE; Extended Care Health Option
The Department of Defense is publishing this proposed rule to implement the requirements enacted by Congress in Section 732 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 which changes the limit of the Government's share of providing certain benefits under the Extended Care Health Option (ECHO) from $2,500 per month to $36,000 per year, and for other non-legislated changes to the ECHO.

TRICARE; Off-Label Uses of Devices; Partial List of Examples of Unproven Drugs, Devices, and Medical Treatments or Procedures
The Department of Defense is publishing this proposed rule to revise the definition of ``unlabeled or off-label drug'' to ``off-label use of a drug or device.'' This revision is consistent with the regulatory framework under the Federal Food, Drug, and Cosmetic Act. Additionally, this rule removes the partial list of examples of unproven drugs, devices, and medical treatments or procedures proscribed in TRICARE regulations. As it is determined that reliable evidence demonstrates that previously unproven drugs, devices, and medical treatments or procedures have proven medical effectiveness, TRICARE has removed them from the list and authorized medically necessary care. This revision removing the partial list is necessary as the list will never be completely current, and is only a partial list of examples. The removal of this partial list does not change or eliminate any benefits that are currently available under the TRICARE program.
TRICARE; Reimbursement of Critical Access Hospitals (CAHs)
This rule implements the statutory provisions that TRICARE payment methods for institutional care be determined to the extent practicable in accordance with the same reimbursement rules as those that apply to payments to providers of services of the same type under Medicare. This final rule implements a reimbursement methodology similar to that furnished to Medicare beneficiaries for services provided by critical access hospitals (CAHs).
Certifications and Exemptions Under the International Regulations for Preventing Collisions at Sea, 1972
The Department of the Navy is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (Admiralty and Maritime Law) has determined that USS NEW MEXICO (SSN 779) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

Disestablishment of Restricted Area for Pascagoula Naval Station, Pascagoula, MS
The U.S. Navy (USN) requested that the U.S. Army Corps of Engineers (Corps) disestablish the restricted area at the former Naval Station Pascagoula in Pascagoula, Mississippi. The restricted area was established on November 9, 1992. The purpose of the restricted area was to reduce safety hazards and security risks and protect persons and property from dangers encountered in the area. As a result of the 2005 Base Realignment and Closure Act, the Naval Station was closed on June 1, 2007, and the property transferred to the State of Mississippi.

The restricted area was established on November 9, 1992. The purpose of the restricted area was to reduce safety hazards and security risks and protect persons and property from dangers encountered in the area. As a result of the 2005 Base Realignment and Closure Act, the Naval Station was closed on June 1, 2007, and the property transferred to the State of Mississippi. In the ``Rules and Regulations'' section of Federal Register, we are publishing the restricted area disestablishment as a direct final rule without prior proposal because we view this as a non-controversial adjustment to our restricted area regulations and anticipate no adverse comment. We have explained our reasons for this approval in the preamble to the direct final rule. If we receive no adverse comment, we will not take further action on this rule and it will go into effect. If we receive adverse comment, we will withdraw the direct final rule

Under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Federal Acquisition Regulation (FAR) Secretariat will be submitting to the Office of Management and Budget (OMB) a request to review and approve a reinstatement of a previously approved information collection requirement concerning Commerce Patent Regulations.

Notice of Intent to Grant a Partially Exclusive Patent License; Sanofi Pasteur S.A.
The Department of the Navy hereby gives notice of its intent to grant to Sanofi Pasteur S.A., a revocable, nonassignable, partially exclusive license to practice worldwide the Government owned inventions described in U.S. Patent Application Serial No. 11/340,003 with inventor Stephen J. Savarino filed on 10 January 2006, entitled ``Adhesin as Immunogen Against Enterotoxigenic E. coli'' and its related PCT/US2006/000660 National Phase applications in Australia, Canada, Europe, Japan and India filed 11 July 2007; and U.S. Patent Application Serial No. 11/988,598 with inventors Stephen J. Savarino, Randall K. Holmes and Michael Jobling filed on 11 January 2007, entitled ``Adhesin-Enterotoxin Chimera Based Composition Against Enterotoxigenic E. coli'' and its related PCT/US2007/000712 National Phase applications in Australia, Canada, Europe, and Japan filed 10 January 2008 in the field of ``Protection against ETEC (Enterotoxigenic Escherichia Coli) associated diarrhea in both endemic zones and for travelers, including the military.''
Federal Acquisition Regulation; FAR Case 2009-009, American Recovery and Reinvestment Act of 2009 (the Recovery Act)-Reporting Requirements
The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (the Councils) are issuing this notice to inform Federal contractors that the Recovery Accountability and Transparency Board (``Board'') has announced the availability of registration at federalreporting.gov. Federal contractors required to report on their use of Recovery Act funds by FAR clause 52.204-11 are encouraged to register early.
Federal Acquisition Regulation; FAR Case 2009-005, Use of Project Labor Agreements for Federal Construction Projects
The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) are proposing to amend the Federal Acquisition Regulation (FAR) to implement Executive Order (E.O.) 13502, Use of Project Labor Agreements for Federal Construction Projects. The comment period is being reopened for an additional 30 days to provide additional time for interested parties to review the proposed FAR changes.
Certifications and Exemptions Under the International Regulations for Preventing Collisions at Sea, 1972
The Department of the Navy is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (Admiralty and Maritime Law) has determined that USS PROVIDENCE (SSN 719) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.
